Statement of the Matter
This item is being submitted for Council consideration in order to
provide the City with current prevailing wage rates as required by
the Labor Code of California for contracts involving public works.

' Concur with staff. This is a routine matter and is required
by law: The City Council may either advertise the prevailing
.wage rate with Qach Public Works contract advertised, or it
may annually adopt a prev'aiiing wage rate schedule. The,
adoption of the resolution will provide.for the annual adoption.

PREVAILING WAGE RATES
The Labor Code of the State of California states:
"The body awarding any contract for public work, or otherwise under-
taking any public work, shall ascertain the general prevailing rate
of per diem wages and the general prevailing rate for holiday and
overtime work in the locality in which the public work is to be
performed for each craft, classification or type of workman needed
to execute the contract. The holidays upon which such rates shall
be paid need not be specified by the awarding body, but shall be
i all holidays recognized in the collective bargaining agreement
applicable to the particular craft, classification or type of work-
man employed on the project."
The City of Carlsbad, being a body that awards contracts for public
works, therefore has a requirement for ascertaining the general prevail-
ing rate of per diem wages. The City in the past has complied with this
provision by publishing the rates in the Carlsbad Journal, and recently
by maintaining on file in the City Clerk's office current wage resolutions
and wage determinations. There is a need to up -date the resolution to
incorporate the amendments to the Labor Law and to ascertain the current
prevailing wages in the local area.
The State Labor Code gives the following guidance on determining wage rates:
"In determining such -rates, the awarding body shall ascertain and
consider the applicable wage rates established by collective bargain-
ing agreements and such rates as may have been predetermined for
federal public works, within the locality and in the nearest labor
market area. Where such rates do not constitute the rates actually
prevailing in the locality, the awarding body shall obtain and consider
further data from the labor organizations and employers or employer
associations concerned, including the recognized collective bargaining
representatives for the particular craft, classification or type of
work involved. The rate fixed for each craft, classification or type
of work shall be not less than the prevailing rate paid in such craft,
classification or type of work."
The City staff did determine rates as may be predetermined for federal
public works. The Secretary of Labor has recently stated that wage
determination as required by the Davis -Bacon Act for public works projects

financed by federal funds are published in the Federal Register and may
be used when applicable. The City of Carlsbad does not at present receive
the Federal Register; therefore, further data was obtained from other
sources. The State of California Labor Relations Board was contacted as
to the best source of wage determinations. The Labor Relations Board
staff recommended the Building Trades Council of San Diego as a source

of wage rates. The Building Trades Council was contacted and subsequently
provided the City staff with a copy of their current wage information
sheets.
