Statement of the Matter

At that time, it was anticipated that these revisionsrevised n

Exhibit "1" is a request of the applicant that Council reconsider A.B. 1
at the March 6, 197^, meeting and that the subject zone change, Specific
Plan and Tentative Map be scheduled for hearing at a subsequent hearing.
The major concern at the public hearings was the traffic circulation in
this area, particularly with respect to Adams St. Staff recommended approval
of the subject applications at that time. Public hearings and Council
action on the Land Use and Circulation Elements are still several months
away. However, consideration of traffic circulation in this area by the
General Plan Consultant, the Citizen's Circulation Committee, and the
Engineering Department, indicates that it would be appropriate to reconsiderA.B; #1054.

City Manager's Recommendation
Concur with staff recommendation. Council should note
that no action is required at this time other than to
set the matter for public hearing. The Public Works
Department feels that they have adequate information at
this time and will be prepared to make a recommendation
on the hearing date.

3-6-74 This matter was set for public hearing & the regular meeting of
April $, 1974.
4-2-74 The public hearing was closed, and it was agreed that the findings
be continued to the second meeting in May, 1974, until the Open
Space Zoning District Ordinance and the Scenic Preservation Ordinance
have been adopted.

Dear Mr. Bussey,
I am a general partner of Covington-Coninmark, a partnership
which applied to the City of Carlsbad for certain action
in respect to property (12.905 acres) southeasterly of the
intersection of Adams and Hoover Streets. Specifically, the
following applications were made:
1. An application for a change of zone to Planned
Community and adoption of a master plan.
2. An application for adoption of specific plan.
3. An application for an environmental impact report.
On March 6, 1973, the environmental impact report was accepted
by the Council. However, on March 7, 1973 a motion was made
and adopted to continue agenda Bill 105^ and the three
accompanying resolutions (pertaining to items 1 and 2 above)
until such time as the General Plan Revision on the subject
area is adopted.
Based on discussions at the public hearing on March 7, 1973,
I understood that the continuance of the Agenda Bill and
resolutions was predicated upon a traffic circulation and
density study of only the north shore of Agua Hedionda Lagoon.
Now, I understand that the studies not only exceed the north
shore area, but also exceed the "subject area" described in
the continuing motion; in fact, the study, as I understand it,
includes the whole City of Carlsbad. While on March 7, 1973
I understood that the study could take up to six months (based
on statements made at the public hearing), the matter has now
continued for one year. Further, it is my understanding that
the study may continue for a second year (into 1975) before
a final city-wide plan is finally approved.

Without going into great detail at this time, suffice it to
say that the long delay (and additional prospective delay)
has had, and will have, substantial economic effect on
Covington-Coninmark. Therefore, this letter is to request
that you place on the City Council's calendar, for its
March 6 hearing, a request by Covington-Coninmark to ask
the City to reconsider Agenda Bill 1054. By this action
I understand that the first hearing will pertain only to
whether the City Council will agree to reconsider the_
matter. At that time, if reconsideration is granted, I
understand that the agenda bill will be entered on the
calendar for actual hearing at a subsequent meeting of
the Council.
