REPORT ON: CONSIDERATION OF TENTATIVE MAP
CASE- NO: CT 73-57

*• REQUEST: Applicant seeks approval of a Tentative Map which would allow 14
condominium units on 0.60 acres, located on the north side of La Costa Avenue
"between El Camino Real and Viejo Castillo Way. .
II. RECOMMENDATION: Staff recommends that the Planning Commission move to
recommend APPROVAL of CT 73-57, to the City Council.
Justification is based on:
1. Conformance to the La Costa Master Plan.
2. Conformance to the City of Carlsbad Zoning Ordinance
3. Compliance with Subdivision Map Act.
II. BACKGROUND:
A. Location: North side of La Costa Avenue between El Camino Real and
Viejo Castilla Way.
B- Description: La Costa Greens, Lot #8, Map 6708, City of Carlsbad.
C- Area: 0.60 Acres.
D. Units: 14 Condominium Units
E. Density: 23 dwelling units per acre (43 d.u./acre allowed).
F. Existing Zoning: RD-M
G. Adjacent Zoning: North: P-C
East: RD-M
South: RD-M
West: RD-M
H. General Plan: La Costa Master Plan indicates Medium Density Residential
with a maximum density of 43 dwelling units per acre. The applicant is
proposing 23 d.u./acre.
I. Parks Requirements: In-Lieu Fees are required.
J. Planning Commission Policies: Compliance to P-C parking and landscaping
requirements will be covered as a part of the building permit process.
IV. DISCUSSION:
The proposed Tentative Map was continued from the Planning Commission meeting
of December 11, 1973 and also January 8, 1974, for the reason that the applicant
did not possess the required letter from the School Districts stating that school
•facilities would be available to serve the project. The applicant does now have
the required school letters.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS AND
RECOMMENDING TO THE CITY COUNCIL, APPROVAL OF A TENTATIVE
MAP (CT 73-57) TO ALLOW DEVELOPMENT OF A 14 UNIT CONDO-
MINIUM DEVELOPMENT ON APPROXIMATELY 0.60 ACRES OF LAND,
SAID LAND GENERALLY LOCATED ON THE NORTH SIDE OF LA COSTA
AVENUE BETWEEN EL CAMINO REAL AND VIEJO CASTILLO WAY.
APPLICANT: ROBERT K. MILLER for CAL PACIFIC PROPERTIES
WHEREAS, the Planning Commission of the City of Carlsbad did receive
a verified application from ROBERT K. MILLER, for CAL PACIFIC PROPERTIES,
requesting approval of a Tentative Map (CT 73-57), to permit the development
of a 14 unit condominium development on approximately 0.60 acres of land,
said land generally located on the north side of La Costa Avenue between El
Camino Real and Viejo Castillo Way, and more particularly described as:
All of Lot 8, La Costa Greens, according to Map No. 6708
in the City of Carlsbad, County of San Diego, State of
California.
WHEREAS, said application has met the requirements of the City of
Carlsbad Environmental Protection Ordinance of 1972, and has been declared
to have a "Non-Significant" impact on the environment, and;
WHEREAS, the Planning Commission did find that the subject Tentative
Map does substantially comply with City of Carlsbad Subdivision Regulations
and the State of California Subdivision Act; and,
WHEREAS, the Planning Commission does find that the provisions for
design and improvements of this tentative map are consistent with the General
Plan of the City of Carlsbad, and;
WHEREAS, said applicant has agreed to comply to all the requirements
of the Municipal Ordinance and applicable policies presently in effect.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Carlsbad, that it does hereby recommend approval to the City Council of
the City of Carlsbad, the herein described Tentative Map (CT 73-57).
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad
Planning Commission, held on the 13th day of February, 1974, by the following

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
WITH CONDITIONS TENTATIVE MAP (CT 73-57),
A 14-UNIT CONDOMINIUM ON 0.6 ACRES OF LAND,
GENERALLY LOCATED ON THE NORTH SIDE OF
LA COSTA AVENUE BETWEEN EL CAMINO REAL AND
VIEJO CASTILLO WAY. APPLICANT: ROBERT K.
MILLER FOR CAL-PACIFIC PROPERTIES, INC.
WHEREAS, on the,13th day of February, 1974, the Carlsbad
City Planning Commission adopted Resolution No. 1040 recommending
to the City Council that Tentative Map (CT 73-57) be conditionally
approved; and
WHEREAS, the City Council of the City of Carlsbad, on the
6th day of March , 1974, considered the recommendation
of the Planning Commission; and
WHEREAS, said Tentative Map has complied with the require-
ments of the City of Carlsbad Environmental Protection Ordinance
of 1972 and has been declared to have a nonsignificant impact
on the environment;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
A. That the above recitations are true and correct.
" B. That Tentative Map (CT 73-57) is hereby approved
subject to all requirements of applicable Municipal Ordinance and
policies.
C. That said Tentative Map together with the provisions
for its design and improvement is consistent with all applicable
general and specific plans of the City of Carlsbad.
