Statement of the flatter
The reorganization of the City Manager's office as outlined
in Agenda Bill 2298 is dependent upon tie inclusion of the
Purchasing A--„-t, the Personnel Directc., and the Assistant
City Manager _.n those positions which are exempt from
the classified service. This recognizes the need to occasionally
shift administrative personnel within the Manager's office to
meet current needs without the normal competitive examination
process. It also recognizes the discretionary relationship
between the City Manager and those Assistants working directly
for him.

2 AN ORDINANCE OF THE CITY COUNCII, OF THE
CITY OF CARLSBAD, CALIFORNIA, AMENDING
3 TITLE 2, CHAPTER 2.44 OF THE MUNICIPAL
CODE BY THE AMENDMENT OF SECTION 2,44.030
4: TO EXCEPT CERTAIN DEPARTMENT HEADS FROM
THE PROVISIONS OF CHAPTER 2.44.

6 The City Council of the City of Carlsbad does ordain as
7 follows:
8 SECTION 1: Title 2, Chapter 2.44 of the Municipal Code
9 of the City of Carlsbad is amended by the amendment of Section
10 2.44.030 to read as follows:
11 112.44.030 City service. The provisions of this chapter
shall apply to all offices, positions, and employments in the
12 service of the city, except:
(1) -Elective officers;
13 (2) Members of appointive boards, commissions, and
committees;
e 14 (3) Persons engaged under contract to supply expert,
professional or technical services for a definite period of time;

22 8 15 (4) Volunteer personnel who receive no regular rompensa-
i a tion from the city;
g o;Z 16 (5) City manager. (Covered in separate ordinances 1040
o Z. and 1088, codified in Chapter 2.12); _

(9) Emergency employees who are hired to meet the immedi-
20 ate requirements of an emergency condition, such as extraordinary
fire, flood, or earthquake which threatens life or property;

section, who are employed less than half time which is defined as
22 employees who ara expected to or do work less than one thousand
and forty hours in any one fiscal year,"

EFFECTIVE DATE: This ordinance shall be effective thirty
24
days after its adoption, and the City Clerk shall certify to the
25
adoption of this ordinance and cause it to be published at least
26
once in the Carlsbad Journal within fifteen days after its adoptior
27 adjourned
