The applicant has met the requirements, of the City as well as State of California Map Act. • The proposed tentative map involves the construction of 18 dwelling units on 1.14 acres of land in La Gosta. . Waters, Jr. for LaVida La Costa 720 Robinson Avenue San Diego, Ca. 92103 I • REQUEST: That the Planning Commission recommend approval to the City Council of a Tentative Map for an 18 unit condominium complex. II. RECOMMENDATION: That it be moved that the Planning Commission recommend to the City Council that CT 74-3 BE APPROVED subject to the conditions outlined below: Justification is based upon: 1. Conformance of said map to all requirements of the Municipal Code, State of California Subdivision Map Act, and the General Plan commitment. 2. The applicant has agreed in writing (see attached) to conform to all requirements of the Municipal Code and any applicable policy. CONDITIONS OF APPROVAL 1. Prior to the issuance of any permits, the applicant shall cause the proposed building locations to be revised to conform to the requirements of the Municipal Code. 2. The developer shall install street improvements to City Standards for the full frontage of the subject property along La Costa Avenue. III. BACKGROUND: A- DESCRIPTION - Lots 406, 407 and 408, La Costa South Unit No. 5. B. LOCATION - Northerly of and adjacent to La Costa Avenue easterly of the intersection of Gilbralter Street and La Costa Avenue C. SIZE_ - 1 .14 acres - D. TOTAL NO. OF UNITS - 18 D.U.'s E. DENSITY - 15.79 D.U. per acre. F. NO. OF BEDROOMS - 28 Bedrooms G. TYPE OF UNITS - 6-2 bedrooms - two story units 4-2 bedroom - single story units 8-1 bedroom - single story units 18 units total H. COVERAGE - 50% I. E.I.R. FINDING - The Planning Director has determined that the proposed project will not have a significant impact on the environment. J. EXISTING ZONING - RD-M K. ADJACENT ZONING - North, East, West - RD-M, South - R-l-7500 L- GENERAL PLAN - The General Plan indicates the property to be potential medium-high Density Residential with up to 43 dwelling units per acre. M. RESOURCE MANAGEMENT DISTRICT - N.A. N. PARKS ORDINANCE COMPLIANCE - In-lieu fees should be re- quired as a part of any action. 0. COMPLIANCE TO CITY COUNCIL PUBLIC FACILITIES POLICY- School , letters have been received. P. APPLICANT: C. M. WATERS, JR. for LAVIDA LA COSTA WHEREAS, the Planning Commission of the City of Carlsbad did receive a verified application from C. M. WATERS, JR. for LAVIDA LA COSTA, requesting approval of a tentative map (CT 74-3) to permit the development of 18 condo- minium units, on approximately 1.14 acres of land, said property generally located northerly of and adjacent to La Costa Avenue, easterly of the inter- section of Gibralter Street and La Costa Avenue, and more particularly described as follows: Lots 406, 407 and 408 of La Costa South Unit No. 5, in the County of San Diego, State of California, according to Map Mo. 6600, filed in the office of the County Recorder of San Diego County, March 10, 1970. WHEREAS, said application has met the requirements of the City of Carlsbad Environmental Protection Ordinance of 1972, and has been declared by the Planning Director to have a "Non-Significant" impact on the environment; and, WHEREAS, the Planning' Commission did find that the subject Tentative Map does substantially comply with City of Carlsbad Subdivision Regulations and the State of California Subdivision Act; and, WHEREAS, the Planning Commission does find that the provisions for design and improvements of this Tentative Map are consistent with the General Plan of the City of Carlsbad; and, WHEREAS, the applicant has agreed to comply to all the requirements of the Municipal Ordinance and applicable policies presently in effect. JACENT TO LA COSTA AVENUE, EASTERLY OF THE INTERSECTION OF GIBRALTER STREET AND LA COSTA AVENUE. APPLICANT: C. M. WATERS, JR. FOR LA VIDA LA COSTA. WHEREAS, on the 26th day of March, 1974, the Carlsbad City Planning Commission adopted Resolution No. 1052 recommending to the City Council that Tentative Map (CT 74-3) be conditionally approved; and WHEREAS, the City Council of the City of Carlsbad, on the 16th day of Apri 1 , 1974, considered the recommendation of the Planning Commission; and WHEREAS, said Tentative Map has complied with the require- ments of the City of Carlsbad Environmental Protection Ordinance of 1972 and has been declared to have a nonsignificant impact on the environment; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That Tentative Map (CT 74-3) is hereby approved, sub- ject to the execution and/or fulfillment of the following condi- i tions: 1. Prior to the issuance of any permits, the applicant shall cause the proposed building locations to be revised to conform to the requirements of the Muni- cipal Code. 2. The developer shall install street improvements to City standards for the full frontage of the subject property along La Costa Avenue. C.
