Baldwin Asst. to City Manager Statement of the fatter Legislation was passed and became effective*october 2, 1973, providing °that a local safety member shall be retired for disability only upon his employer's dete-urination that he is incapacitated physically or mentally for the performance of the duties of his position and termination of his employment for that reason. If a safety member has applied to the Retirement System for disability, ,the employer must now assume: the responsibility, previously imposed on the System, of determining under the Retirement Law whether the member is disabled when an application is filed. Da to: April 14 ,1974 council'Action 4-16-74 Resolution 13402 was adopted; delegating the office of•Ci.ty Manager to determine the nature of disabilities and to certify such disabilities. -2- A 1 2 3 41 5 6 7 9 10 11 12 13 0 14'', a m co 151 � V c, oo=z 16 Z� W 0 ca 17I, LL W o z. 8 < 181 U �' [O _Z O to >Q a 19 20 21 22 23 24 25 26 27 28 29 30 31 i 32 RESOLUTION N0.3402 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DELEGATING TO THE OFFICE OF THE CITY MANAGER THE AUTHORI1Z ON BEHALF OF THE CITY OF CARLSBAD TO DETERMINE THE NATURE OF DISABILITIES AND TO CERTIFY SUCH DISABILITIES TO THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM, (SECTION' 21023.6, (OVERNMENT CODE) WHEREAS, the City of Carlsbad, hereinafter referred to as "Agency", is a contracting'agency of the Public Employees' Retire- ment System; WHEREAS, the Public Employees' Retirement Law requires that a contracting agency determine whether an employee of such agency in employment in which he is classified as a local safety member is disabled for purposes of the Public Employees' Retire- ment Law and whether such disability is "industrial" within the meaning of such Law; WHEREAS, the City Council of the City of Carlsbad has determined upon legal advice that it may delegate authority to make such determinations to the incumbent of the office of the City Manager; NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Carlsbad delegate and it does hereby delegate to the incumbent of the offica of City Manager authority to make deter- minations under Section 21023.6, Government Code, on behalf of the Agency, of disability and whether such disability is industrial and to certify such determinations and all other necessary informa- tion to the Public Employees' Retirement System; and, i BE IT FURTHER RESOLVED, that such incumbent be and he is authorized to make applications on behalf of the Agency for dis- ability retirement of employees in employments in which they are local safety members and to initiate requests for reinstatement of such employees who are retired for disability.
