There is one overhead pole in the district located at 1265 Elm Ave. which is impractical to convert due to the age of the structure and the new land ’use anticipated by the general plan. A Resolution excepting this pole from the district and setting the dates for connection to the underground system and removal of the overhead should be adopted as soon as possible. Exhibit 1. The one utility pole which will be left at 1265 Elm Avenue is off the street right of way and will not detract from the effect of the undergrounding district. The Public Works Administrator will have a photograph available at the Council Meeting. IN UNDERGROLJND UTILITY DISTRICT NO. 3 WHEREAS, on December 18, 1973, the City Council of the City of Carlsbad adopted Res. No. 3269 establishing Underground District No. 3; and PIHEREAS, Section 11.08.030 of City Code requires that property owners be notified of the time to be ready to connect to the Under- ground system by subsequent Resolution; and WHEREAS, the underground system i.s to be completed by June 10, 1974, and overhead poles are to be removed by August 1, 1971: and WHEREAS, an existing utility pole on utility easement is impractical to underground at this time; and WHEREAS, Section 11.08.050 of City Code provides that under unusual circumstances Council may grant permission to maintain overhead wires and structures; NON, THEREFORE, BE IT RESOLVED by the City Council of the City of Carl-sbad as follows: 1. That the date on which affected property owners must be ready to receive underground service is June 10, 1974. 2. That special permission is hereby granted to maintain the existing utility pole and overhead wires on property identified as 1265 Elm Avenue until thesexisting strilctilre is removed, or not more than 5 years, w5ichevejt comes first. 3. That a certified copy of this Resolution be recorded in the County xecorder's office and also mailed to each affected property owner.
