' , The proposed development is the last development in the 100 plus acre Alta Mira Planned Community. ' . - As part of the Specific Plan for Unit No. 4, the applicant is proposing to dedicate an additional six (6) acres for open space and parkway purposes. He is also pronosinq the construction of tennis courts and a recreational complex for the benefit of the residents. The applicant proposes to make the tennis courts available, on a limited basis, to the Carlsbad Parks and Recreation Department. The applicant is requesting permission to construct one building which would act as . the model complex. It is the applicant's impression that a building may be constructed as the model complex through approval of the Specific Plan. Existing Ordinances for subdivisions including Planned Communities, restrict the number of models to four. Therefore, the applicant's request to develop a model complex 'which would exceed four dwelling units can not be granted. In order to develop a. model complex. in excess of Ordinance provisions the applicant would have to record the portion of the tentative &£pli$jl&hich the proposed model complex is located. (PASEO DEL NORTE) LANE AND CAMINO PE L7\S ONDAS. APPLICANT; FINANCIAL SCENE, INC. The City Council of the City of Carlsbad, California does ordain as follows: SECTION 1: A Specific Plan (SP-157) is hereby adopted for Unit No. 4 of Altamira on property located at the northwest corner of the intersection of Lowder (Paseo Del Norte) Lane and Camino De Las Ondas more particularly described as: A portion of Section 21, Township 12 South, Range 4 West, San Bernardino Meridian, according to Map No. 7303, filed in the office of the San Diego County Recorder, in the City of Carlsbad, County of San Diego, State of California, more particularly described on file in the City Planning office, said plan to consist of a plot plan marked Exhibit B and an appli- cation with attachments on file in the office of the City Planning Department and incorporated by reference herein, subject to all terms and conditions of this ordinance. SECTION 2: Findings. .The findings and decision on Specific Plan (SP-157) contained in City Council Resolution No. and said.resolution are incorporated by reference herein. SECTION 3; Development Conditions. The Specific Plan (SP-157) is approved subject to the following conditions and restrictions and the development of the property, as described in Section 1 hereof, shall be subject to all such conditions and restrictions which are in addition to all requirements, limita- tions and restrictions of all municipal ordinances and state and federal laws now in force or which may hereafter be in force: 1. Unless the construction of the structure or facility is commenced not later than one year after the date the approval is granted and is diligently pursued thereafter, this approval will automatically become null and void. 3. Any minor change may be approved by the Planning Director. Any substantial change will require the filing of an application for an amendment to be considered by the Planning Commission. 4. All requirements of any law, ordinance or regula-- tion of the State of California, City of Carlsbad and any other governmental entity shall be complied with. 5. No signs or advertising of any type whatsoever shall be erected or installed until plans therefor have been approved by the City of Carlsbad. 6. All areas shown as parking areas shall be surfaced with asphaltic concrete and shall be visibly marked out- lining individual parking spaces and traffic flow. Said surfacing and marking shall be completed prior to final inspection of the structure or structures by the Building Department. The surface shall be kept in a reasonably good state of repair at all times. 7. Prior to obtaining a building permit and within 30 days hereof, the applicant shall file with the Secretary of the Planning Commission written acceptance of the condi- tions stated herein. - . 8. Any mechanical and/or electrical equipment to be located on the roof of the structure shall be screened in a manner acceptable.to the Planning Director. Detailed plans for said screening shall be submitted, in triplicate, to the Planning Director. 9. All lighting shall be arranged to reflect away from adjoining properties and streets. 10. All outside storage areas"shall be screened from adjacent property and streets. 11. An incombustible trash enclosure shall be provided of a size and location acceptable to the Planning Director, and said area shall be enclosed with a fence and/or wall of sufficient height to adequately shield the area. Said fence and/or wall shall include a solid gate. 12. A detailed landscape and sprinkler plan prepared by a landscape architect, shall be submitted to the Plan- ning Director for consideration and approval. 13. Prior to final building inspection clearance all landscaping shall be installed. All utilities including electrical, telephone and cable television, shall be installed underground and/or shall be completely concealed from view. 15. All public improvements shall be made in con- formance with the Subdivision Ordinance and other City standards to the satisfaction of the City Engineer, without cost to the City of Carlsbad and free of all liens and encumbrances. 16. Prior to any construction the applicant shall submit plans to the appropriate entity providing domestic water to the proposed development for its approval of the location, type and adequacy of water lines, and to this Fire Department for approval of the location of fire hydrants. 17. The applicant shall install all required fire hydrants and dry-stand pipes prior to framing construc- tion, and said fire appurtenances shall be functional prior to commencing such work. 18. Prior to the issuance of any permits a tentative map encompassing the subject prope'rty shall be processed by the City of Carlsbad. Said map shall also include the 6+ acres park dedication that remains to be given to the City of Carlsbad pursuant to the approved Master Plan. As a part of the public improvements to be done under said subdivision the developer shall be responsible for the full street improvements to City standards for the full front- age of the total park site (12+ acres). 19. As a part of the submittal of the required tenta- tive map the developer shall provide the $500 donation to the Parks Fund as required. (C.C. Ord. No. 9293). 20. As a part of the submittal of the required tenta- tive map, the applicant will investigate with the assis- tance of the City's Director of Parks and Recreation a program for public use, for a minimal fee, of the proposed tennis courts. In return the development of the City park will include sufficient parking to be adequate for both the physical development of the City park and the public use of the proposed tennis courts. 21. Prior to the issuance of any permits the appli- cant shall submit detailed plot plans, building elevations and floor plans of all buildings to the Planning Director for consideration and approval. Said plans shall include sufficient evidence to indicate complete compliance to all requirements of the Municipal Code and any applicable City policies. 22. All building roofs shall be of the same material. 23. SECTION 4: Administration and Enforcement. The Building Department shall not approve any building for occupancy until the Planning Director has certified that all the conditions of this ordinance have been satisfied. EFFECTIVE DATE; This ordinance shall be effective thirty days after its adoption and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council held on the day of , 1974, and thereafter PASSED AND ADOPTED at a regular meeting of said Council held on the day of , 1974, by the following vote, to wit: AYES: NOES : ABSENT: ROBERT C.
