Statement of the Matter I_
As directed by Council, staff has prepared a resolution formalizing
the Water Committee (see attached Exhibit A). This resolution has been reviewed by staff, by the City Council representative to the
Water Committee and by the Water Committee members.

XESOLUPION NO. 3424
A RESOLUTION OF TIE CITY COUNCIL OF THE CITY
OF' CARLSBAD, CALIFORNIA, CREATING AND ESTABLISHING
TI-IE WATER COMMITTEE
'iJHEREAS, the City Council has expressed a desire to obtain
community input concerning major capital expansions of the City
Water System including such subjects as:
a) The planning of a long range major capital expansion
program for the City's Water System.
b) The acquisition of lands, properties, and materials
required to implement a major expansion of the City's Water
Sys tem.
c) The establishment of rates, the sale of bonds or property
or any other steps necessary to finance major elements of the
long-range capital expansion of the City's Water System.
WHEREAS, a Water Committee composed of private individuals
can provide such input.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Carlsbad, California, .as follows:
1. The Water Committee of the City is established.
2. The Water Committee shall be advisory to the City Council
and its members shall be selected on the basis of their ability
to constructively advise on the planning and financing of a
program for major capital expansions of the City's Water Service.
3. The Water Committee shall have the duty to make recommend
ations to the City Council and to advise the City Council on such
matters as the Council may from time to time refer to the Committe
4. The Water Committee shall consist of five (5) private
indiv2duals of the City.
5. Private individuals on the Committee and their successors
shall be appointed and may be removed by the Mayor with the conser
of the City Council. The term of office of private members of the
Water Committee shall be for two (2) years; provided, however that

two of the first appointees shall be appointed for-one year terms
so as to provide the Committee.with a higher degree of continui-ty.
The Chairman of the Water Committee shall be selected by the
members from within their ranks. The term of office of the Chair-
man shall be for a period of one year. The Chairman may succeed
himself in office. Unexcused absence of a Committee member from
three (3) successive regularly scheduled meetings in any one twelve
montfi period shall constitute vacation of that office. Appointment
to a vacant seat on the Committee shall be for the remainder of the
term of that office.
G. The Water Committee shall meet every other month at a time
and place to be arranged by City staff. Robert's rules of order
shall govern the conduct of the Water Committee meetings,
the opinion of staff with concurrence of the Committee Chairinan
an extra meeting is required or there is insufficient subject
matter to warrant a regularly scheduled meeting of the Committee,
an extra meeting may be scheduled upon 24 hour notice to Committee
members or a regularly scheduled meeting may be cancelled and such
extra meeting shall not count in a member's attendance record, nor
shall a cancelled meeting be counted as an absence for any member.

8. The City staff liaison person shall serve as Secretary
to the Committee and shall be responsible for the recordation and
distribution of minutes and special reports.
9. A City Councilman, the City Manager, Public Works Adminis-
trator, and Utilities Director shall be ex-officio members of the
Water Committee. Appointment of a staff liaison-person shall be
at the' discretion of the City Manager. Committee requests for staf

assistance shall be directed to the City Manager.
10. The Water Committee serves at the pleasure of the City
Council and will continue to serve in such capacity until other-
wise directed by the City Council.
11. The Water Committee shall act as such without any
compensation.
PASSED, APPROVED-AND ADOPTED at a regular meeting of the
City Council of the City of Carlsbad, California, held on the
18th day of June , 1974, by the following vote,
