The matter has not been presented at a public hearing. The staff is presenting one of the proposed re- visions for City Council consideration. The R-P (Residential -Professional ) Zone District is being amended. The major change is the inclusion of investment agencies and services including financial institutions (banks and savings and loan). Kx-hibi t 1. AS No .Date: June 5, 1974 City Manager's Recommendation Concur with staff report Council'Action 6-5-74 Ordinance No. 9391 revising the Residential Professional zone (R-P) was given a first reading. 6-18-74 Ordinance No. 9391 was given a second rea'ding and adopted. -2- MEMORANDUM May 16, 1974 TO: CITY MANAGER FROM: PLANNING DIRECTOR SUBJECT: PROPOSED REVISION TO THE RP ZONE The Residential-Professional Zone has been modified in several areas as part of a zone code (ZCA-52) revision to the zoning code. The attached summary indicates those areas which have been expanded, eliminated or deleted. The major change occurs in the permitted uses outlined in Section 21.20.020. Additionally the ordinance format now includes an intent and purpose section which doesn't occur in the existing code. It also outlines accessory uses and prohibited uses neither of which are in the present ordinance. The proposed RP Ordinance additionally has a conditional use permit section as an integral part. Conditional uses are presently outlined in the Conditional Use Permit Section of the zoning code and by including a CUP Section in the RP Zone, it eliminates a reference problem. The Planning Commission recommended approval of this re- vision as my recommendation that the Council adopt a resolution approving the revision to the RP Zone. RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL AN AMENDMENT TO TITLE 21 OF THE CARLSBAD MUNICIPAL CODE REGARDING "R" ZONE DISTRICTS. CASE NO: ZCA-52 - . WHEREAS, the Planning Commission of the City of Carlsbad, California, did hold Workshop Sessions on October 9, 1973, October 23, 1973 and October 30, 1973, to consider the proposed "R" Zone Revisions, and; WHEREAS, the Planning Commission did hold a duly noticed Public Hearing on the 13th day of November, 1973, to consider an Amendment to Title 21 of the Carlsbad Municipal Code with regards to Residential Zoning Districts, and upon hearing testimony and arguments, if any, of all persons wishing to speak, the Commission did find the following facts and reasons to exist which make the approval of this Amendment appropriate: . 1. ^To eliminate ambiguity and repetition, and, 2. To provide for modern planning techniques and provide WHEREAS, it has been determined that this Amendment to Title 21 will not have a significant impact on the environment, and therefore, no further environmental considerations will be necessary. AGATEP, Chairman a m CO O u. %--2 M> o CO (T O 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ORDINANCE NO. 9391 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 21, CHAPTER 21.18 OF THE MUNICIPAL CODE BY THE AMENDMENT OF SECTIONS 21.18.010, 21.18.020, 21.18.030, 21.18.040, 21.18.050 AND 21.18.060 AND BY REPEALING SECTIONS 21.18.070, 21.18.080 AND 21.18.090 TO REVISE THE R-P RESIDENTIAL PROFESSIONAL ZONE. , The City Council of the City of Carlsbad, California does ordain as follows: SECTION 1; Title 21, Chapter 21.18 of the Municipal Code is amended by the amendment of Sections 21.18.010, 21.18.020, 21.18.030, 21.18.040, 21.18.050 and 21.18.060 to read as follows: "21.18.010 Intent and purpose. The intent and purpose of the R-P Residential Professional Zone is to: (1) Provide areas for the development of certain low intensity business and professional offices and related uses in locations in conjunction with or adjacent to residential areas, and (2) Provide transitional light traffic generating commer- cial areas between established residential areas and nearby com- mercial or industrial development. 21.18.020 Permitted uses and structures. In the R-P Zone only the following uses and structures are permitted subject to the provisions of this chapter and to development standards provided in Chapters 21.41 and 21.44: (1) Administrative and executive offices. (2) Accountants and attorneys. (3) Clinic, medical and dental, including incidental laboratories -and pharmacies. (4) Engineers, architects and planners. (5) Insurance agencies and services. (6) Investment agencies and services, including financial institutions. (7) Labor union offices. (8) Libraries. (9) Medical offices and clinics, including incidental mortuaries. (10) Offices, businesses and professional, including in- cidental commercial facilities such as blueprint and photocopy shops, business machine sales, computer and data processing centers, news stores, duplicating and mimeographing services and tobacco shops. (11) Parking lots and parking buildings. (12) Public buildings other than schools. (13) Administrative offices for publishing houses and newspapers. (14) Real estate and related services. (15) Schools, business, vocational and professional, in- cluding art, barber, beauty, dance, drama, music arid swimming. (16) Subdivision sales complex. •(17) Any uses permitted in the R-3 Zone District. Accessory uses and buildings customarily appurtenant to a permitted use, such as incidental storage facilities, are permitted in the R-P Zone. 21.18.040 Uses and structures permitted by conditional use permit. The following uses'and structures are permitted by conditional use permit approved and issued by the Planning Depart- ment: (1) Circuses and carnivals and private clubs. (2) Health facilities, long-term. (3) Radio, television and microwave stations or towers. 21.18.050 Development standards. Subject to the general development standards of Chapters 21.41 and 21.44, no lot shall be created or structure constructed in the R-P Zone that does not con- form to the following specific standards: (1) Lot area minimum. In the R-P Zone the minimum area of all lots hereafter created shall be 7,500 square feet. (2) Lot area minimum per dwelling. In the R-P Zone the minimum lot area per dwelling shall be 800 square feet. Rooms used for sleeping purposes shall be provided on the basis of at least one per each 450 square feet of lot area. However, the precise density is established by the General Plan. (3) Lot width minimum. Every lot hereafter created in the R-P Zone shall maintain a minimum lot width at the rear line of the required front yard on the basis of the following: Lot Area Required Width Less than 10,000 sq.ft. 60 feet Less than 20,000 sq.ft. 75 feet More than 20,000 sq.ft. 80 feet (4) Front yard. Every lot in the R-P Zone shall have a front yard of not less than 20 feet in depth, except on key lots which side upon commercially or industrially zoned property, shall maintain a front yard of not less -than 15 feet, (5) Side yard. In the R-P Zone every lot shall have side yards as follows: (A) Interior lots shall have side yards that have width equal to 10% of the lot width, provided that such side yard shall not be less than five feet in width and need not exceed ten feet in width. (B) Corner lots shall have a side yard on the side lot line adjacent to another lot of a width within the limitations for an interior lot above and a side yard adjacent to the street of ten feet. (6) Rear yard. In the R-P Zone every lot shall have a rear yard of a depth equal to 20% of the lot width, provided that such rear yard need not exceed 20 feet. (7) Separation of buildings. In addition to the required yards, buildings shall be set as follows: (A) Minimum distance between habitable buildings 10 feet. (B) Minimum distance between habitable buildings and accessory structures 10 feet. (C) Minimum distance between accessory buildings and rear or side lot lines 0 feet. (D) Except for an accessory building covering up to 50% pf the required rear yard, no building shall be located in any of the required yards. 2. In' the R-P Zone the maximum building height shall be: (A) Habitable buildings 35 feet. (B) Accessory buildings 18 feet. (9) Lot coverage. In the R-P Zone all buildings shall not cover more than 60% of 'the total lot area. (10) Parking off-street. Parking shall not be provided in the required front or side yards. 21.18.060 Special conditions and standards. In addition to the established development standards, when applicable the following conditions shall be met: (1) Outside display and storage. No outdoor display of products or storage shall be permitted. (2) Residential structure conversion. All existing re- sidential structures converted to commercial purposes shall be brought into conformance with all the requirements of this title and Title 18. (3) Walls. Any lot proposed for nonresidential develop- ment which adjoins a lot located in a residential zone district shall have a solid masonry wall of 6 feet in height installed along the common lot line, except in the front yard area where said wall sha.ll be reduced to 42 inches in height. (4) Enclosure of activities. All nonresidential uses shall be located in a completely enclosed building."
