The applicant is proposing to develop a 10-lot single-family subdivision on 3.50 acres. The proposed subdivision is zoned R-l-10",000 and is located east of Park Drive between Adams Street and Hillside Drive. • The applicant has met all ordinances and policies of the City of Carlsbad. APPLICANT: KAMAR CONSTRUCTION COMPANY CT 74-6 WHEREAS, the Planning Commission did on the 14th day of May, receive a verified application from KAMAR CONSTRUCTION COMPANY, requesting approval of a tentative subdivision map CT 74-6 to allow a 10-lot single-family subdivision, 10,000 square foot lots minimum in the R-l-10 zone district, on property generally located on Park Drive between Adams Street and Hillside Drive. Said property is further described as: Parcel 1: Lots 1 and 2 in Block "F" of Bellavista, in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 2152, f filed in the office of the County Recorder of San Diego County, March 7, 1929. WHEREAS, said application has complied with the require- ments of the "City of Carlsbad Environmental Protection Ordinance of 1972" and has been determined to have an insigni- ficant impact on the environment; and, WHEREAS, the Planning Commission did find that the subject tentative map does substantially comply with the City of Carlsbad Subdivision Regulations and the State of California t Subdivision Map Act; and, WHEREAS, the Planning Commission is recommending Park-In- Lieu fees rather than the dedication of park land, for the following reasons: 1. Conformance of the Tentative Map to all requirements of the Municipal Code and the State of California Subdivision Map Act. 2. Conformance of the Map to the present General Plan Land Use commitment of low-density residential with with 2-7 dwelling units per acre and to the proposed Land Use Element Revision (pending) of low medium density residential with 0-4 dwelling units per acre. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force, or which, here-after, may be in force for the purpose of preserving the residential characteristics of adjacent properties. 2. Park-In-Lieu fees shall be granted to the City prior to City Council approval of the Final Map. 3. In order to provide for reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings and adequate fire hydrants with required fire hydrants with required fire flows shall be installed as recommended by the Fire Department. 4. All public improvements shall be made in conformity to the City of Carlsbad Engineering Design Criteria and Standard Plans, the Subdivision Ordinance and other City Standards, to the satisfaction of the City Engineer, with- out cost to the City of Carlsbad, and free of all liens and encumbrances. Improvement plans for water and sewer systems shall meet the requirements of the respective service districts. 5. Street lighting shall be provided for as required by Municipal Ordinance Code. The Developer:shall post a bond and/or cash in the amount necessary to energize said street lights for an eighteen month period after con- struction, to permit the incorporation of the subdivision into a maintenance district. 6. The Subdivider shall dedicate to the public all rights of ingress and egress from lots abutting upon restricted access streets and roads. This dedication shall be so designated on the certificate sheet of the Final Map with the intent that the owners of said lots will have no rights of access whatsoever to said streets and roads. The words "access rights dedicated to the City" shall be lettered along the road adjacent to the lots affected on the map proper, shall apply to Park Drive. 7. Street names shall be subject to approval and shall be designated in accordance with the standards and policies adopted by the Planning Commission on files in the Planning Department. Said names shall be approved by the Planning, Fire and Police Departments prior to recordation of the Final Map. 8. AGATEP Secretary 7 CITY OF CARLSBAD PLANNING DEPARTMENT STAFF REPORT FOR MAY 14, 1974 TO:PLANNING COMMISSION REPORT ON: CONSIDERATION OF TENTATIVE MAP CASE NO: CT 74-6 APPLICANT: KAMAR CONSTRUCTION COMPANY 325 Elm Avenue Carlsbad, California I. REQUEST: That the Planning Commission consider and recommend approval to the. City Council of a ten (10) lot single-family subdivision, on property located in the R-l-10 (single-family, 10,000 sq. ft. lots min)zone district. The subject property, Lot 2 and a portion of Lot 1, Block "F", Bellavista and a portion of Lot I, Rancho Agua Hedionda, is located easterly of and adjacent to Park Drive between Adams Street and Hillside Drive. Said property contains approximately 3.50 acres. The applicant is proposing to develop the subdivision within an avacado orchard, and indicates that whenever possible the existing trees will be preserved. The lots are to be designed to front upon a cul-de-sac with one lot containing an existing house. The proposed street name of Molly Lane does conflict with the.existing street name of Polly Lane and therefore, should not be approved. The adjacent zoning in the area is R-l-10,000 and R-l-15. With regard to the E.I.R. considerations, the-Planning Director has determined that the proposed project would not have a significant effect on the environment, and therefore, no future E.I.R. considerations are required. The applicant has complied to the requirements of the City Council Policy No. 17 dealing with adequacy of Public Facilities. r * * II. STAFF RECOMMENDATION: That it be moved that the Planning Commission recommend to the City Council that tentative map No. CT 74-6 BE APPROVED, subject to the conditions outlined below. Justification is based upon: 1. Conformance of the Tentative Map to all requirements of the Municipal Code and the State of California Subdivision Map Act. 2. APPLICANT: KAMAR CONSTRUCTION COMPANY. WHEREAS, on the 14th day of May, 1974 the Carlsbad City Planning Commission adopted Resolution No. 1063 recommending to the City Council that Tentative Map (CT 74-6) be conditionally approved; and WHEREAS, the City Council of the City of Carlsbad, on the 6th day of June , 1974, considered the recommendation of the Planning Commission; and WHEREAS, said Tentative Map has complied with the require- ments of the City of Carlsbad Environmental Protection Ordinance of 1972 and has been declared to have a nonsignificant impact on the environment; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That Tentative Map (CT 74-6) is hereby approved, sub- ject to the execution and/or fulfillment of the following condi- tions : 1.
