Statement of the Matter

The City Council and Planning Commission recently expressed their desire to add
a zoning district to implement the Professional-Administrative General Plan Land
Use Category. The Planning Commission .held a public hearing on the proposed Pro-
fessional-Administrative (P-A) Zone May 28, 1974.
The Commission is recommending adoption of the proposed P-A Zone for the reasons
stated in the Planning Department Staff report of May 24,.1974.

City Manager's Recommendation
This matter has been advertised for public hearing and
we recommend that Council hold the hearing and review
the proposed zone.
If approved, the matter should be referred to the City
Attorney for preparation of the necessary documents.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF CARLSBAD, CALIFORNIA, ANNOUNCING FINDINGS AND DECISIONS
DECISIONS, RECOMMENDING TO THE CITY COUNCIL AN AMENDMENT OF
TITLE 21 BY ADDING THE P-A (PROFESSIONAL ADMINISTRATIVE)
ZONE
WHEREAS, the Planning Commission did by Resolution of Intention 106
declare its intention to hold a Public Hearing on May 28, 1974, in the City
Council Chambers, 1200 Elm Avenue, Carlsbad, California to consider an amend-
ment to Title 21 of the Carlsbad Municipal Code by creating a Professional
Administrative Zone, and
WHEREAS, the Planning Commission of the City of Carlsbad did oh May
28, 1974, hold a duly noticed public hearing as prescribed by law, to con-
sider an amendment to the Carlsbad Municipal Code, Title 21 by adding the
Professional Administrative (P-A) Zone (Exhibit A attached) and
WHEREAS, at said Public Hearing, the Planning Director declared that
the oroposed amendment would have a non-significant impact on the Environment
pursuant to the requirements of the City of Carlsbad Environmental Impact
Planning Ordinance of 1972, and
WHEREAS, at said public hearing, upon hearing and considering the
testimony and arguments if any, of all persons who desired to be heard,
said commission did find the following facts and reasons to exist to recommend
the addition of the Professional-Administrative (P-A Zone) to Title 21
of the Carlsbad Municipal Code:
1. The P-A (Professional-Administrative) zone is necessary and
desirable for the implementation of the General Plan.
2. The P-A zone is consistent with the General Plan Land Use category.
3. The P-A zone complies with the requirements of State law (AB-1301).
NOW, THEREFORE, BE IT RESOLVED that said amendment to the City of
Carlsbad Municipal Code, Title 21 adding the Professional-Administrative
(P-A Zone) Exhibit A, is hereby recommended to be approved.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the City
of Carlsbad at a regular meeting held on the 28th day of May, 1974, by the
following vote, to wit

REPORT ON: ADDITION OF PROFESSIONAL-ADMINISTRATIVE ZONE TO MUNICIPAL CODE
CASE NO: ZCA-62
I. REQUEST: The Planning Commission and City Council recently approved
the General Plan Land Use category of Professional-Administrative. The State
is requiring that Local General Plans and Zoning Ordinances be consistent
(AB-1301). The City does not have a zone which will provide for the imple-
mentation of the Professional-Administrative Land Use category.
Staff is requesting approval of the proposed Professional-Administrative
Zone.
The intent and purpose of the P-A zone district provides for the location
and development of Professional, Medical, Administrative offices in locations
shown on the General Plan. The zone establishes a minimum lot size (7500 sq.ft.)
and provides developmental standards for height, setbacks, parking, landscaping,
etc.
The R-P (Residential-Professional) zone and the proposed P-A (Professional -
Administrative) zone are similar. The most important difference is the
R-P provision for multiple family residential uses. The addition of multiple
family residential in the R-P zone is NOT consistent with the intent of
AB-1301, therefore, would not be the appropriate zone for implementation of
the P-A (Professional-Administrative) land use category.
RECOMMENDATION:
That the Planning Commission recommend to the City Council, adoption of
the P-A zone for the following reasons:
1. The P-A (Professional-Administrative) zone is necessary and desirable
for the implementation of the General Plan.
2. The P-A zone is consistent with the General Plan Land Use category.
3. The P-A zone complies with the requirements of State law (AB-1301).

Staff is also requesting that the Planning Commission recommend to the City
Council the following:
All R-P (Residential-Professional) zoning intended to implement the
General Plan Land Use category, of P-A (Professional-Administrative)
should be replaced with, or rezoned to, P-A (Professional-Administrative)
zone.
The reason for this would be the P-A (Professional-Administrative) zone
is a better zone to use when developing Professional-Administrative Land
Uses.

Intent and Purpose: The intent and purpose of the P-A Zone
District is to provide appropriate locations where professional and administrative
office zones may be established, maintained and protected. The regulations of this
district are designed to promote a quiet and dignified environment for business
administration, professional and government activities, free from the congestion
and traffic of the usual retail business district. To this end, the regulations
permit office buildings and medical and financial facilities; appropriate commercial
facilities primarily for the service of the occupants of the district are permitted
subject to special controls. The intensity of development in such a district is
intended to reflect its environment, with building height and coverage generally
similar and harmonious to surrounding districts.
Principal Uses and Structures Permitted : In a P-A Zone District
the following uses and structures only are permitted as hereinafter specifically
provided and allowed, subject to the provisions of Chapter 21.40 and Chapter 21.44
governing development standards:
(1) Administrative and executive offices
Accountants
Attorneys
(2) Clinic, Medical, Optical and Dental, including incidental laboratories
and pharmacies.
(3) Engineers, Architects, and Planners
(4) Insurance Agencies and services
Investment Agencies and services including Financial institutions
Labor Union Offices
Libraries
(5) Offices, Business and professional
(6) Real Estate and related services
(7) Other similar uses which the Planning Commission may determine fall
within the intent and purposes of this Zone District, are of a comparable
nature to the uses enumerated in this Chapter, and will not be detrimental
to property in the vicinity.
Accessory Uses and Structures Permitted:
(1) Incidental services and incidental commercial uses, such as
blueprint and photocopy shops, business machine sales, computer and data
processing centers, and retail sales, such as tobacco shops, newspaper
and magazine shops which serve the occupants and patrons of the permitted
uses, when conducted and entered from within the building; provided that
there is no display or advertising visible from the public street.
(2) Accessory uses and buildings customarily appurtenant to a permitted use,
such as incidental storage facilities.
Uses and Structures Prohibited: The following uses are specifically
prohibited in the P-A Zone District:
(1) Manufacturing
(2) Commercial uses not specifically permitted in this Chapter
(3) Residences
(4) Signs, Off-site
(5) Utilities, public or private, major structures
Uses and Structures Permitted by C.U.P. approved by the Planning
Department:
(1) Circuses and Carnivals; private clubs
(2) Restaurants
(2) Commercial parking lots and parking garages
(3) Health facilities, longterm
(4) Nursery schools, schools and studios for arts and crafts, photography
music, dance and art gallaries
(5) Radio and television broadcasting excluding towers
Development Standards: Subject to the general development
standards of Chapter 21.40 and 21.44, no lot shall be created or structure
constructed in the P-A-Zone District that does not conform to the following
specific standards:
(1) Lot area minimum. In the P-A Zone District, the minimum area of all
lots hereafter created shall be 7,500 square feet.
(2) Lot width minimum. Every lot hereafter created in the P-A Zone District
shall maintain a minimum lot width at the rear line of the required
front yard on the basis of the following:
Lot Area Required Width
Less than 10,000 sq. ft. 60 feet
Less than 20,000 sq. ft. 75 feet
More than 20,000 sq. ft. 80 feet
(3) Front Yard. Every lot in the P-A Zone District shall have a front yard
of not less than 15 feet in depth, except on key lots which side upon
commercially or industrially zoned property, shall maintain a front yard
of not less than 10 feet.
(4) Side Yard. On the P-A Zone District, every lot shall have side yards
as follows:
1. Interior lots shall have side yards that have width equal to
10% of the lot width, provided that such side yard shall not
be less than five feet in width and need not exceed ten feet in
width.
2. Corner lots shall have a side yard on the side lot line adjacent
to another lot of a width within the limitations for an interior
lot above and a side yard adjacent to the street of ten feet.
(5) Rear Yard. In the P-A Zone District, every lot shall have a rear yard
of not less than 5 feet.
(6) Separation of Buildings. In addition to the required yards, buildings
shall be set as follows: Distances between primary buildings - 10 feet
Distances between accessory buildings and rear or side lot lines - 0 feet
Except for an accessory building covering up to 50$ of the required rear
yard, no building shall be located in any of the required yards.
(7) Height Limits. In the P-A Zone District, the maximum building height
shall be no more than 35 feet.
(8) Lot coverage. In the P-A Zone District, all buildings shall not cover
more than 60% of the total lot area.
(9) Parking, off-street. Parking may be provided in the required front
or side yards. All parking areas in the P-A Zone shall be landscaped
as follows:
(a) The sum of all landscaped areas shall be no less than 15% of
the total area of the property not covered by buildings or
structures.
(b) All yards which adjoin a street shall be permanently landscaped
to a depth of no less than 10 feet,
(c) All landscaped areas shall be served by a water irrigation
system and be supplied with bubblers and sprinklers.
(10) Signs.

Special Conditions and Standards: In addition to the established
development standards, when applicable the following conditions shall be met:
(1) Outside display and storage. No outdoor display of products or
' storage shall be permitted.
(2) Walls. Any lot proposed for professional-administrative development
which adjoins a lot located in a residential zone district shall have
a solid masonry wall of 6 feet in height installed along the common
lot line, except in the front yard area, said wall shall be reduced
to 42" in height.
(3) Enclosure of activities. All uses in the P-A Zone District shall be
located in a completely enclosed building.
