'Statement of the Matter
The1 City Council at your meeting of June 18, 1974, directed the City
Attorney to prepare the necessary documents approving Zone Change 1Q1,
approving Master Plan, adopting- Specific Plan (SP-102) and approving
Tentative Map (CT 73-1). The resolutions approving .the zone change,
the Master Plan and the Tentative Map, and the Ordinances adopting the
zone change and Specific Plan are attached.

City Manager's Recommendation
Concur with staff recommendation. Because of unusual
circumstances by which this was returned to the Council
after a long period, the matter was not properly referred
back to the Planning Commission for report after the
developer amended the Plan. In order to satisfy the legal
requirements, the staff has referred the matter to the
Planning Commission for report since your Council meeting
of June 18. Final action may now be taken on the item by
the Council by adoption of those resolutions and ordinances
prepared by the City Attorney and attached as exhibits.

RESOLUTION NO. 3446
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING
FINDINGS AND DECISION REGARDING CHANGE
OF ZONE FROM R-l-15,000 TO P-C ON PROPERTY
LOCATED ON THE LAGOON SIDE OF ADAMS STREET
AND SOUTHEAST OF HOOVER STREET. APPLICANT:
COVINGTON-CONINMARK.
WHEREAS, on February 13, 1973 a duly advertised public
hearing was held before the Planning Commission in the manner pre-
scribed by law to consider a change of zone from R-l-15,000 to
P-C on property located on the Lagoon side of Adams Street and
southeast of Hoover Street, more particularly described as:
Being all of Lots 1, 2, 3, 4,5, and a portion of
Lot 6, in Block D of Bellavista, in the City of
Carlsbad, California, County of San Diego, State
of California, according to Map No. 2152, filed
March 7, 1929, in the office of the County Re-
corder of San Diego County;
and
WHEREAS, at the conclusion of said hearing the Planning
Commission of the City of Carlsbad adopted Resolution No. 870
recommending said zone change which is herewith referred to and
made a part hereof; and
WHEREAS, on the 2nd day of July , 1974, the City
Council held a public, hearing on the matter, received all recom-
mendations and heard all persons interested in or opposed to the
proposed change of zone; and
WHEREAS, the Planning Director has certified that all of
the requirements of the City of Carlsbad Environmental Protection
Ordinance of 1972 have been fulfilled in connection with this zone
change;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the findings of the Planning Commission contained
in the aforementioned Resolution No. 870 constitute the findings

of the Carlsbad City Council.
3. That the approval of the proposed change of zone
classification is necessary to carry out the general purpose of

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, AMENDING
TITLE 21 OF THE MUNICIPAL CODE BY GRANT-
ING A CHANGE OF ZONE FROM R-1-15,000 TO
P-C ON PROPERTY LOCATED ON THE LAGOON
SIDE OF ADAMS STREET AND SOUTHEAST OF
HOOVER STREET. APPLICANT: COVINGTON-
CONINMARK.
The City Council of the City of Carlsbad, California,
does ordain as follows:
SECTION 1; The following described real property is
granted a change of zone from R-l-15,000 to P-C:
Being all of Lots 1, 2, 3, 4, 5, and a portion of
Lot 6, in Block D of Bellavista, in the City of
Carlsbad, California, County of San Diego, State
of California, according to Map No. 2152, filed
March 7, 1929, in the office of the County Re-
corder of San Diego County.
EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal within fifteen days after its adop-
tion.
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council held on the 2nd day of July , 1974,
and thereafter PASSED AND ADOPTED at a regular meeting of said

A RESOLUTION OP THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
A MASTER PLAN FOR A 190-UNIT CONDOMINIUM
PROJECT ON 12.9 ACRES LOCATED ON THE
LAGOON SIDE OF ADAMS STREET AND SOUTHEAST
OF HOOVER STREET. APPLICANT: COVINGTON-
CONINMARK.
WHEREAS, the Planning Coitunission of the City of Carlsbad
did on the 13th day OL February, 1973, hold a duly advertised
public hearing as prescribed by law to consider a request for
approval of a 190-unit condominium project on property generally
located on the Lagoon side of Adams Street and southeast of
Hoover Street, and more particularly described as:
Being all of Lots 1, 2, 3, 4, 5, and a portion of
'Lot 6, in Block D of Bellavista, in the City of
Carlsbad, California, County of San Diego, State
of California, according to Map No. 2152, filed
March 7, 1929, in the office of the County Re-
corder of San Diego County;
and
WHEREAS, at the conclusion of said hearing, the Planning
Commission adopted a series of resolutions recommending approval
of said development; and
WHEREAS, an Environmental Impact Report was prepared and
discussed at a duly noticed public hearing before the Planning
Commission and the City Council and was certified as complete in
compliance with City of Carlsbad Environmental Protection Ordi-
nance of 1972; and
WHEREAS, on the day of , 1974, a duly
advertised public hearing was held before the City Council to
consider the proposed request for approval of the above-described
190-unit condominium project, and after hearing and considering
the testimony and arguments, if any, of all persons desiring to
be heard, said Council did find the following facts and reasons
present which in their opinion are necessary to carry out the
general purpose of Title 21 of the Carlsbad Municipal Code:

1. The proposed application is consistent with the
General Plan as it applies to contiguous properties
within the City of Carlsbad.
2. The proposed zone is consistent with the Housing
Element of the General Plan.
3. The proposed development satisfies the intent of
the Planned Community (P-C) Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the approval of the proposed Master Plan is
necessary to carry out the general purpose of Title 21 of the
Municipal Code.
3. That the Master Plan, attached as Exhibit A revised
June 18, 1974, to Specific Plan (SP-102), is hereby approved as
the Master Plan for the development.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA ADOPTING A
SPECIFIC PLAN (SP-102) FOR A 190-UNIT
CONDOMINIUM PROJECT ON 12.9 ACRES GENERALLY
LOCATED ON THE LAGOON SIDE OF ADAMS STREET
AND SOUTHEAST OF HOOVER STREET. APPLICANT:
COVINGTON-CONINMARK.
The City Council of the City of Carlsbad, California,
does ordain as follows:
SECTION 1; A Specific Plan (SP-102) is hereby adopted
for approximately 12.9 acres of land generally located on the
Lagoon side of Adams Street and southeast of Hoover Street, more
particularly described as:
Being all of Lots 1, 2, 3, 4, 5, and a portion of
Lot 6, in Block D of Bellavista, in the City of
Carlsbad, County of San Diego, State of California,
according to Map No. 2152, filed March 1, 1929, in
the office of the County Recorder of San Diego
County,
said plan to consist of a plot plan marked Exhibit A to SP-102,
revised June 18, 1974, and an application with attachments on file
in the office of the City Planning Department and incorporated by
reference herein, subject to all terms and conditions of this
ordinance.
SECTION 2; Findings. The approval of Specific Plan (SP-
102) is justified by the following findings:
A. Conformance of the revised Specific Plan to the
approved Master Plan and to the General Plan.
B. Conformance of the revised Specific Plan to all re-
quirements of the Municipal Code requirements applicable to prop-
erty located in the Planned Community Zone.
C. Conformance of the precise development to the existing
and proposed development in the area.
SECTION 3; Development Conditions. The Specific Plan
(SP-102) is approved subject to the following conditions and
restrictions and the development of the property, as described in

Section 1 hereof, shall be subject to all such conditions and
restrictions which are in addition to all requirements, limitations
and restrictions of all municipal ordinances and state and federal
laws now in force or which may hereafter be in force:
1. The applicant shall install all required fire
hydrants and dry stand pipes prior to framing construc-
tion, and said fire appurtenances shall be functional
prior to commencing such work.
2. A land&cape plan shall be submitted to and approved
by the Planning Director, and such landscaping shall be
installed, constructed and planted according to such
approved plan, and shall thereafter be continuously and
permanently maintained.
3. Prior to the issuance of any building permit
whatsoever, a subdivision map shall be filed with the City
of Carlsbad and recorded pursuant to the Carlsbad Municipal
Code and the State Subdivision Map Act.
4. All mechanical equipment located on roof tops
shall be completely enclosed so as not to be visible
from any public street and/or adjacent property. Such
enclosure shall be of compatible design related to the
building structure for which such facilities are intended
to serve.
5. No signs or advertising of any type whatsoever
shall be erected or installed until plans therefor have
been approved by the City of Carlsbad.
6. All utilities, including electrical, telephone and
television shall be installed underground and/or shall be
completely concealed from view.
7. Final construction plans shall substantially
comply with the Specific Development Plan, and the struc-
ture shall be constructed in such a manner as to display
the architectural character incorporated in the Specific
Plan graphics.
8. Particular attention shall be expended to insure
public access to the water front via the existing sewer
easement. In addition, a document shall be prepared and
recorded designating said sewer easement for public
pedestrian access.
9. An agreement shall be obtained from the Carlsbad
Unified School District to provide for future school
requirements that will result from this development.
10. Exhibits as submitted by the applicant shall con-
stitute the graphic portions of the Specific Plan.
11. The applicant shall enter into an agreement with
the City and San Diego Gas & Electric Company for the
purpose of obtaining recreational access rights to the
surface waters of the upper Agua Hedionda Lagoon.

SECTION 4; Administration and Enforcement. The Building
Department shall not approve any building for occupancy until the
Planning Director has certified that all the conditions of this
ordinance have been satisfied.

WITH CONDITIONS TENTATIVE MAP (CT 73-1)
FOR A 190-UNIT CONDOMINIUM PROJECT ON
12.9 ACRES LOCATED ON THE LAGOON SIDE
OF ADAMS STREET AND SOUTHEAST OF HOOVER
STREET. APPLICANT: COVINGTON-CONINMARK.
WHEREAS, on the 13th day of February, 1973, the Carlsbad
City Planning Commission adopted Resolution No. 872 recommending
to the City Council that Tentative Map (CT 73-1) be conditionally
approved; and
WHEREAS, the City Council of the City of Carlsbad, on the
day of , 1974, considered the recommendation of
the Planning Commission; and
WHEREAS, said Tentative Map has complied with the require-
ments of the City of Carlsbad Environmental Protection Ordinance
of 1972 in that an Environmental Impact Report has been prepared
and accepted by the Planning Commission and the City Council;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
A. That the above recitations are true and correct.
B. That Tentative Map (CT 73-1) is hereby approved,
subject to the execution and/or fulfillment of the following
conditions:
1. Improvement plans shall conform to the City of
Carlsbad Engineering Design Criteria and Standard Plans,
except that Adams Street may have a design speed of 25
miles per hour.
2. Grading shall be performed to ensure that the
property will be free from ponding and/or surface of water.
3. Dedication of land for park purposes and/or in-lieu
fees shall be provided to the City of Carlsbad prior to
the recordation of the final map.
4. Hoover and Adams Streets shall be improved to
provide two 12-foot-wide travel lanes and a parking lane.
The improvement of Adams Street will include a minimum of
5 feet of dedication of right-of-way plus additional
dedication of right-of-way as approved by the City Engineer
to provide a safe horizontal and vertical alignment.

5. The applicant shall provide all-weather access to
and across the public sewer easement of and to the satis-
faction of the City Engineer.
6. All facilities provided to adequately control
drainage on the subject property shall be maintained by
the property owner(s) in perpetuity.
C. That said Tentative Map, together with the provisions
for its design and improvement and subject to the above conditions,
is consistent with all applicable general and spec:fie plans of
the City of Carlsbad.

MEMORANDUM
June 28, 1974
TO: CITY MANAGER

Subject: Covington-Coninmark
SP 102, CT 73-1
The Planning Commission was given a report on the proposed redesign
of the Covington-Coninmark project. An explanation of the purpose
of the redesigning was given by the Planning Director, to the effect
that density had been reduced from 14.7 DU/ac to 13.25 DU/ac. The
redesign would also provide increased public access to the Agua
Hedionda Lagoon. The Director also stated that the proposed redesign
would meet the goals and policies of the Open Space and Conservation
Element.
After discussion by the Planning Commission, the Commission moved
the following report be given to the City Council:
(1) The Planning Commission is nojL in agreement with the
redesign of the Covington-Coninmark project. It is
the Planning Commission's opinion that the density
should be 10 dwelling units per acre maximum. The
Planning Commission has recently recommended to the
City Council the proposed revised Land Use Element
which recommends a density range of 4-10 dwelling units,
therefore, if a redesign is to be accomplished, the re-
design program should meet the density recommendation
forwarded by the Planning Commission.
(2) An alternative to the above recommendation, if the City
Council elects to proceed with the Covington-Coninmark
project, (SP-102, CT 73-1), prior to the adoption of the
revised LandUse Element, the Planning Commission
recommends that the City Council adopt Exhibit A, SP-102
revised June 18, 1974. It is recommended that the adoption
be subject to the amendments proposed by Staff and Applicant
in the report to the City Manager dated May 14, 1974.
