Cnrpnratin.n y/f^Q y Real and 200 ft. (approx.) northerly of Statement of the Matter On Aug. 7, 1973 the City Council by Resolution No. 3178 approved the tentative map of Carlsbad Tract 73-8. The owner has requested that the subject tentative map be extended for a period of one year to Aug. 7, 1975. The City Engineer advises the Planning, Engineering, Fire and Building Dept. have been contacted to determine if they have any objections to the extension of the tentative map, and therefore, having no objections, it is recommended that the City Council approve the extension of the tentat ive map. BOX 1114 CARLSBAD, CALIFORNIA 92003 (714)493-3113 April 26, 1974 Mr. Tim Flanagan- City Engineer City of Carlsbad 1200 Elm Avenue Carlsbad, California 92008 Dear Tim: Due to problems in obtaining necessary funding for Carlsbad Palisades, we are forced to apply for a one year extension on Specific Plan and Tentative Tract Map 73-8 (Council Resolution No. 3177). This is due to sales in the north San Diego County area, including Carlsbad and La Costa, falling off to the point that lenders are reluctant to fund any projects in that vicinity. However, they have acknowledged a recent and definite upswing in the market and they are now thinking in more liberal terms. We feel that we are very close to obtaining a committment from any one of several large lending institutions. Needless to say, if the loan is funded anytime in the next two months, we won't need the extension and in all probability, this will be the case. How- ever in the event something unforeseen happens in the money market, to be on the safe side, I find it necessary to request the time ex- tension. Meanwhile we are actively proceeding with engineering and contract negotiations. We have awarded an engineering and grading contract and v/e now have grading, improvement and architectural plans ready for submittal to plan check. I trust you will find we have complied with Council Policy Statement No. 17 issued 10-16-73-Items 1, 2 and 3-Adequacy of Public Services in Connection with Develop- ment Proposals. . Bannister- Project Director RWB/awb Q O 6 7 8 9 10 11 12 13 14 15 16 RESOLUTION NO. 3178 ZD ^ -5 2 flCo ?• >° *^i " H> U)°5S§° 18 5°"§ >E 5- 19 > o 5 20 21 22 23 24 25 26 27 28 29 30 31 32II A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING TENTATIVE MAP (CT 73-8) PERMITTING DEVELOPMENT OF 331 UNITS ON PROPERTY GENERALLY LOCATED ON THE WESTERLY SIDE OF AND ADJACENT TO EL CAMINO REAL, APPROXIMATELY 200 FEET NORTHERLY OF THE INTERSECTION OF KELLY DRIVE AND EL CAMINO REAL, CONSISTING OF APPROXIMATELY 63 ACRES. SAID DEVELOPMENT IS TO BE KNOWN AS "CARLSBAD PALISADES". WHEREAS, on the 10th day of July, 1973, the Carlsbad City Planning Commission adopted Resolution No. 929, recommending to the City Council that Tentative Map (CT 73-8} be conditionally approved; and WHEREAS, the City Council of the City of Carlsbad, on the 7th day of August , 1973, considered the recommendation of the Planning Commission; and WHEREAS,said Tentative Map has complied with the requirements of the "City of Carlsbad Environmental Protection Ordinance of 1972" and an Environmental Impact Report was presented and discussed at a duly noticed public hearing held by the Planning Commission and the City Council and was approved as presented; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That Tentative Map (CT 73-8) is hereby approved, subject to the execution and/or fulfillment of the following conditions: 1. Prior to any construction, the applicant shall.submit a grading and drainage plan to the City Engineer for his consideration and approval. 3. All fire protection appurtenances shall be constructed in accordance with City Fire Department requirements. 4. The applicant shall install all required fire hydrants and dry-stand pipes prior to framing construction, and said fire appurtenances shall be functional prior to commencing such work. 5. The applicant shall install a fully actuated traffic signal at the intersection of Tamarack Avenue and El Camino Real, with reimbursement as possible. A Future Agreement may be submitted as an alternative. 6. The applicant shall install the remaining full half-street improvements on El Camino Real (1061 curb to curb) adjacent to the subdivision, including but not limited to - curb and gutter, sidewalk and paving. 7. Tamarack Avenue shall be installed as shown on the Tentative Map. 8. Street names shall be subject to the approval of the City Planning Department. 9. Tamarack Avenue shall have an 84 ft. right- of-way and shall be extended to Skyline Drive, with 52 ft. of pavement and full public improvements. Offsite, the improvements shall be installed within the existing right-of-way in a manner acceptable to the City Engineer. 10. Developer shall pay 50% of the cost of a two inch A.C. overlay on Birch Avenue between Skyline Drive and Sunnyhill Drive. 11. Adequate parking space, subject to the approval of the Planning Director, shall be provided for the Park and Recreational areas. 12. Park-In-Lieu fees shall be granted to the City prior to recording the Final Map. 13. The full improvement of Tamarack Avenue (Birch Avenue extended) shall be included in the first phase of development. 14. The C.C. & R's for this development shall be submitted to the Planning Director for review and approval prior to the issuance of any bui1 ding permi ts. All public improvements shall be made in conformity to the City of Carlsbad Engineering Design Criteria and Standard Plans, the Subdivision Ordinance and other City Standards to the satisfaction of the City Engineer, and without cost to the City of Carlsbad, and free of all liens and encumbrances. The Developer is encouraged to work with the Carlsbad Unified School District to provide for future school requirements that will result from the proposed development. If requested by the City Engineer, an amended Tentative Map shall be submitted for approval by the City Engineer prior to preparation of the Final Map to assure compliance to all conditions of approval. All utilities, including provisions for cable TV shall be placed underground and/or shall be completely concealed from view. During the course of construction all access to the subject property shall be taken from El Camino Real. C.
