Statement of the Matter
On August 7, 1973 the City Council by Resolution No. 3180 approved the
Tentative Map of "Carlsbad Tract 72-3V. The owner has requested that
the subject Tentative Map be extended for a period of one year, to
August 7, 1975. The City Engineer advises the Planning,
Engineering, Fire and Building Department have been contacted to
determine if they have any objections. It is recommended that the
City Council approve the extension of the Tentative Map. The
Public Facilities Policy has been met.

RESOLUTION NO. 3180
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING TENTATIVE MAP
(CT 72-34), A DEVELOPMENT OF 278 SINGLE-FAMILY
LOTS, 100 DUPLEX CONDOMINIUM LOTS AND 3 COMMERCIAL
LOTS, ON PROPERTY GENERALLY LOCATED ON THE WEST SIDE
OF EL CAMINO REAL, BETWEEN ALGA ROAD (EXTENDED) AND
ARENA! ROAD (EXTENDED) TO BE KNOWN AS "RANCHO LA CUESTA".
WHEREAS, on the 24th day of July, 1973, the Carlsbad City
Planning Commission adopted Resolution No. 935, recommending
to the City Council that Tentative Map (CT 72-34) be condition-
ally approved; and
WHEREAS, the City Council of the City of Carlsbad, on the
7th day of August , 1973, considered the recommendation
of the Planning Commission; and
WHEREAS, said application has complied with the require-
ments of the "City of Carlsbad Environmental Protection
Ordinance of 1972" and an Environmental Impact Report was
presented and discussed at a duly noticed public hearing held
by the Planning Commission and the City Council and was
approved as presented;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, as follows:
A. That the above recitations are true and correct.

B. That Tentative Map (CT 72-34) is' hereby approved,
subject to the execution and/or fulfillment of the following
conditions:
1. The applicant shall dedicate and improve Alga
Road to 1/2 street requirements for a "major
arterial highway" (102'R.O.W.) to the westerly
boundary of the subdivision.
2. The applicant shall install a four-way, fully
actuated traffic signal at the intersection of
Alga Road and El Camino Real and at Arena! Road
and El Camino Real. City will attempt to secure
reimbursement for the Developer by agreements
with the surrounding, or abutting, developers.
3. The applicant shall dedicate an open space
easement along the bank at the rear of the RD-M
lots backing up to El Camino Real. A building
pad that would permit a typical duplex unit to be

The applicant shall dedicate and install full
1/2 street improvements along El Camino Real.
All areas of the subdivision shall be designated
as a legal lot or public right-of-way.
The proposed sewer main to Leucadia County
Water District lift station is not approved.
A trunk line connecting to the Encina Treatment
Plant shall be installed prior to occupancy.
The design of this line shall be subject to
the approval of the City Engineer. The
applicant shall initiate proceedings to de-annex
the small portion of their property within
the L.C.W.D.'s service area.
Park-In-Lieu fees shall be paid to the City
prior to recording the Final Map.
Street names shall be subject to approval and
shall be designated in accordance with the
standards and policies adopted by the Planning
Commission on file in the Planning Department.
Said names shall be approved by the Planning
Director prior to recordation of the Final Map.

The method of storm drainage shown on the map
is not approved. Storm drainage shall be
designed per the requirements of the City Engineer,
Proper siltation controls and slope protection
shall be proposed as part of the required
grading plan (refer to EIR comments for sugges-
tions).
The development of the property described herein
shall be subject to the restrictions and
limitations set forth hereiri which are in
addition to all the requirements, limitations
and restrictions of all municipal ordinances
and State and Federal statutes now in force,
or which, hereafter, may be in force, for the
purpose of preserving the residential charac-
teristics of adjacent properties.
Prior to consideration of the Final Map and
Improvement Plans, a grading and plot plan
of the tract with all proposed dwelling units
located thereon, and showing appropriate
setback dimensions, shall be submitted to the
Planning Department for approval to insure that
adequate area requirements can be met.

The Developer is encouraged to work with
the Carlsbad Unified School District to
provide for future school requirements that
will result from the proposed development.
If requested by the City Engineer, an amended
Tentative Map shall be submitted for approval
by the City Engineer prior to preparation of
the Final Map to assure compliance to all
conditions of approval.
In order to provide for reasonable fire protec-
tion during the construction period, the sub-
divider shall maintain passable vehicular
access to all buildings, and adequate fire
hydrants with required fire flows shall be
installed as recommended by the Fire Department.
All public improvements shall be made in
conformity to the City of Carlsbad Engineering
Design Criteria and Standard Plans, the
Subdivision Ordinance and other City Standards
to the satisfaction of the City Engineer without
cost to the City of Carlsbad, and free of all

C. That said Tentative Map together with the provisions
for its design and improvement and subject to the above
conditions, is consistent with all applicable general and
specific plans of the City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting of
the Carlsbad City Council held on the 7th day of August »
1973, by the following vote, to wit:
