The'City Council granted an appeal of the Planning Commission's recommendation of
denial for the Papagayo Specific Plan Revision.(SP-31A)
The Planning Commission on July 23, 197.4, was given a report of the Council's action,
on Papagayo. The Planning Director reported the Commis'sion had several "options;
1) Reaffirm the Commissions original decision of Denial • . •"
2) Concur with the City Council action and recommend conditions of approval.
3) Reaffirm the original decision and recommend conditions of approval if -
the Council approved the revised Specific Plan (SP 31-A)
The Planning Commission by 2 for and 4 abstained vote, moved—to reaffirm the Commission's
original' decision of denial. The Commission subsequently moved with a 6-0 vote to
add conditions outlined in the Planning Director's-memorandum of July 26, 1974. Con-
ditions to incorporate dedication of the 3.2 acre Open Space easement and a phasing
program"were to be revised. '• . .

MEMORANDUM
July 26, 1974
TO: City Council
FROM: Planning Commission
SUBJECT: Planning Commission Report Papagayo Specific Plan (SP 31-A)
The Planning Commission at its July 23rd Planning Commission meeting
was presented a report by the Planning Director which informed the
Commission of the Councils' decision to grant the appeal on the Papagayo
Specific Plan revision. After some discussion by the Commission and the
Staff, the Planning Commission was of the opinion that there was no new
information which would cause the Planning Commission to reverse its
original recommendation of denial.
The Planning Commission moved to report to the City Council that the
Planning Commission's recommendation of DENIAL was still valid for the
reasons of Planning Commission Resolution 1074. The motion carried
2 for, 4 abstained and 1 absent.
Subsequent motion recommended that in the event the City Council approve
the proposed Specific Plan planning revision, the following conditions
should apply:
1. Prior to the issuance of building permits for residential
buildings, the following must be accomplished:
A. Any additional information required by the Planned Community
Ordinance including a detailed landscape-irrigation plan
and maintenance program be submitted to the City of Carlsbad.
B. Fees-in-lieu of dedications for park purposes as required by
the City of Carlsbad Municipal Code.
C. The applicant shall provide a legal description for the public
access easement, to be not less than 20 feet wide, from the
end of Harbor Drive to the area proposed for Open Space
Dedication. The public access shall be provided in a manner
shown on Exhibit A, the amended Specific Plan, dated July
1, 1974. The proposed public access shall be improved in a
manner acceptable to the Planning Director and shall provide
access for bicycles as well as pedestrians. The description
and conveyance of the easement as indicated on Exhibit A,
dated July 1, 1974, shall be submitted to/and approved by the
Planning Director.
D. Conveyance for public use 3.2 acre Open Space Easement as in-
dicated on Exhibit A, dated July 1, 1974.
E. The applicant shall rezone all areas shown as greenbelt/open
space to 0-5 (Open Space) Zone prior to final map approval.
F. CC & R's of the Home Owners Association to be submitted to the
Planning Director for review and approval.
G. Street rights-of-way, adjacent to the property as required for
Street improvements, shall be dedicated to the City free of all
items and encumbrances.
H. The water distribution and sewer collection system shall be dedi-
cated to the City together with the necessary easements free of
liens and encumbrances. Connections to the existing trunk line
through the property shall be made only at manholes.
The interior streets are proposed to be private. The following special
conditions shall apply:
A. Provisions for maintaining the streets, satisfactory to the City
Engineer and City Attorney, shall be provided prior to issuance of
any building permits.
B. The design of all streets shall be approved by the Public Works
Department and all street construction shall be inspected by the
Public Works Department and a standard inspection fee paid.
C. All streets shall be designed for a structural section in accordance
with the City of Carlsbad Standard Design criteria.
D. Provision for accommodating pedestrian traffic satisfactory to
the Planning Director and City Engineer shall be provided.
E. Lighting adequate for pedestrian and vehicular safety and sufficient
to minimize police problems shall be provided.
F. Where it is proposed to reduce street widths by elimination of
curb-side parking, equivalent parking in addition to the normal
off-street requirement shall be provided by other means.
G. The City will assume no responsibility for enforcement of traffic
control.
The Specific Plan Exhibit known as Exhibit A, revised July 1, 1974,
shall be adopted as a Specific Plan and shall be revised to include
the following modification:
A. The intersection of the easterly entrance shall be located approxi-
mately 250' easterly of Jefferson Street, the exact location to be
approved by the City Engineer.
The phasing of the development shall occur as indicated on Exhibit A,
dated July 1, 1974 and in the following manner:
Phase I 50 Units Not earlier than September, 1974
Phase II 56 Units
Phase III 52 Units
Phase IV 42 Units
Phase V 30 Units
Phase IV and V may be initiated simultaneously at the completion of
Phase III.
A. All public and private improvements contained in each phase shall
be completed and accepted by the City of Carlsbad prior to
commencement of each succeeding phase. This shall include private
streets, water systems and sewer systems.
B. Traffic signals at Jefferson Street and Tamarack Avenue shall be
required as part of Phase I.
C. Full street improvements shall be constructed over the Southerly 32
feet of Chinquapin Avenue between 1-5 and the A.T. & S.F. Railroad
and installed prior to completion of Phase II.
D. On-site fire hydrants and fire protection appurtenances for each
phase shall be installed in accordance with Fire Department
requirements and be installed prior to construction of such phase.
E. Building permits shall not be issued on any phase after 5 years
from the date of City Council approval unless development is
reviewed by the City Council to determine if development is in
substantial compliance with General Plan, ordinances, or policies
that may have been adopted during this five-year period.
5. All public improvements shall be constructed in accordance with City
of Carlsbad design criteria and shall be subject to the approval of
the City Engineer.
6. Fire retardant materials subject to the approval of the City Fire
Chief shall be utilized wherever applicable.
7. The storm drain shall be installed as directed by the City Engineer.
