The City Council at your July 16, 1974 meeting directed the City Attorney
to prepare the necessary documents for the subject project. Attached are
the documents approving the Specific Plan (SP-155) and Tentative Map
(CT 73-59) subject to certain conditions as recommended by. the Planning
Commission.

CITY OF CARLSBAD, CALIFORNIA ANNOUNCING
3 FINDINGS AND DECISION ON A SPECIFIC PLAN
(SP-155) FOR DEVELOPMENT OF 326 DWELLING
4 UNITS ON 60 ACRES OF LAND GENERALLY
LOCATED EAST OF LOWDER LANE BETWEEN
5 PALOMAR AIRPORT ROAD AND POINSETTIA LANE.
APPLICANT: PACESETTER HOMES, INC.

7 WHEREAS, a duly advertised public hearir.? was held on
8 June 25, 1974 before the Planning Commission to consider adoption
9 of a Specific Plan (SP-155) to allow for the development of 326
10 dwelling units on 60 acres of land generally located east of
11 Lowder Lane between Palomar Airport Road and Poinsettia Lane and
12 more particularly described as:
13 A portion of the West half of Section 21, Township
12 South, Range 4 West, S.B.B.M., in the City of
14 Carlsbad, County of San Diego, State of California;
15 and
16 WHEREAS, at the conclusion of said hearing on June 25, 1974
17 the Planning Commission of the City of Carlsbad adopted Resolution
18 No. 1072 recommending adoption of said plan which is herewith
19 referred to and made a part hereof; and
20 WHEREAS, on the day of , 1974, the City
21 Council held a duly advertised public hearing on the matter and
22 received all recommendations and heard all persons interested in
23 or opposed to the proposed Specific Plan; and
24 WHEREAS, said application has complied with the require-
25 ments of the City of Carlsbad Environmental Protection Ordinance
26 of 1972 in that an Environmental Impact Report has been prepared
27 and accepted by the Planning Commission and the City Council;
28 NOW, THEREFORE, BE IT RESOLVED by the City Council of
29 the City of Carlsbad as follows:
30 1. That the above recitations are true and correct.

ORDINANCE NO. 9400
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, ADOPTING
A SPECIFIC PLAN (SP-155) FOR DEVELOPMENT
OF 326 DWELLING UNITS ON 60 ACRES OF LAND
GENERALLY LOCATED EAST OF LOWDER LANE
BETWEEN PALOMAR AIRPORT ROAD AND POINSETTIA
LANE. APPLICANT; PACESETTER HOMES, INC.
The City Council of the City of Carlsbad, California does
ordain as follows:
SECTION 1; A Specific Plan (SP-155) is hereby adopted
for development of 326 dwelling units on 60 acres of land gener-
ally located east of Lowder Lane between Palomar Airport Road and
Poinsettia Lane, more particularly described as:
A portion of the West half of Section 21, Township
12 South, Range 4 West, S.B.B.M., in the City of
Carlsbad, County of San Diego, State of California,
said plan to consist of a plot plan marked Exhibit A to SP-155,
revised June 25, 1974, and an application with attachments on file
in the office of the City Planning Department and incorporated
by reference herein, subject to all terms and conditions of this
ordinance.
SECTION 2; Findings. The approval of Specific Plan
(SP-155) is justified by the following findings:
A. Conformance of the revised Specific Plan to the
approved Master Plan No. 132.
B. Conformance of the revised'Specific Plan to all re-
quirements of the Municipal Ordinance for property located in the
Planned Community Zone District.
C. Conformance of the precise development to the existing
and proposed development in the area.
SECTION 3; Development Conditions. The Specific Plan
(SP-155) is approved subject to the following conditions and
restrictions and the development of the property, as described in
Section 1 hereof, shall be subject to all such conditions and

restrictions which are in addition to all requirements, limita-
tions and restrictions of all municipal ordinances and state and
federal laws now in force or which may hereafter be in force:
A. Dedication of Lots 19 and 21, satisfying the Park
Dedication Ordinance, shall occur at the time of final map
approval. The applicant shall also rezone lots 19 and 21
(Park lots) and lots 8, 9 and 10 (Recreation areas) to
Open Space Zone (0-S) prior to final map approval.
B. The approval is granted for the land described in
the application and any attachments thereto, and as shown
on the plot plan submitted labeled Exhibit A. The loca-
tion of all buildings, fences, signs, roadways, parking
areas, landscaping, and other facilities or features
shall be located substantially as shown on the plot plan
labeled Exhibit A, except or unless indicated otherwise
herein. All buildings and structures shall be of the
design shown on the elevation plans labeled Exhibit B.
C. All outside storage areas shall be screened from
adjacent property and streets.
D. An incombustible trash enclosure shall be provided
of a size and location acceptable to the Planning Director,
and said area shall be enclosed with a fence and/or wall
of sufficient height to adequately shield the area. Said
fence and/or wall shall include a solid gate.
E. A detailed landscape and sprinkler plan shall be
submitted to the City of Carlsbad for consideration and
approval.
F. All utilities including electrical, telephone and
cable television, shall be installed underground and/or
shall be completely concealed from view.
G. All public improvements shall be made in conformity
with the Subdivision Ordinance and other City standards
to the satisfaction of the City Engineer, without cost
to the City of Carlsbad and free of all liens and encum-
brances .
H. Construction of this development shall occur in
accord with the following phasing schedule:
November, 1974
February, 1975
May, 1975
August,1975
November, 1975
Construction of the next phase in sequence may not be
commenced until completion of the preceding phase. Con-
struction of any particular phase may not begin in any
event prior to the date indicated. The approval of the
Specific Plan is granted on condition that the entire
construction program be completed by July, 1979. In the
event construction is not so completed, the Specific Plan
shall be reviewed by the City Council. At that time, in
the sole discretion of the City Council, the completion

date for the project may be extended on proper showings
or modified in some other manner or approval for the bal-
ance of the project may be revoked.
SECTION 4; Administration and Enforcement. The Building
Department shall not approve any building for occupancy until the
Planning Director has certified that all the conditions of this
ordinance have been satisfied.
EFFECTIVE DAT*?; This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal within fifteen days after its adop-
tion.
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad 'City Council held on the day of , 1974,
and thereafter PASSED AND ADOPTED at a regular meeting of said
Council held on the day of , 1974, by the follow-

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
WITH CONDITIONS TENTATIVE MAP (CT 73-59)
TO ALLOW A 21-LOT SUBDIVISION ON PROPERTY
LOCATED EAST OF LOWDER LANE BETWEEN PALOMAR
AIRPORT ROAD AND POINSETTIA LANE.
APPLICANT: PACESETTER HOMES, INC.
WHEREAS, on the 25th day of June, 1974 the Carlsbad City
Planning Commission adopted Resolution No. 1073 recommending to
the City Council that Tentative Map (CT 73-59) be conditionally
approved; and
WHEREAS, the City Council of the City of Carlsbad, on
the day of , 1974, considered the recommendation
of the Planning Commission; and
WHEREAS, said Tentative Map has complied with the require-
ments of the City of Carlsbad Environmental Protection Ordinance
of 1972 in that an Environmental Impact Report has been prepared
and accepted by the Planning Commission and the City Council;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
A. That the above recitations are true and correct.
B. That Tentative Map (CT 73-59) is hereby approved,
subject to the execution and/or fulfillment of the following
conditions:
1. The developer must obtain off-site public sewer
easements prior to any grading of the project.
2. "A" Street shall be constructed to a 42-foot
half-width, or as otherwise modified by the City Engineer.
3. The developer shall participate in traffic signal
installation as determined by any policy of the City
Council in effect at the time of the recordation of the
final map.
4. The developer shall dedicate access rights to "A"
Street.
5. Lots 8, 9 and 10 shall be dedicated as open space
lots on the final map.

6. The developer shall obtain off-site right-of-way
and develop one-half width (34 feet) of Camino de las
Ondas to the Lowder Lane intersection.
7. "B" Street shall be aligned with the street in
CT 73-23 at their intersection with Camino de las Ondas.
8. The recorded restrictions for the subdivision shall
include the minimum lot size and width requirements, evi-
dence of which shall be submitted to the City Planning
Director prior to approval of the final map.
9. The development of the property described herein
shall be subject to the restrictions and limitations set
forth herein which are in addition to all the requirements,
limitations and restrictions of all municipal ordinances
and state and federal statutes now in force, or which
hereafter may be in force for the purpose of preserving
the residential characteristics of adjacent properties.
10. The C.C.& R.'s for this development shall be
submitted to the Planning Director for review and approval
prior to the issuance of any building permits.
11. In order to provide for reasonable fire protec-
tion during the construction period, the subdivider shall
maintain passable vehicular access to all buildings and
adequate fire hydrants with required fire flows shall
be installed as recommended by the Fire Department.
12. All public improvements shall be made in conform-
ity to the City of Carlsbad Engineering Design Criteria
and Standard Plans, the Subdivision Ordinance and other
City standards, to the satisfaction of the City Engineer,
without cost to the City of Carlsbad, and free of all
liens and encumbrances. Improvement plans for water and
sewer systems shall meet the requirements of the respec-
tive service districts.
13. Street lighting shall be provided for as required
by Municipal Code. The developer shall post a bond and/or
cash in the amount necessary to energize said street
lights for an 18-month period after construction, to permit
the incorporation of the subdivision into a maintenance
district.
14. All land and/or easements required by this ordi-
nance shall be granted to the City of Carlsbad without
cost to the City, and free of all liens and encumbrances.
No easements shall be recorded prior to recordation of
the final map unless approved by the City Engineer.
15. All facilities provided, other than public ease-
ments, to adequately control drainage on the subject
property, shall be maintained by the property owner(s) in
perpetuity.
16. Street names shall be subject to approval and
shall be designated in accordance with the standards and
policies adopted by the Planning Commission on file in the
Planning Department. Said names shall be approved by
the Planning, Fire and Police Departments prior to
recordation of the final map.

17. The improvement plans shall include a report of
a geological investigation and a complete grading plan
for the entire site when required by the City Engineer.
The report and plan shall be prepared by Civil Engineers
licensed by the State of California, and experienced in
erosion control who shall be acceptable to the City
Engineer, and they shall certify that they have investi-
gated the site and prepared data with full consideration
of the consequences to the included and neighboring prop-
erties and conform to the standards of the Geological
Safety Element of the General Plan.
C. That sai'? Tentative Map, together with the provisions
for its design and improvement and subject to the above conditions,
is consistent with all applicable general and specific plans of
the City of Carlsbad.
