An unexpended balance of $1,500 from Fiscal Year, 1973-74 has been, used to reduce this year's assessment. . However, a cost adjustment factor for fuel, labor and materials of $10,495.-05has been included for 1974-75 . lighting districts. In order to have the assessments placed, on the property tax bill and collected by the County, it is necessary for the Council to approve the special assessment roll. , Funds necessary for the City's participation in the lighting districts .. should be appropriated in the 1974-75 budget. A street lighting contract for the energizing and partial maintenance of the lighting system must be entered into by Council. It is- necessary that Council determine that SDG&E is the only contractor capable of performing said contract and authorize the agreement' therefor in, accord- ance with the rules and rates of the Public Utilities Commission. WHEREAS, the San Diego Gas & Electric Company is the sole and only source available to the City capable of performing said_ contracts which are governed as to rates and rules by the California Public Utilities Commission; 18 . LIGHTING MAINTENANCE DISTRICTS NO. 1, 2 4 jj ' AND 3 ___________________^^ . ' 5 jj WHEREAS, the City Engineer on June 5, 1974 filed with the !'6 jj City Council an estimate of costs for 'lighting maintenance ..di: for 1974-75; and 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 WHEREAS, the expenses of maintenance and operation to be borne by Districts no. 1, 2 and 3 shall be paid by special assess- ment levies upon the land, exclusive of improvements within the Districts; and WHEREAS, the estimated costs of City participation in•the districts were estimated in the report by the City Engineer dated June 5, 1974. . NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That the boundaries of the Districts shall remain as shown on map entitled "Lighting Maintenance District Map 1973-78" on file in the Office of the City Clerk and incorporated herein by reference. 3. That the items of maintenance for the lighting system shall consist of electric power, relamping,.1 cleaning of lenses . and repair or replacement of damaged circuits, luruinaires and standards and other necessary items as described in the Report of the. City Engineer to the City Council dated June 5, 1974, on file in the office of the City Clerk and incorporated by reference herein. Said system shall be lighted from fifteen (15) minutes after sunset until one-half hour (thirty minutes) before sunrise each day in the year. That the City Council determines that there is only one contractor practically capable of serving the street lighting system and that such contractor is subject to the jurisdiction of the Public Utilities Commission of the State, of California, and the City Council orders that the above described items of maintenance and operation be furnished from time to time as necessary by the San Diego Gas and Electric Company, in accord- ance with the rates and rules filed by it from time to time with said Public Utilities Commission. 5. That the City Council orders that the percentage of the total expenses of maintenance and operation to be paid by District No.s 1, 2 and 3 shall be paid by special assessment taxes levied upon all the lands, exclusive of improvements, within - said-districts. . . 6. That the City of Carlsbad shall pay the following amounts of the total expenses of maintenance and operation of said system: District No. 1 $1/624.80 District No. 2 $1,853.78 District No. 3 $2,631.66 1. That the amount of the total expense of maintenance and operation of said system to be paid by each district of assessment against individual benefited parcels of land within each district is as follows: District No. 1 $19,157.68 District No. 2 $10,030.50 District No. 3 .$60,.069. 74 8.
