Attorney to prepare the necessary document adopting Specific Plan (SP-31A).

ORDINANCE NO. -9401
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA ADOPTING
AN AMENDED SPECIFIC PLAN (SP 31-A) ON
PROPERTY LOCATED ON THE EASTERLY SIDE
OF THE A.T.& S.F. RAILROAD RIGHT-OF-WAY,
WESTERLY OF INTERSTATE 5 AND SOUTHERLY
OF CHINQUAPIN AVENUE. APPLICANT: LARRY
HUNTS
The City Council of the City of Carlsbad, California does
ordain as follows:
SECTION 1; An amended Specific Plan (SP-31-A) is hereby
adopted for development of 230 dwelling units on property generally
located east of the A.T.& S.F. Railroad right-of-way, west of
Interstate 5 and south of Chinquapin Avenue, more particularly
described as:
All that portion of Tract 233 of Thum Lands, City
of Carlsbad, County of San Diego, State of Cali-
fornia, according to Map No. 1681 filed in the
office of the County Recorder of San Diego County,
December 9, 1915; also known as San Diego County
Assessor's Parcels 11, 12 and 13 of Book 206,
page 22,
said plan to consist of a plot plan marked Exhibit A to SP 31-A,
revised July 1, 1974, and an application with attachments on file
in the office of the City Planning Department and incorporated by
reference herein, subject to all terms and conditions of this
ordinance.
SECTION 2; Findings. The approval of Specific Plan
(SP 31-A) is justified by the following findings:
A. Substantial conformance of the revised Specific Plan
to the approved Master Plan.
B. Conformance of the revised Specific Plan to all re-
quirements of the Municipal Ordinance for property located in the
Planned Community Zone District.
SECTION 3: Development Conditions. The Specific Plan
(SP-31A) is approved subject to the following conditions and
restrictions and the development of the property, as described in
Section 1 hereof, shall be subject to all such conditions and

restrictions which are in addition to all requirements, limita-
tions and restrictions of all municipal ordinances and state and
federal laws now in force or which may hereafter be in force:
1. Prior to the issuance of building permits for
residential buildings, the following must be accomplished:
A. Any additional information required by the
Planned Community Ordinance including a detailed landscape-
irrigation plan and maintenance program be submitted to
the City of Carlsbad.
B. Fees-in-lieu of dedications' for park purposes
as required by the City of Carlsbad Municipal Code.
C. The applicant shall provide a legal descrip-
tion for the public access easement, to be not less than
20 feet wide, from the end of Harbor Drive to the area
proposed for Open Space dedication. The public access
shall be provided in a manner shown on Exhibit A, the
amended Specific Plan, dated July 1, 1974. The proposed
public access shall be improved in a manner acceptable
to the Planning Director and shall provide access for
bicycles as well as pedestrians. The description and
conveyance of the easement as indicated on Exhibit A
dated July 1, 1974 shall be submitted to and approved by
the Planning Director.
D. Conveyance for public use 3.2-acre Open Space
easement as indicated on Exhibit A dated July 1, 1974.
E. The applicant shall rezone all areas shown as
greenbeIt/open space to 0-S (Open Space) Zone prior to
occupancy of first unit.
F. CC&R's of the Homeowners Association to be
submitted to the Planning Director for review and approval,
G. Street rights-of-way, adjacent to the property
as required for street improvements, shall be dedicated
to the City free of all liens and encumbrances.
H. The water distribution and sewer collection
system shall be dedicated to the City together with the
necessary easements free of liens and encumbrances. Con-
nections to the existing trunk line through the property
shall be made only at manholes.
2. The interior streets are proposed to be private.
The following special conditions shall apply:
A. Provisions for .maintaining the streets, satis-
factory to the City Engineer and City Attorney, shall be
provided prior to issuance of any building permits.
B. The design of all streets shall be approved by
the Public Works Department and all street construction
shall be inspected by the Public Works .Department and a
standard inspection fee paid...-
C. All streets shall be designed for a structural

section in accordance with the City of Carlsbad Standard
Design criteria.
D. Provision for accommodating pedestrian traffic
satisfactory to the Planning Director and City Engineer
shall be provided.
E. Lighting adequate for pedestrian and vehicular
safety and sufficient to minimize police problems shall be
provided.
F. Where it is proposed to reduce street widths
by elimination of curbside parking, equivalent parking in
addition to the normal off-street requirement shall be
provided by other means.
G. The City will assume no responsibility for
enforcement of traffic control.
3. The Specific Plan exhibit known as Exhibit A,
revised July 1, 1974, shall be adopted as a Specific Plan
and shall be revised to include the following modification:
A. The intersection of the easterly entrance
shall be located approximately 250 feet easterly of
Jefferson Street, the exact location to be approved by the
City Engineer.
4. The phasing of the development shall occur as
indicated on Exhibit A dated July 1, 1974, in fche follow-
ing manner:
Phase I
Phase II
Phase III
Phase IV
Phase V

30 Units
Not earlier than Sept.1974
Phase IV and V may be initiated simultaneously
at the completion of Phase III.
A. All public and private improvements contained
in each phase shall be completed and accepted by the City
of Carlsbad prior to commencement of each succeeding phase.
This shall include private streets, water systems and
sewer systems.
B. Traffic signals at Jefferson Street and Tamarack
Avenue shall be required as part of Phase I.
C. Full street improvements shall be constructed
over the southerly 32 feet of Chinquapin Avenue between
1-5 and the A.T.& S.F. Railroad as follows: That portion
of said improvements between 1-5 and a point 68 feet west
of the center line of Jefferson Street shall be constructed
and completed prior to occupancy of Phase I of the develop-
ment. The balance of said improvements shall be con-
structed and completed prior to occupancy of Phase IV of
the development.
D. On-site fire hydrants and fire protection ap-.
purtenances for each phase shall be installed in accord-
ance with Fire Department requirements and be installed
prior to construction of such phase.

E. Building permits shall not be issued on any phase
after 5 years from the date of City Council approval unless
development is reviewed by the City Council to determine
if development is in substantial compliance with General
Plan, ordinances or policies that may have been adopted
during this 5-year period.
5. All public improvements shall be constructed in
accordance with City of Carlsbad design criteria and shall
be subject to the approval of the City Engineer.
6. Fire retardant materials subject to the approval
of the City Fire Chief shall be utilized wherever appli-
cable.
7. The storm drain shall be installed as directed
by the City Engineer.
SECTION 4: Administration and Enforcement. The Building
Department shall not approve any building for occupancy until the
Planning Director has certified that all applicable conditions of
this ordinance have been satisfied.
SECTION 5; Ordinance 9311 is repealed.
EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal within fifteen days after its adop-
tion.
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council held on the 20th day of August , 1974,
.adjournedand thereafter PASSED AND ADOPTED atan/regular meeting of said
Council held on the 11th day of September, 1974, by the follow-
ing vote, to wit:
AYES: Councilman ' Frazee, McComas and Chase.
NOES: Councilman Lewis and Skotnicki.
