Subject: Submitted By:$J Public Hearing - Proposed Underground Utility Public Works District No. 5 - El Camino Real Administrator 3 - - Statement of the Matter Notices of the hearing have been mailed to the affected property owners and utility companies as required by ordinance. After interested parties have had an opportunity to speak, the Council may determine that the public health, safety and welfare require the removal of overhe and installation of underground lines and adopt Resolution No. &- The estimated cost of the conversion project is $156,000 to be funded from the County's Conversion Allocation. The work is scheduled to be accomplished in the spring of 1975. The formation of the County Underground District is contingent upon the formation of this district. The only project within the City District is the Rancho Carlsbad Mobilehome Park, which is already undergrounded to the point of connection to this District. WHEREAS, Chapter 11.08 of the Carlsbad Municipal Code provides for the formation in the City of Carlsbad of underground utility districts to accomplish the orderly removal of existing overhead facilities and the construction of new underground facilities; and WHEREAS, the San Diego County Underground Advisory Committee has recommended that contiguous City and County districts be formed to replace overhead lines on a portion of El Camino Real; and WHEREAS, The City Underground Advisory Committee has reviewed the proposed districts and concurs with the recommendation of the County Underground Advisory Committee that a district be formed on El Camino Real from southerly of Agua Hedionda Creek to Rancho Carlsbad Drive; and WHEREAS, the monies for the work are to be charged to the County's a1 location of conversion funds; and WHEREAS, further proceedings pursuant to Chapter 11.08 are warranted to determine whether or not the district should be established; T t NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Carlsbad, as fol ows: 1. The Counci hereby expresses its intent to initiate pro- ceedings for the formation of an underground utility district for the above-described area to be known as Underground Utility Distric No. 5. 2. Carlsbad, Cal ifornia, to ascertain whether the pub1 ic health, safety, or welfare require the removal of poles, overhead wires, and associated overhead structures, and the underground installatic of wires and facilities for supplying electric, communication, or similar associated service in the area hereinabove described and to determine whether or not the City should continue proceedings to create and implement an underground utility district to accomp- 1 ish said removal and installation. 3. At said hearing all persons interested are invited to appear and present their views and all such persons shall be given an opportunity to be heard. Said hearing may be continued from time to time as may be determined by the City Council. 4. The area to be included within the proposed District No. 5 is shown upon that certain map entitled "Map of Proposed Underground Utilities District No. 5," dated July 1, 1974 9 which is on file in the office of the City Clerk of the City of Carlsbad, and which is incorporated by reference herein. 5. The City Clerk shall give notice of the time and place of the hearing to all property owners within the District as shown on the last equalized assessment rolls,or as known to the City Clerk and to each Public Utility within the District by mail- ing a copy of this resolution to such property owners and such utilities at leastten (10) days prior to the date thereof. WHEREAS, on July 16, 1974, the City Council of the City of Carlsbad adopted Resolution No. 3462 expressing its intent to initiate proceedings pWsuant to Chapter 11.08 of the Carlsbad Municipal Code and calling a public hearing to determine whether or not the public health, safety or welfare required the formation of an underground utility district in a portion of Carlsbad; and WHEREAS, pursuant to Resolution No. 3462, a public hearing was held on August 20, 1974 at the hour of 7:30 PM, in the Council Chambers in the City Hall, Carlsbad, California to ascertain whether the public health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilitie for supplying electric, communication.or similar or associated service, within that certain area of the City described as follows (see Exhibit “A” ) WHEREAS, said hearing was also held to determine whether or not the City should continue proceedings to create and implement an underground utility district to accomplish said removal and . installation; and WHEREAS, notice of said hearing was given to all affected property owners as shown on the last equalized assessment roll and utilities concerned in the manner and for the time required by law; and WHEREAS, said hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard. NOW, THEREFORE, BE: IT RESOLVED by the City Council of the City of Carlsbad, as follows: 1. Such notification shall be made by mailing a copy of this resolution together with a copy of Chapter 11.08 of the Municipal Code to affected property owners as such are shown on the last equalized assessment roll and to the affected utilities; 6. That the Council of the City of Carlsbad hereby finds . and determines that the public health, safety and welfare require the removal of poles, overhead wires and associated structures, and the underground installation of wires and facilities for supplying electric, communication or similar or associated servicc in the above described area. 3. That said area is hereby declared to be an underground utility district, and is designated as Underground Utility Distric No. 5 of the City of Carlsbad. Attached hereto, as "Exhibit BO', and incorporated.by reference herein, is a map delineating the boundaries of said District. 4. That the City Council finds that said District is in the public interest for one of the following reasons: A. The streets, roads or rights of way in the District are extensively used by the general public and carry a heavy volume of pedestrian or vehicular .traffic. B. The said streets, roads or rights of way adjoin or pass through an area of unusual scenic interest to the general public. 5. That the City Clerk is hereby instructed to notify all affected utilities and all persons owning real property within installation shall be accomplished, and within which affected -__ ..... . . .
