Changes include substitution of individual birthdays as a holiday in lieu of Admission Day, changes in marksmanship compensation and changes in the Educational Incentive Program. August 20, 1974 Cit2 1•Janager's Recommendation It•is recommended that Resolution No. 3486 be adopted to implement the necessary changes in•the City's Personnel -Rules which Provide for changes in benefits to City employees as agreed to by the•various Memorandums of Understanding, Two items I wish to call special attention t'o: 1. The. language of the -Educational -Incentive Program is not entirely satisfactory. We have.utilized the • language that presently exists. The only change made was dropping the top 2 1/2% as agreed. No attempt was .made to improve; -the ex4sting-language in order to avoid complications in the negotiations. It"is ?tntici- pated that additional review of this section will ber made with the rewriting of the'Personnei Rules which is in progress at this time. 2. No specific.provision was made for•retroactivity to July 1, 1974 for•the substitution of an employee's birthday for Admission Day holiday. This office will, • however, handle that on an -administrative basis. ADJUSTMENTS IN SCHOOLING PAY, HOLIDAYS AND EDUCATION INCENTIVE PAY. WHEREAS, the City Council has approved Memorandums of Understanding with the Carlsbad Police Officers Association, the Carlsbad Firefighters Association and the Carlsbad City Employees Association which provide for changes in certain terms and condi- tions of employment; and WHEREAS, in order to implement the terms of said Memorand- ums it is necessary to amend portions of the Personnel Rules and Regulations of the City of Carlsbad, California; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and-correct.------- 2. That the Personnel Rules and Regulations of the City of Carlsbad, California, are hereby amended by the amendment of Rule IV, Section 8, Rule X, Section 13 and Rule XV to read as shown on the document entitled "Personnel Rules Amendment, Aug- ust 6, 1974", marked Exhibit A, attached hereto and incorporated herein by reference. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the 20th day of August , 1974, by the following vote, to wit: 26 AYES: Cmn. Effective January 1, 1974, Rule IV is amended to read as follows: "Section 8. Compensation for Pistol Marksmanship: Any City of Carlsbad Police Officer who, as a result of monthly pistol requalification with a service pistol, fires a record score qualifying him as a Pistol Expert for each of six or more.months of the calendar year shall receive Pistol Expert pay. Pistol Expert pay shall be in the amount of $50.00 per year, to be paid on the first scheduled pay day of December. Only Pistol Experts shall receive marksmanship compensation. Pistol Sharp- shooter and Pistol Marksman designations resulting from monthly pistol requalification firing shall be recorded for department record purposes only and shall not be eligible for marksmanship compensation. The City Manager may appoint a Rangemaster to certify the scores." 2. Effective July 1, 1974, Rule X is amended to read as follows: "Section 13. Holidays: Municipal offices shall be closed on the following days which are designated as legal holidays for all employees in the City service: New Year's Day, Lincoln's Birthday, Washington's Birthday, Memorial Day, Independence Day, Labor Day, Veterans' Day, Columbus Day, Thanksgiving Day and Christmas Day.- In addition thereto each employee may observe his birthday as an individual holiday. If the employee's birthday falls on a Saturday, Sunday or holiday, he may observe another day of his choice as his birthday holiday with the approval of his department head. If a holiday other than the birthday holiday falls on a Saturday, the preceding Friday shall be observed as a holiday in lieu thereof. If a holiday other than the birthday holiday falls on a Sunday, the following Monday shall be observed as a holiday in lieu thereof." 'v 3. Effective Septembet.91 1974, Rule XV is amended in -its, entirety to read as follows: "RULE XV. EDUCATIONAL INCENTIVE PROGRAMS Section 1. General: The objectives of this program are to encourage full-time career employees to strive for, and, maintain a high level of educational achievement. To acknowledge that with a high level of education the employee is more valuable to the community, therefore, he should be compensated for this asset. To define educational goals, and to aid employees in attaining them. Qualifying standards shall consist of two consecutive years of full-time employment with the City of Carlsbad, except those employees designated a "miscellaneous professional" and for whom four consecutive years of full-time employment with the City of Carlsbad will be -2-- _ A required. Section 2. Police Safety and Police Miscellaneous Employees. A police safety employee in the classified position POLICE CHIEF, and police miscellaneous employees with classifications relative to other City departments will not be eligible for pay because of this education incentive, program. Eligibility for compensation shall be established quarterly from January of each year. Proof of eligibility will be the responsibility of a Police Department Education Committee of three (3), representative of top, middle and basic levels, this committee being responsible for the s initial approval of an accepted study curriculum using the criteria police science or an associated one, recognizing those prerequisite courses towards the attain- ment of an associate or baccalaureate degree from an accredited college. It shall be the responsibility of this committee to forward the names and supportive materials to establish education incentive pay to the personnel director for the ultimate approval of the City Manager. Only employees who have been performing satisfactory work, or above, for the previous year will be eligible for educational compensation. All applications must be accompanied with a grade card or certified transcript showing the following: - 3 - a. A Grade Point Average of 2.00 or above. b. Number of units or classroom hours. c. Where the course was taken. The following schedule will be used to determine compen- sation for police safety training or college acheivement. SCHEDULE OF PAY CARLSBAD Pn&T. It will be recognized that an accumulation of more than seven (7) units per semester would interfere with the efficiency and/or health of a qualifying employee. Qualifying units or points are not accumulated within regular scheduled working hours unless justified by a department education committee for the approval of the Personnel Director, representing the City Manager. Certificated training for the five (5) designated police safety levels, chief, captain, lieutenant, sergeant and officer is established by the State of California Police Officer Standards Training Commission. Incentive pay increase awarded under this program will continue to - 4 - IF benefit the individual advancing in rank to and including the position POLICE CAPTAIN. Section 3. Fire Safety Employees. A fire safety Employee in the classified position FIRE CHIEF will not be eligible for pay because of this educa- tion incentive program. Eligibility for compensation shall be established quarterly from January of each year. Proof of eligibility will be the responsibility of a Fire Department Education Committee of three (3), representative of top, middle and basic levels, this committee being responsible for the initial approval of an accepted study curriculum using the criteria fire science or an associated one, recognising those prerequisite courses towards the attainment of an associate or baccalaureate degree from an accredited 4 college. It shall be the responsibility of this committee to forward the names and supportive materials to establish education incentive pay to the Personnel Director for the ultimate approval of the City Manager. Only employees who have been performing•satisfaczory work, or above, for the previous year will be eligible for education achievement compensation. All applications must be accompanied with a grade card or certified transcript or certificate of completion showing the following: a. A grade of 'C' or better, or a satis`actory rating of completion. b. Number of units or classroom hours. c. Where the course was taken. - 5 - The following schedule will be used to determine compen- sation for fire safety training or college achievement. It will be recognized that an accumulation of more than i seven (7) units per semester would interfere with the efficiency and/or health of a qualifying employee. Qualifying units or credits are not accumlated within regular scheduled working hours unless justified by a department education committee for the approval of the Personnel Director, representing the City Manager. A Fire Department Education Committee as specified will submit for the approval of the Personnel Director, representing the City Manager, a set of standards pertaining to fire safety seminars and a relative credit value as analyzed by the California Fire Chiefs' Association. Section 4. Miscellaneous Employees. All full-time positions listed in the annual salary resolution are eligible to receive education incentive pay, subject to the other provisions of this program, except City Council appointed staff members, heads of a department, and those regular employees with the - 6 - i w classification title ASSISTANT CITY ENGINEER, ASSISTANT CITY MANAGER, ASSISTANT TO THE CITY MANAGER, ASSOCIATE PLANNER, ASSISTANT TO THE PLANNING DIRECTOR, ASSISTANT TO THE FINANCE DIRECTOR, CIVIL ENGINEERING ASSOCIATE, i PRINCIPAL CIVIL ENGINEER AND RECREATION SUPERINTENDENT. All other classifications to be designated professional and specifying graduation from a four-year college or above as a standard of employment, will attain eligibility for education incentive pay at the time -rate of 4, 5-1/2, 7 and 9 years as City service applies itself to the scale for rate of additional compensation. Eligibility for education incentive program pay will be t determined quarterly from the beginning of the fiscal- " year. The employee will submit for the approval of the Education Committee, a joint Management/Employees' Association/Employee member committee of three (3), satisfactory completion of approved courses (job/municipal government related), to be supported by grade card (GPA 2.00 or above), transcript, certificate of completion or statement of instructor. Units completed prior to employment with the City of Carlsbad, or during the first two/four (2/4) years of employment, including the probationary period, shall b�- considered in determining compensation eligibility, provided all other requirements of this amendment are met. Upon compliance with qualifying standards/proof of - 7 - eligibility as set out in this amendment, persons eligible shall receive compensation according to the following schedule. Non-academic Training or Instruction: In those divisions of City government where few job oriented college units have been made available (namely, divisions of public works) the Education Committee will reduce non-academic training or instruction at the rate of 20 hours to one (1) college level unit, evaluating to the satisfaction of the chief administrator, personnel director and related department head, those seminars, workshops and lectures as apropos and credible. Thus, 20 training/instruction hours equals one (1) college unit, and education incentive pay may be received for courses of instruction or training other than college units according to the following schedule. (Base Pay shall mean the monthly salary/wages set forth for the Range and Step of an eligible person.
