Pieti Personnel Director Statement of the Matter The attached resolution and its exhibit represent the agreement between the City and the Carlsbad Firefighters Association pertaining to changes to the conditions of employment during Fiscal Year 1974-75. Council 'Action 8-20-74 Resolution No. 3492 accepting a Memorandum of understanding between Management and Firefighters was,adopted. -2- 1 2 3 4 5 6 7 a 9 1c 11 12 1: V 2( 21 2: 2; 24 2: 2t 2: 2E 25 3( 3: 3: RESOLUTION NO. 3492 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING A MEMORANDUM OF UNDERSTANDING BETWEEN REPRESENTATIVES OF MANAGEMENT AND THE CARLSBAD FIREFIGHTERS ASSOCIATION. WHEREAS, representatives of Management and the Carlsbad Firefighters Association have been conducting negotiations pursuant to the Meyers-Milias-Brown Act regarding wages and other terms and conditions of employment for the 1974-75 fiscal year; and WHEREAS, said representatives failed to reach agreement and an impasse was declared; and WHEREAS, at the City Council meeting of August 7, 1974 the City Council heard from representatives of the Firefighters Asso- ciation and received recommendations from the City Manager in regard to wages and other terms and conditions of employment and approved the City Manager's recommendation by the adoption of Resolution No. 3482 . In so doing, the Council announced its willingness to allow two weeks of further negotiations and to consider further recommendations from the City Manager on the matter if there was some progress to report; and WHEREAS, said representatives have reached agreement which they desire to submit to the City Council for approval; and WHEREAS, the City Council has determined it to be in the public interest to accept such an agreement in the form of a Memorandum of Understanding marked Exhibit A and incorporated by reference herein; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That the Memorandum of Understanding between the Carlsbad Firefighters Association and representatives of Management is hereby accepted. ........ ........... ............ ..... .. .- ......... - -. ........ That the City Council intends to implement said Memo- randum by incorporating its terms into the salary plan for fiscal year 1974-75 and the personnel rules of the City of Carlsbad and by other appropriate actions as necessary in accord with its terms. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the 20th day of August , 1974 by the following vote, to wit: AYES : Cmn. I ... ..,. . .... .- ..... .- EXHIBIT A b MEMORANDUM OF UNDERSTANDING BETWEEN MANAGEMENT REPRESENTATIVES OF THE CITY OF CARLSBAD AND THE CARLSBAD FIRE- FIGHTERS ASSOCIATION FOR FISCAL YEAR 1974-75 WHEREAS, the City of Carlsbad Firefighters Association has been negotiating as part of the meet and confer process with representatives from Management regarding wages and certain other terms and conditions of employment to be effective during fiscal year 1974-75; and WHEREAS, the parties to said negotiation have reached agreement and wish to present this Memorandum of Understand- ing incorporating all the terms of that agreement to the City Council and request that it be approved and implemented; NOW, THEREFORE, IT IS AGREED by and between the Management representatives (City) and the Carlsbad Fire- fighters Association (Association) that the following terms and conditiens of employment during fiscal year 1974-75 be submitted to the City Council: 1, PERSONNEL INCLUDED This agreement shall apply to the following employees in the Carlsbad Fire Department: A. Fire Battalion Chief B. Fire Captains C. Fire Engineers D, Firemen 2. SALARY ADJUSTMENT The City shall provide a 1.5% salary increase for all ranges and steps for all included personnel effective as of the first day of the first pay period in September, 1974. .... ... - ... - ................. .............. -. . ~~-~-- .- ...... .... ..- ........ 3. EDUCATIONAL INCENTIVE PAY ADJUSTMENT City and Association agree to an amendment to Personnel Rule XV to decrease the maximum possible compen- sation under the Education Incentive Program from 10% to 7-1/2%. The compensation schedule will be amended accord- ingly to reflect the 7-1/2% maximum on four or more years' servicz with fifty-five or more college units in accredited courses toward a BS or BA in an appropriate field. The balance of the schedule will remain the same. 4. CONTINUANCE OF TERMS All other terms and conditions of employment appli- cable to included personnel and not inconsistent with the terms of this Memorandum of.Understanding, including those contained in the City Manager's recommendations as approved !I by Resolution No. 3482 , shall remain in effect. -. - Dated this \q day of &+ , 1974.
