statement of the Matter: The Planning Commission is recommending approval of a
Subdivision Map (CT 74-7) for the reasons outlined and subject to the conditions stated in
Planning Commission Resolution 1089. The request would permit development of a one-lot Con-
dominium on a 0.785 acre site on the east side of Jerez Court approximately 400' north of
its intersection with Gibralter Street.
The applicant has met all ordinances and policies, including Public Facilities, of the City
of Carlsbad.

Staff Recommendations to City Manager:
Staff recommends that the Tentative Subdivision Map (CT 74-7) be approved for the reasons
outlined in Planning Commission Resolution #1089. If the City Council concurs with the
Planning Commission recommendation, the Council should direct the City Attorney to prepare
the necessary documents as stated in Planning Commission Resolution #1089.

RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, CONCERNING THE
TENTATIVE MAP RECOMMENDING APPROVAL OF A ONE
LOT CONDOMINIUM TENTATIVE MAP ON A 0.785 ACRE
SITE DESCRIBED AS LOTS 368 and 369, LA COSTA
SOUTH UNIT NO. 5 AT 2348 LA COSTA AVENUE.
CASE NO. CT 74-7, APPLICANT: BARRIE F. CHASE
WHEREAS, a verified application for a certain property, to wit:
Lots 368 and 369 of La Costa South Unit No. 5 according
to Map No. 6600 in the City of Carlsbad, County of San
Diego, State of California.
has been filed with the City of Carlsbad and referred to the Planning Commission;
and
WHEREAS, said verified application constitutes a request as provided by
Title 21 of the "Carlsbad Municipal Code"; and
WHEREAS, the public hearing was held at the time and in the place specified
in said notice on August 13, 1974.
WHEREAS, the applicant has complied with the Public Facility Policy of the
City of Carlsbad and has provided the necessary information which insures Public
Facilities will be available and current with need; and
WHEREAS, the subject application has complied with the req uirements of the
City of Carlsbad "Environmental Protection Ordinance of 1972"; and the Project
was declared non-significant according to the requirements of the Carlsbad
Environmental Protection and CEQA. Justification for the finding is that the
project is small, on a manufactured lot, and is similar to existing development
that area.
WHEREAS, at said public hearing, upon hearing and considering the testimony
and arguments, if any, of all persons who desired to be heard, said Commission
considered all factors relating to the Tentative Map and found the following
facts and reasons to exist:
(1) Conformance to the State of California Subdivision Map Act.
(2) Compliance to the Carlsbad Municipal Code requirements, including
the Parks and Environmental Protection Ordinances.
(3) Conformance to the adopted La Costa Master Plan
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City

of Carlsbad, California, as follows: That a Tentative Map is approved for use
of said property to allow a one-lot Condominium on a 0.785 acre site described
as lots 368 and 369, La Costa South Unit Mo. 5, to build 22 units and subject
to the following conditions:
(1) The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all the requirements, limitations and restrictions of all
municipal ordinances and State and Federal statutes now in force,
or which, hereafter, may be in force for the purpose of preserving the
residential characteristics of adjacent properties.
(2) The C.C. & R.'s for this development shall be submitted to the Planning
Director for review and approval prior to the issuance of any building
permits.
(3) Park-in-lieu fees shall be granted to the City prior to City Council
approval of the final map.
(4) In order to provide for reasonable fire protection during the con- • .
struction period, the subdivider shall maintain passable vehicular
access to all buildings and adequate fire hydrants with required
fire flows shall be installed as recommended by the Fire Department.
(5) All public improvements shall be made in conformity to the City of
Carlsbad Engineering Design Criteria and Standard Plans, the Sub-
division Ordinance and other City Standards, to the satisfaction of
the City Engineer, without cost to the City of C rlsbad, and free of
all liens and encumbrances. Improvement plans for water and sewer
systems shall meet the requirements of the respective service districts
(6) All drainage and grading plans shall be submitted to the City Engineer
for consideration and approval.
(7) All utilities, including provisions for cable TV, shall be placed
underground and/or shall be completely concealed from view.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Carlsbad

*• REQUEST: The applicant is requesting approval of a one lot
Condominium Tentative Map on a 0.785 acre site described as
lots 368 and 369, La Costa South Unit No. 5. The applicant
is proposing to build 22 units.
II. RECOMMENDATION: Staff recommends APPROVAL of CT 74-7 as
shown on Exhibit A dated May 3, 1974, based on the following

B. Location; On the east side of Jerez Court, approximately
400 feet north of its intersection with Gibralter Street.

D. E.I.R. Finding: The project was declared non-significant
according to the requirements of the Carlsbad Environmental
Protection and CEQA. Justification for the finding is that
the project is small, on a manufactured lot, and is similar
to existing development in that area.

G. General Plan; The existing General Plan shows the subject
property as RD-M density at a maximum density of 43 DU/acre.
The proposed Land Use Element shows the property as residen-
tial high density at 16-24 DU/acre. The applicant proposes
a density of 28 DU/acre.
H. Parks Ordinance: The Carlsbad Parks Ordinance requires
payment of in-lieu fees for all subdivisions which are less
than 50 units. Accordingly, the applicant will be required
to pay in-lieu fees at the time of final map recordation.
I. Public Facilities Policy: The applicant has complied with
the City's Public Facility Policy. A copy of letters from
the affected school districts has been attached.
