The committee's function and purpose would be similar to the existing Special Districts Advisory Committee. LAFCO has approved the concept in principle and referred the matter to each of the thirteen City Councils for consideration and endorsement. An Ad Hoc Committee of the City Managers Association has prepared a draft set of By-Laws to define the role and purpose of such an Advisory Committee. Date: September 3, 1974 City Manager's Recommendation The statement of the matter and the proposed By-Laws are self-explanatory. Under Section 11, Statement of Purpose, it should be pointed.out that none of the,purposes of the Advisory Committee represent an expansi'on of the existing role of LAFCO, but are all provided for as responsibilities of LAFCO under existing law. It is recommended that Council endorse the proposal, referring the matter back to staff and LAFCO for implementation. Council Action 9-3-74 A motion was made that the Council endorse the'proposal, and that the matter be referred back to the staff and LAFCO for imp1 ementa t ion. . -2- The Local Agency Formation Commission Cities Advisory Committee BYLAWS Section I: Authorization for Formation Local Agency Formation Cominission "Resolution approving the report and recommendation of the City-County Xanagement Association regarding the adoption of rules and reg'ulations providing for the functions of a Cities Advisory Cormnittee as regards its role under the Local Agency Formation Commission" dated Section 11: Statement of Purpose Recognizing the diversity of municipal services provided. by the cities in San Diego County, the variety of types and levels of services provided by each, and the potential for incorporation of new cities, there is a need for ?olicy and technical advice fron existing cities to assist the Local Agency Formation Commission. More specifically,?the purposes of the Cities Advisory Conmiittee include: 1. Advise LAFCO on the general operational problems faced by cities in San Diego County; 2. to LMCO consideration with respect to their economic feasibility and adequacy, potential jurisdictional conflicts with other agencies, and effect upon the general structure of local Review and give advice on specific city proposals prior government within the County; -2- 3. of spheres-of-influence boundaries; 4. Identify potential jurisdictional conflicts between cities and between cities and other agencies and provide assistance in resolving those conflicts; 5. Assist cities in preparing and submitting proposed changes in organization to LAFCO; 6. Promote and assist LAFCO in promoting higher levels of intergovernmental cooperation and coordination; 7. Review, study and recommend changes in city annexation, detachment, and incorporation statutes; 8. Provide technical assistance to LAFCO in analyzing Review and give advice on the adoption or amendment city incorporation proposals. Section 111. Principal Office The princisal office for the transaction of the business of the Committee is located in the office of the Local Agency Formation Coinmission in the San Diego County Administration Center at 1600 Pacific Highway, San Diego, California 92101. Section IV: Membershb The Cities Advisory Committee shall have a membership equal to the number of incorporated cities in the County of San Diego. There shall be a primary representative from each city who shall be a legislator of that city. The primary representative of each city shall be allowed an alternate who will be the City Manager of that city, or his staff alternate. -3- Section V. Voting Each voting Committee member (the primary representative or his alternate) shall be entitled to a single vote. Approval of any proposal requires an affirmative vote from a simple majority of the total voting representatives of record. Section VI: Meetings of Members - Regular meetings of the Cities Advisory Committee shall be scheduled at least ten (10) days prior to the regularly scheduled meetings of the San Diego County Local Agency Formation Commission. Special meetings of members may be called at any time by the Chairman or by three (3) or more of the Committee members. Notice of such special meetings shall be mailed or telephoned to each member at least forty-eight (48) hours before the time set for said meeting, Section VIII: Place of Meetings Meetings of the Committee shall be held at a place designated by the Chairman. Section VIII: Quorum The presence of a majority of the member cities represented shall constitute a quorum for the transaction of business at any regularly scheduled or special meeting of the Committee. Section IX: Selection Procedure Every city will choose its legislative representative by whatever method it may deem appropriate. ., '. . . '- * -4- Section X: Committee Officers - Number and Selection The officers of the Committee shall be Chairman, Vice-chairman and Secretary. The Committee may create and appoint such additional officers as may be necessary to carry out the work of the Committee. The officers of the Committee shall be chosen annually by the Conunittee and eacn shall hcld his office until he shall resign or shall be removed or otherwise disqualified to serve, or until his successor shall be elected or appointed and qualified. shall serve for a term of one (1) year, provided that any officer may be re-elected to succeed himself for one (1) additional term only . Each above named officer The Cities Advisory Committee may appoint such other officers as the business of the Committee may require, each of whom shall hold office for such period and have such authority and perform such duties as are provided in'the Bylaws or as the Committee may from time to time determine. Section XI: Committee Officers - Duties of the Vice-chairman In the absence or disqualification of the Chairinan, the Vice-chairman shall perform all of the duties of the Chairman; he shall preside as the Chairman of all .subcommittees, and report to the Chairman of the Comiiittee on the success or failure of a subcommittee's activities. -5- Section XII: Committee.Officers - Duties of the Secretary The Secretary shall keep or cause to be kept at the principal office of the Committee or such other place as the members may order a book of minutes of all meetings of the Committee. The Secretary shall give the notices of regular and special meetings of the Committee. Section XIII: Subcommittees The Cities Advisory Committee may create such Subcommittees as the business of the Committee may require, each of which shall exist fgr such period and have such authority and perform such duties as are provided in the Bylaws or as the Committee may from time to time determine. Section XIV:. Amendment of Bylaws These Bylaws may be amended by a majority vote of the Committee at any regular or special meeting. . .... : d. ; !
