«
The City Council at your meeting of September 3, 1974, directed the City
Attorney to prepare the necessary documents adopting Specific Plan (SP-159)
and approving Tentative Map (CT 74-11) . The ordinance adopting the
Specific Plan and the resolution approving the Tentative -Map are attached.

ORDINANCE NO. 9405
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, ADOPTING A
SPECIFIC PLAN (SP-159) FOR 48 CONDOMINIUM
UNITS ON 4.44 ACRES IN LA COSTA VALE UNIT
NO. 2. APPLICANT: HAROLD O'BRIEN
The City Council of the City of Carlsbad, California,
does ordain as follows:
SECTION 1; A Specific Plan (SP-159) is hereby adopted
for approximately 4.44 acres of land in La Costa Vale Unit No. 2,
more particularly described as:
Lots 261 and 262, La Costa Vale No. 2, in the City of
Carlsbad, County of San Diego, State of California,
according to Map No. 7779 filed in the office of the
County Recorder of San Diego County,
said plan to consist of a plot plan marked Exhibit A Alternate to
SP-159 dated August 13, 1974, and an application with attachments
on file in the office of the City Planning Department and incor-
porated by reference herein, subject to all terms and conditions
of this ordinance.
SECTION 2; Findings. The approval of Specific Plan (SP-
159) is justified by the following findings:
A. The project meets all applicable requirements of the
Municipal Code.
B. The project conforms to the adopted General Plan.
SECTION 3: Development Conditions. The Specific Plan
(SP-159) is approved subject to the following conditions and re-
strictions and the development of the property, as described in
Section 1 hereof, shall be subject to all such conditions and
restrictions which are in addition to all requirements, limitations
and restrictions of all municipal ordinances and state and federal
laws now in force or which may hereafter be in force:
1. The approval is granted for the land described in
the application and any attachments thereto, and as shown
on the plot plan submitted labeled Exhibit A Alternate-
dated August 13, 1974. The location of all buildings,
fences, signs, roadways, parking areas, landscaping and

other facilities or features shall be located substantially
as shown on the plot plan labeled Exhibit A Alternate,
except or unless indicated otherwise herein.
2. Any minor change may be approved by the Planning
Director. Any substantial change will require the filing
of an application for an amendment to be considered by the
Planning Commission.
3. All requirements of any law, ordinance or regula-
tion of the State of California, City of Carlsbad and any
other governmental entity shall be complied with.
4. All areas shown as parking areas shall be surfaced
with asphaltic concrete and shall be visibly marked out-
lining individual parking spaces and traffic flow. Said
surfacing and marking shall be compensated prior to final
inspection of the structure or structures by the Building
Department. The surface shall be kept in a reasonably
good state of repair at all times.
5. Prior to obtaining a building permit and within
30 days hereof, the applicant shall file with the Secretary
of the Planning Commission written acceptance of the condi-
tions stated herein.
6. A detailed landscape and sprinkler plan prepared
by a landscape architect shall be submitted to the Planning
Director for consideration and approval.
7. A circular drive will be allowed providing it is
stamped, colored concrete, as indicated on Exhibit A
Alternate dated August 13, 1974.
SECTION 4; Administration and Enforcement. The Building
Department shall not approve any building for occupancy until the
Planning Director has certified that all the conditions of this
ordinance have been satisfied.
EFFECTIVE DATE; This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal within fifteen days after its adoptior

Carlsbad City Council held on the T7th day of September , 1974,
and thereafter

RESOLUTION NO. 3509
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
WITH CONDITIONS TENTATIVE SUBDIVISION MAP
(CT 74-11) FOR 48 CONDOMINIUM UNITS ON
4.44 ACRES IN LA COSTA VALE UNIT NO. 2
APPLICANT: HAROLD O'BRIEN
WHEREAS, on the 13th day of August, 1974, the Carlsbad
City Planning Commission adopted Resolution No. 1086 recommending
to the City Council that Tentative Map (CT 74-11) be conditionally
approved; and
WHEREAS, the City Council of the City of Carlsbad, on the
3rd day of September , 1974, considered the recommendation of
the Planning Commission; and
WHEREAS, said Tentative Map has been declared to have a
nonsignificant impact on the environment and a Negative Declara-
tion has been prepared and filed in compliance with the require-
ments of the City of Carlsbad Environmental Protection Ordinance
of 1972;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. The development of the property described herein
shall be subject to the restriction and limitations set
forth herein which are in addition to all the require-
ments, limitations and restrictions of all municipal
ordinances and state and federal statutes now in force,
or which hereafter may be in force for the purpose of
preserving the residential characteristics of adjacent
properties.
2. The CC&R's for this development shall be submitted
to the Planning Director for review and approval prior to
the issuance of any building permits.
3. In order to provide for reasonable fire protection
during the construction period, the subdivider shall main-
tain passable vehicular access to all buildings and
adequate fire hydrants with required fire flows shall be
installed as recommended by the Fire Department.
4. All public improvements shall be made in conformity
with the City of Carlsbad Engineering Design Criteria and
Standard Plans, the Subdivision Ordinance and other City
standards to the satisfaction of the City Engineer without
cost to the City of Carlsbad and free of all liens and
encumbrances.

5. All utilities, including provisions for cable TV,
shall be placed underground and/or shall be completely
concealed from view.
6. The improvement plans shall include a report of a
geological investigation and a complete grading plan of
the entire site when required by the City Engineer. The
report and plan shall be prepared by civil engineersv
licensed by the State of California and experienced in
erosion control who shall be acceptable to the City
Engineer, and they shall certify that they have investi-
gated the site and prepared data with full consideration
of the consequences to the included and neighbouring prop-
erties and conform to the standards of the Geological
Safety Element of the General Plan.
7. The existing 10-foot sewer easement shall be
abandoned and new sewer arrangements shall be made as
required by the Leucadia County Water District.
C. That said Tentative Map, together with the provisions
for its design and improvement and subject to the above condi-
tions, is consistent with all applicable general and specific
plans of the City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 17th day of September , 1974,
by the following vote, to wit:
AYES: Councilmen Chase, McComas, Lewis and Skotnicki
NOES: None
ABSENT: Councilman Frazee
