CT 73-12 APPLICANT: ' D.R. Gray Construction Corp. WHEREAS, a verified application for a certain property, to wit: Lots 370, 371, 372 aid 373 of La Costa South, Unit No. 5, per map no, 6600, City of Carlsbad, San Diego County, State of California. has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the "Carlsbad Municipal Code"; and WHEREAS, the public hearing was held at the time and in the place specified in said notice on August 27, 1974; and WHEREAS, the applicant has complied with the Public Facility Policy of the City of Carlsbad and has provided the necessary information which insures Public Facilities will be available and current with need; and WHEREAS, the subject application has complied with the re- quirements of the City of Carlsbad "Environmental Protection Ordinance of 1972" an Environmental Impact Assessment was filed for the same project and was declared non-significant according to the Carlsbad Environmental Protection Ordinance and CEQA require- ments on April 12, 1973. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Carlsbad, California, as follows: That a tentative map is approved for use of said property to allow development of a 24 Unit Condominium project on 1.6 acres located on the north side of Jerez Court between Gibralter Street and the westerly terminus of Jerez Court and subject to the following conditions: \ (1) All improvements shall be in conformance with the City of Carlsbad Design Criteria and Standards. (2) Improvement plans for water and sewer systems shall meet the requirements of the respective service districts providing services. (3) All on-site fire protection appurtenances shall be constructed in accordance with fire department standards and requirements. (4) Park-in-lieu fees shall be granted to the City prior to recording of the final map. (5) The development shall meet all requirements of the Department of Public Health. (6) All utilities, including provisions for cable TV shall be placed underground. Council'Action 9_17-74 The tentative map was approved and the staff instructed to _ prepare the documents. REQUEST: The applicant is requesting approval of a one lot subdivision to allow the development of a 24 unit condominium project on 1.6 acres located on the north side of Jerez Court between Gibralter Street and the westerly terminus of Jerez Court. II. RECOMMENDATION: Staff recommends CT 73-12 be APPROVED for the following reasons: 1) Conformance to the adopted General Plan. 2) Compliance to the Subdivision Map Act. III. ENVIRONMENTAL IMPACT INFORMATION: The project has complied with the requirements of the "City of Carlsbad Environmental Protection Ordinance" and was declared to have a non-signi- ficant impact on the environment when originally proposed. The present project is the same as that originally proposed. Therefore, the project is categorically exempt by reasons of prior compliance. IV. PUBLIC FACILITIES POLICY: The applicant has submitted the necessary evidence that public facilities will be available to serve the project. V. PARKS ORDINANCE REQUIREMENT: The Carlsbad Parks Ordinance requires payment of in-lieu fees for all subdivisions with less than 50 units. This project will be assessed fees prior to recordation of the final map. VI. BACKGROUND; The subject application was originally approved by the City Council on June 5, 1973. In July 1973, the City Council approved a Specific Plan on a 1.2 acre piece adjacent to the subject property which would be added to the project for open space and recreational purposes. The tentative map was revised in September, 1973 to include the open space in the subdivision. The present request is to delete the 1.2 acre open space portion of the project, making it the same as the original approval (City Council Resolution No. 3139), because the applicant could not obtain clear title to the 1.2 acre parcel so that it could be included in the proposed tentative map. VII.ZONING AND GENERAL PLAN: A. Zoning: Existing: RD-M North: P-C and RD-M East: P-C South: RD-M West: RD-M B. General Plan: The adopted La Costa Master Plan shows the property as Residential Medium High Density at 0-43 DU/acre. The proposed Land Use Element shows a maximum density of 16-24 DU/acre. The applicant proposes a "density of 15 DU/ acre.
