j\/s t'J,::: j , Capital (Hughes) on March 20, 1973. The Specific P7an, City Council
Resolution #3087, required that the applicant install one-half of a public
street along the project's southerly boundary and to participate in a fully
activated traffic signal at the intersecti-on of El Camino Real in-the proposed
driveway at the southerly property line.
The Tentative Map submitted by Cabot, Cabot & Forbes for the Industrial Park
west of Systems Capital site, provides circulation satisfying requirements
of the Systems Capital project. Therefore, conditions 1 and ,2 requiring
the traffic signal and the pub'lic street are no longer required.
Therefore the staff is recommending deletion of conditions 1 and 2 from City
Council Resolution 3087 per Planning Commission. Resolution #lo96 recommending
.that the City Council delete said conditions. . .

REQUEST FOR AFlEND?lE!lT TO CITY COUNCIL RESOLUTION
#3087 DELETING DEVELOPrlEFfT CONDITIONS fl AND $2.
CASE N?. SP-109, APPLICANT: SYSTEMS CAPITAL
WHEREAS, a verified application for a certain propert.y, to-wit:
All that portion of Lot "G" of Ranch0 Aqua Hedionda in *.
the County of San Diego, State of California, according
to Map thereof No. 823 filed in the Office of the County
Recorder of said County;
has been filed with the City of Carlsbad and referred to the Planning -
Commission; and.
IdHEREAS, said verified application constitutes a request as provided by
Title 21 of the “Carlsbad Mnicipal Code"; and
!JHEREAS, the public hearing was held at the time and in the place
specified in said notice on September 24, 1974; and .
WHEREAS, the applicant has complied with the Public Facility Policy of
the City of GarJsbad and has provided the necessary information which insures
Public Facilities will be available and current with need; and
WHEREAS, the subject application has complied with the requirements of
the City of CarJsbad "Environmental Protection Ordinance of 1972"; and
WHEREAS, at said public hearing, upon hearing and considering the
testimony and arguments, if any, of all persons who desired to be heard, said
Commission considered all factors relating to the Specific Plan and found the
following facts and reasons to exist:
1. The initial reauirement was to provide a signalized access to propert;
to the west, which wjll now be met by the Cabot, Cabot and Forbes
subdivision through the street from El Camino Real to Palomar Air-
port Road.
2. The cul-de-sac Street "C" will provide access to the rear portion
of the Hughes -property.
3. The property owners (Huahes and Cabot, Cabot and Forbes) have met
with the City and a.re aqreeable to the modification.
4. The road and traffic siqnal are not necessary for general traffic
circulation.

NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of the
City of Carlsbad, California, as follows: That an amendment to City Council
Resolution #3057 which would delete development conditions #l and f2 is
approved. Development conditions #l and 52 to be deleted read as follows:
1. The applicant shall participate in the installation of a fully<
actuated traffic signal at El Camino Real for the proposed 40 foot
driveway along the southerly property line.. Such participation
shall be based on the proportionate share of the 'Marrant traffic (as
defined in Section 9 of the California State Division of Highways
traffic manual) on the southerly road, generated by the applicant.
Applicant shall be reimbursed for the additional proport'+onate share
of traffic generated by future development bordering the southerly
street as may be a!rthorized by law.
2. The 4-O foot driveway shall ultimately be built to City street
standards and the southerly 50 feet of the property shall be offered
for dedication to the City by the developer.

Carlsbad Planning Commission held on September 24, 1974 by the following vote,

RESOLUTION NO. 3087 .
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ANNOUNCING FINDINGS AND
DECISION REGARDING SPECIFIC PLAN FOR PROPERTY
LOCATED ON 50.2 ACRES SOUTH OF PALOMAR AIRPORT
ROAD AND WEST OF EL CAMINO REAL, TO BE DEVELOPED
AS A MANUFACTURING FACILITY PROJECT KNOWN AS
SYSTEMS CAPITAL CORPQRATTOU .
WHEREAS, on February 27, 1973 the Planning Commission of
the City of Carlsbad held a duly noticed public hearing to con-
sider the adoption of a specific plan on property located on
50.2 acres South of Palomar Airport Road and West of El Camino
Real to be developed as a manufacturing facility project known as
SYSTEMS CAPITAL CORPORATION and more particularly described .,
below; and
WHEREAS, on the 27th day of February, 1973, the Carlsbad
Planning Commission adopted Resolution No- 836, which is incor-
porated by reference herein, recommending adoption of said plan;
and
WHEREAS, on March 20, 1973, a duly advertised public hearin!
was held before the City Council in the manner prescribed by law
:
to consider said plan for property described as:
All that portion of Lot "G" of Ranch0 Agua
Hedionda in the County of San Diego, State
of California, according to Map thereof No. 82-3
filed in the Office of the County Recorder of
said County;
and,
WHEREAS, the City Council received all recommendations and
heard all persons interested in or opposed to the proposed
Specific Plan at said hearing; and
WHEREAS, the requirements of the "City of Carlsbad Environ-
mental Protection Ordinance of J972” in that the applicant has
submitted the environmental impact report to the County of San
Diego. The City of Carlsbad has accepted the information sub-
mitted by the County of San Diego as the Lead Agency.

THEREFORE, the'city Counci 1 of the City of Carlsbad
DOES HEREBY RESOLVE that the findings of the Planning Commission
Reso ution No. 836 constitutes the findings of the Carlsbad City
Council.
BE IT FURTHER RESOLVED that the City Council certifies\ that
the approval of the proposed Specific Plan is necessary to carry
out

BE IT FURTHER RESOLVED that the Specific Plan is hereby
approved and adopted subject to the conditions listed ih the

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING A SPECIFIC PLAN FOR PROPERTY LOCATED SOUTH OF PALOMAR AIRPORT ROAD AND WEST OF EL CAMINO REAL BY THE AMENDMENT OF RESOLUTION NO. 3087 TO DELETE CONDITIONS NOS. 1 AND 2 OF PLANNING COMMISSION RESOLUTION NO. 836 REGARDING A TRAFFIC SIGNAL AND ACCESS ROAD. CASE NO. SP-109; APPLICANT: SYSTEMS CAPITAL CORPORATION'
WHEREAS, the City Council by Resolution No. 3087 approved
a specific plan (SP-109) for approximately 50 acres of property
generally located south of Palomar Airport Road and west of El
Camino Real, said resolution incorporating by reference the condi-
tions of approval contained in Planning Commission Resolution
No. 836; and
WHEREAS, the Planning Commission by Resolution No. 1096
has recommended that the specific plan be amended by the deletion
of conditions Nos. 1 and 2 of Planning Commission Resolution
No. 836;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the findings of Planning Commission Resolution
No. 1096 constitute the findings of the City Council.
3. That Specific Plan (SP-log), Systems Capital Corpora-
tion, is hereby amended by amending Resolution No. 3087 to delete
conditions Nos. 1 and 2 of Planning Commission Resolution No. 836.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 15th day of October , 1974,
by the following vote, to wit:
