The City Council approved a Specific Plan for 20 unit apartment cfcmplex in May, 1973. It was the applicant's intention at that time to build a condominium development, however, a tentative subdivision map was not filed. The units have been constructed and are 95% complete. The Specific Plan 101 required all necessary public improvements. Additionally the applicant has met all ordinances and policies including public facilities for the City of Carlsbad. If the City Council concurs with the Planning Commission recommendation, the Council should direct the City Attorney to prepare the necessary documents as stated in P.C. Resolution #1098. Council'Action 10-15-74 The staff recommendations were accepted for approval of the tentative map of Carlsbad Tract 74-20; the staff was instructed to review the conditions of Planning Commission Resolution #1098 to make sure that the conditions of all the ordinances and policies of the City are being met; and the City Attorney was. instructed to prepare the documents necessary for approval of the tentati ve map. -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 v.' _.!- 32 PLANNING COMMISSION RESOLUTION NO. 1098 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING THE TENTATIVE MAP, CONSISTING OF ONE LOT, TO PERMIT THE DEVELOP- MENT OF 20 CONDOMINIUM UNITS IN A R-3 ZONE DISTRICT LOCATED ON THE WEST SIDE OF HARRISON STREET, APPROXI- MATELY 250 FEET SOUTH OF CHINQUAPIN AVENUE. CASE NO. CT 74-20, APPLICANT: HARRISON LAGOON WHEREAS, a verified application for a certain property, to wit: Parcel 1 in the City of Carlsbad, County of San Diego, State of California, as shown on page 2484 of Parcel Maps, filed in the office of the County Recorder of San Diego County; has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the "Carlsbad Municipal Code"; and WHEREAS, the applicant has complied with the Public Facility Policy of the City of Carlsbad and has provided the necessary information which insures Public Facilities will be available and current with need; and WHEREAS, the subject application has complied with the requirements of the City of Carlsbad "Environmental Protection Ordinance of 1972"; and WHEREAS, said Commission considered all factors relating to the Tentative Map and found the following facts and reasons to exist: 1. The requested use conforms to the adopted General Plan. 2. The requested use complies to all City Ordinances and Policies. 3. The requested use complies with the Subdivision Map Act. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Carlsbad, California, as follows: That a Tentative Map is approved for use of said property to allow the development of 20 condominium units in a R-3 Zone District located on the west side of Harrison Street, approximately 250 feet south of Chinquapin Avenue, and subject to the following conditions: 1. All public improvements shall be made in conformity with the Sub- division Ordinance, and other City standards, to the satisfaction of the City Engineer, without cost to the City of Carlsbad, and free of all liens and encumbrances. 2. The project shall be constructed with the density shown on the Specific Plan, and shall be constructed in no less a manner than shown on the exhibits labeled "A" and "B". 4. Final elevation and plot plans shall be reviewed by the Director of Planning to ensure conformity with the intent of this Specific Plan. 5. The off-street parking facilities shall be constructed in accordance with Chapter 21.44 of the Carlsbad Municipal Code. 6. Side and rear yards shall be fenced with a six foot high solid fence or equal, in compatible materials with those used in the main structure. 7. Exterior lighting shall be provided in the off-street parking areas, and shall be shielded so as not to shine or glare on adjacent properties. 8. A parcel map shall be prepared, filed with the City of Carlsbad and recorded prior to the issuance of any building permit whatsoever. 9. A strip of land ten (10) feet wide shall be granted to the City for street purposes along Harrison Street. 10. Full subdivision improvements shall be constructed to include the undergrounding of all utilities. 11. An approved fire hydrant shall be installed on the west side of Harrison Street, at the intersection of Locust Avenue, type and installation to the satisfaction of the Fire Chief. 12. On-site fire protection appurtenances shall be constructed in accordance with Fire Department requirements to the satisfaction of the Fire Chief. Said fire protection appurtenances shall be installed and functioning prior to framing construction. 13. All building shall be connected to the facilities of the City of Carlsbad Water Department. 14. All buildings shall be connected to the City of Carlsbad Public Sewer System. 15. The proposed design of the swimming pool and Jacuzzi shall be revised to the satisfaction of the City's Health Officer. 16. A landscape plan shall be submitted to, and approved by, the Director of Planning prior to the issuance of a building permit. Landscape Plan shall include provisions for a landscape screen adjacent to the 1-5 freeway right-of-way. 17. Provisions will be made for Cable Television. 18. Agatep, Secretary V ~" «J"~ CITY OF CARLSBAD PLANNING DEPARTMENT STAFF REPORT September 24, 1974 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: CONSIDERATION OF A TENTATIVE SUBDIVISION MAP CASE NO: CT 74-20 APPLICANT: HARRISON LAGOON, A Partnership 7860 Mission Center Court San Diego, California 92108 *• REQUEST: The applicant is requesting approval of a tentative sub- division map, consisting of one lot, to permit the development of 20 condominium units in a R-3 Zone District. The subject property is located on the west side of Harrison Street, approximately 250 feet south of Chinquapin Avenue. II. STAFF RECOMMENDATION: Staff recommends APPROVAL of CT 74-20, based on the following justification: 1. Conformance to the adopted General Plan. 2. Compliance to all City Ordinances and Policies. 3. Compliance with the Subdivision Map Act. III. RECOMMENDED CONDITIONS OF APPROVAL: 1. Prior to the granting of final occupancy, all conditions of City Council Resolution No. 3118 shall be met. IV. BACKGROUND: On May 1, 1973, the City Council adopted Resolution No. 3118, approving a Specific Plan (SP-101) for a 20-unit apartment complex. Since the subject property consisted of two legal lots, a parcel map was required to consolidate the two lots into one. Through this requirement, all necessary dedications and improvement agreements have been made. Also, park-in-lieu fees have been paid. The applicant has always intended that this be a condominium project V. ENVIRONMENTAL IMPACT INFORMATION: This project has complied with the requirements of the City of Carlsbad Environmental Protection Ordinance and was declared to have a "non-significant" impact on the environment when originally proposed. The proposed project is the same as that originally approved. Therefore, this project is categorically exempt by reason of prior compliance. VI. PUBLIC FACILITIES POLICY: The applicant has submitted the necessary evidence that public facilities will be available to serve the project. A copy of a letter from the Carlsbad Unified School District has been attached. VII. ZONING AND GENERAL PLAN: A. ZONING: Subject Property: R-3 (SP) North: R-l East: R-l South: R-l West: Interstate 5 B. GENERAL PLAN: The adopted General Plan designates this area as "Medium Density" Residential (22-47 d.u.'s per net acre). The project consists of 20 d.u.'s on .88 acres or 22.7 d.u.'s per net acre. The proposed General Plan designates this area as "Medium-High Density" Residential (10-20 d.u.'s per gross acre).
