V. The request will permit development of 464 dwelling uni-ts on 232 lots. The subject parcel is a 75 acre parcel zoned RD-M. The proposed development contemplates duplex/garden Home family residences. The proposed site is located easterly of Lagoon Lane and Southerly of the proposed Camino de las Ondas. The applicant has met all ordinances and policies including Public Facilities, of the'City of Carlsbad. It must be noted that the proposed sewer service for this project will be provided by the City. San Diego, CA 92111 UEST: The applicant is requesting approval of a 232 lot division on a 75 acre parcel of land zoned RD-M, located the south side of Camino de las Ondas and east of Lagoon e. REQUEST: ,„= subdivision on on t1" —"u ~ Lane This property is described as: The westerly % of the northeasterly % sec. 28, T 12.S R4W, SBB & M, excepting the northerly 871 feet of the westerly 150 feet and also excepting therefrom any portion of Spinnaker Hills, CT 73-39. II. RECOMMENDATION: Staff recommends approval of CT 74-16, based on the following justification: 1) Conformance to the Carlsbad General Plan. 2) Compliance with requirements of the subdivision map act. Recommended Conditions of Approval: 1) The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations and restrictions of all municipal ordinance and State and Federal statutes now in force, or which, hereafter, may be in force for the purpose of preserving the residential characteristics of adjacent properties. 2) The C.C. & R's for this development shall be submitted to the Planning Director for review and approval prior to the issuance of any building permits. 3) Park-In-Lieu fees and/or park land dedication, bonds, fees, deposits shall be granted to the City prior to City Council approval of the final map. 4) In order to provide for reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings and adequate fire hydrants with required fire flows shall be installed as recommended by the Fire Department. 5) All utilities, including provisions for cable TV, shall be placed underground and/or shall be completely concealed from view. 6) Ornamental street lighting shall be provided for as required by Municipal Ordinance Code. The Developer shall post a bond and/or cash in the amount necessary to energize said street lights for an eighteen month period after construction, to permit the incorporation of the sub- division into a maintenance district. 7) All land and/or easements required by this Ordinance shall be granted to the City of Carlsbad without cost to the City and free of all liens and encumbrances. No easements shall be recorded prior to recordation of the final map unless approved by the City Engineer. 8) The improvement plans shall include a report of a geological investigation and a complete grading plan of the entire site when required by the City Engineer. The report and plan shall be prepared by Civil Engineers licensed by the State of California, and experienced in erosion control. Said Engineer shall certify that they have investigated the site and prepared data with full consideration of the consequences to the included and neighboring properties and conform to the standards of the Geological Safety Element of the General Plan. 9) Construction of the project shall be generally phased as follows: UNIT NO. ENVIRONMENTAL IMPACT CONSIDERATIONS: An EIR was accepted by the City Council for the entire Rancho La Costa (Ayres) Master Plan, including the subject property. The applicant has provided supplemental information which staff believes is adequate in discussing the environmental effects associated with the present subdivision proposal. IV. PUBLIC FACILITIES POLICY: The applicant has supplied evidence that adequate public facilities will ba available to serve the project. A School District V. BACKGROUND A. Zoni ng: copy of a letter from has been attached. the Carlsbad Unified Subject property - RD-M North - P-C and County E-l-A South - R-l-7500 East - County E-l-A and A-l-8 West - P-C General Plan: The existing Land Use segment of the General Plan was amended with the Ayres Master Plan to show the subject property as RD-M at 8 dwelling units per acre. The proposed Land Use Element shows the property as residential medium density at 4-10 dwelling units per acre. The applicant proposes a density of 6.8 DU/acre. C. Parks Ordinance Requirements: The General Plan shows a park corridor adjacent to the subject property on its westerly boundary. The Parks and Recreation Department has determined that park land dedication is not necessary for the subject property. Accordingly, the applicant will be assessed in- lieu fees. D. Circulation: Poinsettia Lane, which is proposed to be a secondary arterial, is shown on the tentative map as a j!04' curb to curb section. All lots will be oriented iaway from Poinsettia Lane and shall front on 40' curb ito curb residential streets. Lots will be similarly oriented away from Lagoon Lane and Camino de las Ondas. ii ;The City has agreed that the residential streets shall iabutt City Park property at two locations to the west. Therefore street access can be provided to the park. VI. INCIDENTAL INFORMATION A. Project Description: The applicant is proposing construction of 460 duplex units and 2 recreational lots on the 75 acre site. Exact bedroom counts or description of the units is not available at this time, but the applicant has indicated that the ownership is expected to be primarily families. CASE NO. 74-16, APPLICANT: STANDARD PACIFIC OF SAN DIEGO WHEREAS, a verified application for a certain property, to wit: The westerly 1/2 of the northeasterly 1/4 sec. 28, T 12.S R4W, SBB & M, excepting the northerly 871 feet of the westerly 150 feet and also excepting therefrom any portion of Spinnaker Hills, CT 73-39; has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the "Carlsbad Municipal Code"; and WHEREAS, the applicant has complied with the Public Facility Policy of the City of Carlsbad and has provided the necessary information which insures Public Facilities will be available and current with need; and WHEREAS, the subject application has complied with the requirements of the City of Carlsbad "Environmental Protection Ordinance of 1972"; and WHEREAS, said Commission considered all factors relating to the Tentative Map and found the following facts and reasons to exist: 1. All public improvements shall be made in conformity to the City of Carlsbad Engineering Design Criteria and Standard Plans, the Sub- division Ordinance and other City Standards, to the satisfaction of the City Engineer, without cost to the City of Carlsbad, and free of all liens and encumbrances. Improvement plans for water and sewer systems shall meet the requirements of the respective service districts. All land and/or easements required by this Ordinance shall be granted to the City of Carlsbad without cost to the City and free of all liens and encumbrances. No easements shall be recorded prior to recordation of the Final Map unless approved by the City Engineer. All utilities, including provisions for cable TV, shall be placed underground and/or shall be completely concealed from view. This shall be noted on the Final Map. Ornamental street lighting shall be provided for as required by Municipal Ordinance Code. Dedication shall be made prior to approval of Final Map. In order to provide for reasonable fire protection during the con- struction period, the subdivider shall maintain passable vehicular access to all buildings and adequate fire hydrants with required fire flows and dry-stand pipes shall be installed prior to framing construction. This condition should be noted on the Final Map. Park-In-Lieu Fees shall be granted to the City prior to City Council approval of the Final Map.
