ORDINANCE NO. 9408 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA ADOPTING SPECIFIC PLAN (SP-132) FOR DEVELOPMENT OF 253 DWELLING UNITS ON 100 ACRES GENER- ALLY LOCATED ON THE NORTH SIDE OF UNICORN10 STREET BETWEEN AVENIDA DE PARAISO AND CHORLITO STRJ3ET. APPLICANT: CARRILLO RANCHQ,PARTNERSHI The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1: A Specific Plan (SP-132) is hereby adopted for development of 253 dwelling units on 100 acres generally located on the north side of Unicornio Street between Avenida de Paraiso and Chorlito Street, more particularly described as: Portion of the Southwest Quarter of Section 24, Township 12 South, Range 4 West, according to the Official Plat thereof, filed in the office of the County Recorder in the County of San Diego, State of California, said plan to consist of a plot plan marked Exhibit A to SP-132, dated May 7, 1973, and an application with attachments on file in the office of the City Planning Department and incorporated by reference herein, subject to all terms and conditions of this ordinance. SECTION 2: Findings. The approval of Specific Plan (SP-132) is justified by the following findings: A. Conformance of the revised Specific Plan to the ap- proved Master Plan and to the General Plan. B. Conformance of the revised Specific Plan to all re- quirements of the Municipal Code requirements applicable to prop- erty located in the Planned Community Zone. C. Conformance of the precise development to the existing and proposed development in the area. SECTION 3: Development Conditions. The Specific Plan (SP-132) is approved subject to the following conditions and restrictions and the development of the property, as described in 1 2 3 4 5 6 7 e 9 IC 11 12 13 2c 21 22 22 24 25 26 27 28 29 30 31 32 t 0 0. 0. Section 1 hereof, shall be subject to all such conditions and restrictions which are in addition to all requirements, limita- tions and restrictions of all municipal ordinances and state and federal laws now in force or which may hereafter be in force: 1. The approval of Specific Plan 132 is granted for the land described in the application and any attachments thereto and as shown on the plot plan submitted labeled Exhibit A. The location of all buildings, fences, signs, roadways, parking areas, landscaping and other facilities or features shall be located substantially as shown on the plot plan labeled Exhibit A. 2. All requirements of any law, ordinance or regula- tion of the State of California, City of Carlsbad, and any other governmental entity shall be complied with. 3. An open-space easement shall be dedicated to the City over Lots 254 and 255 as shown on the Specific Plan. These open space areas shall be preserved and maintained by a property owners' association and shall be rezoned to Open Space (0-S) Zone prior to approval of the final map. 4. The setbacks on the individual lots shall conform to all the requirements and limitations for property located in the R-1 Zone District. 5. The units shall commence construction on or before the following dates: Unit 1 - April, 1977 Unit 2 - April, 1978 6. Ordinance No. 9332 adopted the Master Plan for the subject property. amended by Ordinance No. 9365 to add various conditions of approval. Master Plan Condition No. 2 providing for the dedication of Parcels K and K-1 for park purposes is incorporated by reference herein. This Specific Plan is approved on condition that said condition be fully satis- fied prior to the approval of the final map for develop- ment of any part of the property encompassed in this Specific Plan. this Specific Plan shall be subject to the same condition, and the final map may not be approved until Parcel K is deeded free and clear to the City of Carlsbad and all other terms of Master Plan Condition No. 2 are fully satisfied. The applicant shall present a report and evidence of an archaeological investigation of the potential quarry site prior to the issuance of any permits for grading. SECTION 4: Administration and Enforcement. The Building lepartment shall not approve any building for occupancy until the ?lanning Director has certified that all the conditions of this xdinance have been satisfied. EFFECTIVE DATE: This ordinance shall be effective thirty gays after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least mce in the Carlsbad Journal within fifteen days after its adop- tion.
