CARLSBAD, CALIFORNIA 92008
I. REQUEST: The applicant is requesting approval of a zone change from
RD-M and P-C to R-P on property located on the south side of Costa Del
Mar Road between El Camino Real and Estrella del Mar Road. This parcel
is 4.040 acres and is described as follows:
All of Lot 3 of La Costa Condominium No. 4, in the City of
Carlsbad, County of San Diego, State of California, according
to Map thereof No. 6520 on file in the office of the San Diego
County Recorder.
II. RECOMMENDATION: Staff recommends APPROVAL of ZC-146 based on the
following justification:
1. The proposed zoning is consistent with the Land Use designation
of the City's proposed Land Use Element of the General Plan.
2. The proposed zoning is better suited than existing zoning to the
location adjacent to a major arterial.
III. BACKGROUND:

B. General Plan: The adopted La Costa Master Plan shows the subject
property as Residential Density Multiple.
The proposed Land Use Element of the General Plan shows the property
as Residential High Density/Office, which is in conformance with the
proposed change. This Element is slated to be adopted October 15, 1974.
State law AB-1301 requires that, in order for the City Council to
approve zone changes, General Plan conformity must be proven.
Accordingly, the City Council will be obligated to await the effective
date of the New Land Use Element before approving the subject
application.
C. Environmental Impact Information: The project has been declared
non-significant, according to the requirements of the Carlsbad
Environmental Protection Ordinance for the reason that the project
is small and adjacent to the established SPA area.
D. Surrounding Land Use: The project site is north of the La Costa
stables and at the main entrance to the hotel and spa complex.
E. Major Planning Consideration: The major difference between the
existing zones and proposed zone is that the R-P zone allows
professional office uses. Staff believes that this type of use is
appropriate for the following reasons:
1. The site is at the entrance to the hotel and spa complex, and
a professional use could provide focus as the entry to La Costa.
2. The site is adjacent to El Camino Real, making it readily
accessible.
F. Incidental Information: The La Costa Land Company has submitted a
building permit application for an information center which would
be located on the site. The Center would consolidate all subdivision
advertising (which is now conspicuously scattered throughout La
Costa), provide displays, parking and restroom facilities. The
majority of the site is to remain in the present landscaped state.

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF CARLSBAD, CALIFORNIA, CONCERNING THE ZONE CHANGE
FROM RD-M and P-C to R-P ON PROPERTY LOCATED ON THE
SOUTH SIDE OF COSTA DEL MAR ROAD BETWEEN EL CAMINO
REAL AND ESTRELLA DEL MAR ROAD CONSISTING OF 4.040
ACRES. CASE NO. ZC-146, APPLICANT: LA COSTA LAND
COMPANY
WHEREAS, a verified application for a certain property, to wit:

All of Lot 3 of La Costa Condominium No. 4, in the City
of Carlsbad, County of San Diego, State of California,
according to Map thereof No. 6520 on file in the office
of the San Diego County Recorder
has been filed with the City of Carlsbad and referred to the Planning
Commission; and
WHEREAS, said verified application constitutes a request as provided by
Title 21 of the "Carlsbad Municipal Code"; and
WHEREAS, the public hearing was held at the time and in the place
specified in said notice on October 8, 1974; and
WHEREAS, the applicant has complied with the Public Facility Policy of
the City of Carlsbad and has provided the necessary information which insures
Public Facilities will be available and current with need; and
WHEREAS, the subject application has complied with the requirements of
the City of Carlsbad "Environmental Protection Ordinance of 1972"; and
WHEREAS, at said public hearing, upon hearing and considering the
testimony and arguments, if any, of all persons who desired to be heard, said
Commission considered all factors relating to the Zone Change and found the
following facts and reasons to exist:
1. The proposed zoning is consistent with the Land Use designation
of the City's proposed Land Use Element of the General Plan.
2. The proposed zoning is better suited than existing zoning to the
location adjacent to a major arterial.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Carlsbad, California that a Zone Change is approved for use of said
property from RD-M and P-C to R-P on property located on the south side of
Costa Del Mar Road between El Camino Real and Estrella Del Mar Road and

PASSED, APPROVED AND ADOPTED at a regular meeting of the City of
Carlsbad Planning Commission held on October 8, 1974 by the following vote,

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING
FINDINGS AND DECISION REGARDING CHANGE
OF ZONE FROM RD-M TO R-P (ZC-146) ON
PROPERTY GENERALLY LOCATED ON THE SOUTH
SIDE OF COSTA DEL MAR ROAD BETWEEN EL
CAMINO REAL AND ESTRELLA DEL MAR ROAD.
APPLICANT: LA COSTA LAND COMPANY
WHEREAS, on October 8, 1974, a duly advertised public hear-
ing was held before the Planning Commission in the manner pre-
scribed by law to consider a change of zone from RD-M to R-P, as
shown on the map marked ZC-146, Exhibit A, dated September 26, 1974
on file in the Planning Department and incorporated by reference
herein, on property generally located on the south side of Costa
Del Mar Road between El Camino Real and Estrella Del Mar Road,
more particularly described as:
All of Lot 3 of La Costa Condominium No. 4 in the
City of Carlsbad, County of San Diego, State of Cali-
fornia, according to Map No. 6520 on file in the
office of the San Diego County Recorder;
and
WHEREAS, at the conclusion of said hearing the Planning
Commission of the City of Carlsbad adopted Resolution No. 1104
recommending said zone change which is herewith referred to and
made a pa'rt hereof; and
WHEREAS, on the 6th day of November , 1974, the City
Council held a public hearing on the matter, received all recom-
mendations and heard all persons interested in or opposed to the
proposed change of zone; and
WHEREAS, the Planning Director has determined that said
change of zone will have a nonsignificant impact on the environ-
ment, and a Negative Declaration has been prepared and filed in
satisfa'ction of the requirements of the City of Carlsbad Environ-
mental Protection Ordinance of 1972 and the California Environmen-
tal Quality Act;

NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the findings of the Planning Commission contained
in the aforementioned Resolution No. 1104 constitute the findings
of the Carlsbad City Council.
3 . That the approval of the proposed change of zone
classification is necessary to carry out the general purpose of
Title 21 of the Municipal Code.
4. That the City Council of the City of Carlsbad intends
to adopt an ordinance to effectuate the proposed change of zone.
PASSED, APPROVED AND ADOPTED at a meeting of the City
Council on the 6th day of November , 1974, by the follow-
ing vote, to wit:

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, AMENDING
TITLE 21 OF THE CARLSBAD MUNICIPAL CODE
BY AMENDING THE ZONING MAP TO GRANT A
CHANGE OF ZONE FROM RD-M (RESIDENTIAL
DENSITY-MULTIPLE ZONE) TO R-P (RESIDEN-
TIAL PROFESSIONAL ZONE) (ZC-146) FOR
4.040 ACRES GENERALLY LOCATED ON THE
SOUTH SIDE OF COSTA DEL MAR ROAD BETWEEN
EL CAMINO REAL AND ESTRELLA DEL MAR ROAD.
APPLICANT: LA COSTA LAND COMPANY
The City Council of the City of Carlsbad, California,
does ordain as follows:
SECTION 1: Title 21 of the Carlsbad Municipal Code is
amended by the amendment of the zoning map change of zone from
RD-M (Residential Density-Multiple Zone) to R-P (Residential
Professional Zone) (ZC-146) for the following described property:
All of Lot 3 of La Costa Condominium No. 4 in the
City of Carlsbad, County of San Diego, State of
California, according to Map No. 6520 on file
in the office of the San Diego County Recorder.
EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Jounral within fifteen days after its adop-
tion.
INTRODUCED AND FIRST READ at a meeting of the Carlsbad
City Council held on the 6th day of November / 1974, and
thereafter
PASSED AND ADOPTED at a meeting of said City Council held
on the 19th day of November ' 1974, by the following vote,
to wit:
