The applicant is proposing to develop 179 single-family lots, '3 condominium lots providing for a maximum density of 20 dwelling units per acre and 8 open space lots. The applicant has met all ordinances and policies including Public Facilities of the City of Carlsbad. The Planning Commission required that an.archaeologic investigation be conducted on; an identified archaeologic site within the subdivision. The Planning Commission will present a report, with recommendations, on the findings of that investigation to the City Council. Also the Council accepted the E.I.R. -2- CITY OF CARLSBAD PLANNING DEPARTMENT STAFF REPORT October 8, 1974 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT REPORT ON: CONSIDERATION OF AN ENVIRONMENTAL IMPACT REPORT, SPECIFIC PLAN AND TENTATIVE SUBDIVISION MAP CASE NOS: EIR-248, SP-116 AND CT 73-2 APPLICANT: LA COSTA LAND COMPANY COSTA DEL MAR ROAD CARLSBAD, CALIFORNIA 92008 I. REQUEST: The applicant is requesting certification of a Final Environ- mental Impact Report and approval of a Specific Plan and Tentative Sub- division Map for property located in an established P-C (Planned Community) Zone District. The proposed development consists of 179 single-family lots, 3 condominium lots with a maximum density of 20 dwelling units per acre and 8 open space lots. II. ENVIRONMENTAL IMPACT REPORT No. 248: Staff recommends that EIR-248 be CERTIFIED based on the following justification: 1. The EIR adequately discussed the environmental impacts of the project and proposes mitigating measures which would reduce those impacts. 2. The EIR has been properly noticed and reviewed and comments from interested parties have been included in the Final Report. 3. The EIR meets all of the requirements of the Carlsbad Environmental Protection Ordinance and the California Environmental Quality Act. III. SPECIFIC PLAN NO. 116: A. Staff Recommendation: Staff recommends APPROVAL of SP-116, as shown on Exhibit A, dated revised September 12, 1974, based on the following justification: 1. 2. No substantial environmental impacts will occur as a result of this project —,c The project complies with all City Ordinances and Policies, including the Parks Ordinance and the Public Facilities Policy. 3. The project conforms to the adopted General Plan for the City of Carlsbad. 4. The project conforms to the adopted La Costa Master Plan. B. Recommended Conditions of Approval: 1. This approval is granted for the land described in the application and any attachments thereto, and as shown on the plot plan submitted labeled Exhibit A, dated revised September 12, 1974. 2. All setbacks and other development standards for the single- family lots shall conform to those established in the R-l Zone District. Coverage of said lots shall not exceed 33-1/3%. 3. Prior to the issuance of any building permits for Lots #180, 181 or 182 (multiple-family lots), an application for an amend- ment to this Specific Plan shall be submitted to the City for review and approval. Said application shall conform to all of the requirements of the P-C (Planned Community) Zone District relating to Specific Plans. Densities shall reflect those recommended in the adopted General Plan. 4. Any minor change may be approved by the Planning Director. Any substantial change will require the filing of an application for an amendment to be considered by the Planning Commission. 5. All requirements of any law, ordinance or regulation of the State of California, City of Carlsbad, and any other governmental entity shall be complied with. 6. Prior to final occupancy, a detailed landscape and sprinkler plan for the Open Space lots and the method of maintaining those lots shall be submitted to the City for review and approval. 7. The applicant shall install all required fire hydrants and dry- stand pipes prior to framing construction, and said fire appurten- ances shall be functional prior to commencing such work. 8. A program for the* maintenance of open space easements (Lots 183- 190) shall be submitted to the Planning Director for approval prior to issuance of building permits IV. TENTATIVE MAP NO. CT 73-2: A. Staff Recommendation: Staff recommends APPROVAL of CT 73-2 as shown on Exhibit A, dated revised September 12, 1974, based on the following justification: 1. No substantial environmental impacts will occur as a result of this project. 2. The project complies with all City Ordinances and Policies, including the Parks Ordinance and the Public Facilities Policy. 3. The project conforms to the adopted General Plan for the City of Carlsbad. 4. The project conforms to the adopted La Costa Master Plan. 5. The project conforms to the requirements of the California Subdivision Map Act. B. Recommended Conditions of Approval: 1. The Final Map shall be submitted for approval within one year from the final action by the City Council on the Tentative Subdivision Map. The Final Map shall be in substantial .con- formance of the Tentative Subdivision Map known as Exhibit A, dated revised September 12, 1974. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations and restrictions of all municipal ordinance and State and Federal statutes now in force, or which, hereafter, may be in force for the purpose of preserving the residential characteristics of adjacent properties. 3. All public improvements shall be made in conformity to the City of Carlsbad Engineering Design Criteria and Standard Plans, the Subdivision Ordinance and other City Standards, to the satisfaction of the City Engineer, without cost to the City of Carlsbad, and free from all liens and encumbrances. Improvement plans for water and sewer systems shall meet the requirements of the respective service districts. 4. All land and/or easements required by this Ordinance shall be granted to the City of Carlsbad without cost to the City and free of all liens and encumbrances. No easements shall be recorded prior to recordation of the Final Map unless approved by the City Engineer. 5. All utilities, including provisions for cable TV, shall be placed underground and/or shall be completely concealed from view. 6. All drainage and flood control facilities shall be approved by the County of San Diego Flood Control District prior to installation. 7. Ornamental street lighting shall be provided for as required by Municipal Ordinance Code. The developer shall post a bond and/or cash in the amount necessary to energize said lights for an eighteen month period after construction, to permit the incorpora- tion of the subdivision into a maintenance district. This shall be done prior to approval of Final Map. 8. The improvement plans shall include a report of a geological investigation and a complete grading plan of the entire site when required by the City Engineer. The report and plan shall be prepared by Civil Engineers licensed by the State of California, and experienced in erosion control. Said Engineer shall certify that they have investigated the site and prepared data with full consideration of the consequences to the included and neighboring properties and conform to the standards of the Geological Safety Element of the General Plan. 9. All slopes created as a result of this development shall not exceed a 2:1 slope. 10. Ingress and egress along the property line bordering public street right of way for all lots shall be dedicated, except at location as specified by the City Engineer. Dedication shall be made prior to approval of Final Map. 11. If requested by the City Engineer, an amended Tentative Map shall be submitted for approval by the City Engineer prior to prepara- tion of the Final Map to assure compliance to all conditions of approval. 12. In order to provide for reasonable fire protection during the construction period, the subdivider shall maintain a passable vehicular access to all buildings and adequate fire hydrants with required fire flows and dry-stand pipes shall be installed prior to framing construction. 13. Park-In-Lieu Fees shall be granted to the City prior to City Council approval of the Final Map. 14. Street trees, when required by the City, shall be installed by the applicant at his expense. Trees shall be of a type approved by the Parks Department and shall be installed to their specifica- tions. If removal of any existing trees is required by the City, said removal shall be at the applicant's expense. It shall be the responsibility of the applicant to make all arrangements with the Parks Department concerning the requirements of this condition. These arrangements are to be made prior to approval of the Final Map. 15. Street names shall be subject to approval and shall be designated in accordance with the standards and policies adopted by the Planning Commission on file in the Planning Department. Said names shall be approved by the Planning Director prior to approval of the Final Map. 16. The C.C. & R's for this development shall be submitted to the Planning Director for review and approval prior to the approval of Final Map. 17. An Open Space Easement shall be dedicated to the City over lots #83-190 as shown on the Tentative Map, prior to approval of the Final Map. 18. A forty (40) foot Open Space Easement along the southerly boundary of the subdivision shall be offered for dedication to the City by separate instrument prior to approval of the Final Map. 19. All drainage and flood control facilities shall be approved by the County of San Diego Flood Control District prior to installation. 20. Prior to the issuance of grading permits, the San Diego Museum of Man or other recognized archeological organization shall conduct a resurvey of the subject property to determine if there are additional steps necessary to preserve the archeological resources of the site. A letter from such an organization, stating that this condition has been met, shall be submitted to the City Engineer. X. 21. The applicant shall dedicate and make offsite improvements to City Standards (28' Row) on Segovia Way, from its intersection with Levante Street to the project boundary. V. ENVIRONMENTAL IMPACT INFORMATION: Refer to the attached Final Environmental Impact Report No. 248. VI. BACKGROUND: A. Location and Description of Property: The subject property is located southwesterly of the intersection of La Costa Avenue and Rancho Santa Fe Road. The site consists of 57.3 acres and is currently vacant 1 a nd. B. Zoning: Subject Property: P-C (MP) East: P-C (MP) South: P-C (MP) West: P-C (no MP) North: R-l, RD-M & C-2 C. Land Use: This property, and all surrounding areas, are currently vacant except for the area to the north. This area, known as La Costa Point, is being developed with single-family and multiple-family units. D. General Plan: The adopted General Plan designates this area as "High Density" Residential (20 d.u.'s per acre) and "Low Density" Residential (3.5 d.u.'s per acre). The proposed Land Use Element designates this area as "Low-Medium Density" Residential (0-4 d.u.'s per gross acre), "Medium Density" Residential (4-10 d.u.'s per gross acre) and "Medium- High Density" Residential (10-20 d.u.'s per gross acre). The proposed density of the multiple-family area is 20 d.u."s per acre and the proposed density of the single-family area is 3.3.d.u.'s per acre. E. Major Planning Considerations: This project will be the last of its type with orientation to the north. All access will be from Levante Street. Any new development will have orientation to the south. This is the reason the open space corridor shown on the proposed General Plan was shifted slightly to the south. It will act as a natural buffer between this project and any new development to the south and won't be traversed by any streets. Segovia Way will have to be improved off-site to provide adequate access to this development. This improvement will consist of approxi- mately 1300 ft. of minimum street section and will not substantially preclude future land use options in the future development area. On July 16, 1974, the City Council amended the Interim Parks Agreement with La Costa. This project is consistent with that agreement and fees will be paid in-lieu of park dedication. SP-116, APPLICANT: LA COSTA LAND COMPANY WHEREAS, a verified application for a certain property, to wit: Portions of lot 1, of Fractional Section 6, Township 13, South, Range 3 West; portions of lots 1 & 2 of fractional Section 1, Township 13 South, Range 4 West, S.B.M; and portions of lots 3, 4, 9 and 10 of Rancho Las Encinitas, Map No. 848, City of Carlsbad; has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the "Carlsbad Municipal Code"; and WHEREAS, the public hearing was held at the time and in the place specified in said notice on October 8, 1974; and WHEREAS, the applicant has complied with the Public Facility Policy of the City of Carlsbad and has provided the necessary information which insures Public Facilities will be available and current with need; and WHEREAS, the subject application has complied with the requirements of the City of Carlsbad "Environmental Protection Ordinance of 1972"; and WHEREAS, at said public hearing, upon hearing and considering the testimony and arguments, if any, of all persons who desired to be heard, said Commission considered all factors relating to the Specific Plan and found the following facts and reasons to exist: 1.
