Statement of the Matter
As a part of Memoranda of Understanding between the City of Carlsbad
and the Carlsbad Police Officers' Association and the Carlsbad
Firefighters' Association the provisions of Section 21263.1
(one-half continuance benefits) of the California Government Code
are to be included by amendment in the contract with P.E.R.S. The
City has received the required actuarial report from P.E.R.S. and
must now return a copy of the attached resolution and a Certifica-
tion.of,Governing Body's Action:
The above action will be followed by receipt of the actual amend
ment to the contract. At this time the Council must take affirma-
tive action adopting the amendment.

RESOLUTION NO. 3542
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, EXPRESSING
THE INTENTION OF THE CITY COUNCIL TO
APPROVE AN AMENDMENT TO CONTRACT BETWEEN
THE BOARD OF ADMINISTRATION OF THE PUBLIC
EMPLOYEES' RETIREMENT SYSTEM AND THE CITY
OF CARLSBAD.
IWHEREAS, the Public Employees' Retirement Law permits
the participation of public agencies and their employees in the
Public Employees' Retirement System by the execution of a contract
and sets forth the procedure by which said public agencies may
elect to subject themselves and their employees to amendments to
said law; and
WHEREAS, one of the steps required in the procedure to
amend this contract is the adoption by the legislative body of
the public agency of a resolution giving notice of its intention
to approve an amendment to said contract, which resolution shall
contain.a summary.of the changes proposed in said contract; and
WHEREAS, the following is a summary of the proposed
change:
Provides, upon death of a local safety member who .has
retired for service or disability for the continuation of post -
retirement survivor allowance to certain survivors.
NOW, THEREFORE, BE 11! RESOLVED by the City Council of
the City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That it does hereby give notice of intention to
approve an amendment to contract between said City of Carlsbad
and the Board of Administration of the Public Employees' Retire-
ment System. A copy of said amendment is attached as Exhibit A
and incorporated herein by reference.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held. on the 6th day of November , 1974, -
by the following vote, to wit: ",
