APPLICANT: LA COSTA LAND COMPANY The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1; A Specific Plan (SP-116) is hereby adopted for development of 179 single-family lots, 3 condominium lots with a maximum density of 20 dwelling units per acre and 8 open space lots on 57.3 acres located southwesterly of the intersection of La Costa Avenue and Rancho Santa Fe Road, more particularly described as: Portions of Lot 1, of Fractional Section 6, Town- ship 13 South, Range 3 West; portions of Lots 1 and 2 of Fractional Section 1, Township 13 South, Range 4 West, S.B.M.; and portions of Lots 3, 4, 9 and 10 of Rancho Las Encinitas, Map No. 848, recorded in the office of the County Recorder, County of San Diego, State of California, said plan to consist of a plot plan marked Exhibit A to SP-116, dated October 10, 1974, and an application with attachments on file in the office of the City Planning Department and incor- porated by reference herein, subject to all terms and conditions of this ordinance. SECTION 2; Findings. The approval of Specific Plan (SP-116) is justified by the following findings: A. Conformance of the revised Specific Plan to the approved Master Plan and to the General Plan. B. Conformance of the revised Specific Plan to all re- quirements of the Municipal Code requirements applicable to prop- erty located in the Planned Community Zone. C. SECTION 3: Development Conditions. The-Specific Plan (SP-116) is approved subject to the following conditions and restrictions and the development of the property, as described in Section 1 hereof, shall be subject to all such conditions and restrictions which are in addition to all requirements, limita- tions and restrictions of all municipal ordinances and state and federal laws now in force or which may hereafter be in force: 1. This approval is granted for the land described in the application and any attachments thereto, and as shown on the plot plan submitted labeled Exhibit A, dated October 10, 1974. 2. All setbacks and other development standards for the single-family lots shall conform to those established in the R-l Zone District. Coverage of said lots shall not exceed 33-1/3%. 3. Prior to the issuance of any building permits for Lots 180, 181 or 182 (multiple-family lots), an applica- tion for an amendment to this Specific Plan shall be sub- mitted to the City for review and approval. Said applica- tion shall conform to all of the requirements of the P-C (Planned Community) Zone District relating to Specific Plans. Densities shall reflect those recommended in the adopted General Plan. 4. Any minor change may be approved by the Planning Director. Any substantial change will require the filing of an application for an amendment to be considered by the Planning Commission. 5. All requirements of any law, ordinance or regula- tion of the State of California, City of Carlsbad, and any other governmental entity shall be complied with. 6. Prior to final occupancy a detailed landscape and sprinkler plan for the Open Space lots and the method of maintaining those lots shall be submitted to the City for review and approval. 7. The applicant shall install all required fire hydrants and drystand pipes prior to framing construction, and said fire appurtenances shall be functional prior to commencing such work. 8. A program for the maintenance of open space ease- ments (Lots 183 through 190, inclusive) shall be submitted to the Planning Director for approval prior to issuance of building permits. SECTION 4: Administration and Enforcement. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adop- tion. APPLICANT: LA COSTA LAND COMPANY WHEREAS, on October 8, 1974, the Carlsbad City Planning Commission adopted Resolution No. 1103 recommending to the City Council that Tentative Map (CT 73-2) be approved; and WHEREAS, the City Council of the City of Carlsbad, on the 6th day of November / 1974, considered the recommendation of the Planning Commission; and WHEREAS, an Environmental Impact Report has been prepared and discussed at duly noticed public hearings before the Planning Commission and the City Council, and the final report has been certified as complete in compliance with the requirements of the City of Carlsbad Environmental Protection Ordinance of 1972; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That Tentative Map (CT 73-2) is hereby approved subject to all applicable requirements of the Carlsbad Municipal Code and to the satisfaction of the following conditions: 1. The final map shall be submitted for approval with- in one year from the final action by the City Council on the Tentative Subdivision Map. The final map shall be in substantial conformance of the Tentative Subdivision Map known as Exhibit A, dated October 10, 1974. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations and restrictions of all municipal ordinance and state and federal statutes now in force, or which hereafter may be in force for the purpose of preserving the residential characteristics of adjacent properties. 3. Improvement plans for water and sewer systems shall meet the requirements of the respec- tive service districts. 4. All land and/or easements required by this ordi- nance shall be granted to the City of Carlsbad without cost to the City and free of all liens and encumbrances. No easements shall be recorded prior to recordation of the final map unless approved by the City Engineer. 5. All utilities, including provisions for Neable TV, shall be placed underground and/or shall be completely concealed from view. 6. All drainage and flood control facilities shall be approved by the County of San Diego Flood Control District prior to installation. 7. Ornamental street lighting shall be provided for as required by Municipal Code. The developer shall post a bond and/or cash in the amount necessary to energize said lights for an 18-month period after construction to permit the incorporation of the subdivision into a main- tenance district. This shall be done prior to approval of final map. 8. The improvement plans shall include a report of a geological investigation and a complete grading plan of the entire site when required by the City Engineer. The report and plan shall be prepared by civil engineers licensed by the State of California and experienced in erosion control. Said engineers shall certify that they have investigated the site and prepared data with full consideration of the consequences to the included and neighboring properties. 9. All slopes created as a result of this develop- ment shall not exceed a 2:1 slope. 10. Ingress and egress along the property line bor- dering public street right-of-way for all lots shall be dedicated, except at location as specified by the City Engineer. Dedication shall be made prior to approval of final map. 11. If requested by the City Engineer, an amended Tentative Map shall be submitted for approval by the City Engineer prior to preparation of the final map to assure compliance to all conditions of approval. 12. In order to provide for reasonable fire protec- tion during the construction period, the subdivider shall maintain a passable vehicular access to all buildings and adequate fire hydrants with required fire flows,and dry- stand pipes shall be installed prior to framing construc- tion. 13. Street trees/ when required by the City, shall be installed by the applicant at his expense. Trees shall be of a type approved by the Parks Department and shall be installed to their specifications. If removal of any existing trees is required by the City, said removal shall be at the applicant's expense. It shall be the respon- sibility of the applicant to make all arrangements with the Parks Department concerning the requirements of this •condition. These arrangements are to be made prior to approval of the final map. 15. Street names shall be subject to approval and shall be designated in accordance with the standards and policies adopted by the Planning Commission on file in the Planning Department. Said names shall be approved by the Planning Director prior to approval of the final map. 16. The CC&R's for this development shall be submit- ted to the Planning Director for review and approval prior to the approval of final map. 17. An Open Space easement shall be dedicated to the City over Lots 183 through 190, inclusive, as shown on the Tentative Map, prior to approval of the final map. 18. A forty-foot open space easement along the south- erly boundary of the subdivision shall be offered for dedication to the City by separate instrument prior to approval of the final map. 19. Prior to the issuance of grading permits devel- oper shall cause the San Diego Museum of Man or other recognized archeological organization to conduct a survey of the subject property to determine if there are addi- tional steps necessary to preserve the archeological resources of the site. A letter from such an organization stating that this condition has been met shall be submit- ted to the City Engineer. A report from such an organi- zation which sets forth a program shall be submitted to the Planning Commission for approval. The Planning Com- mission may consider recommending the imposition of addi- tional conditions deemed necessary in view of the arche- ological report. Upon receipt of such recommendations the City Council may impose any additional conditions which may be necessary in view of the report which shall be satisfied prior to approval of the final map. 20. The applicant shall dedicate and make offsite improvements to City standards (28-foot section) on Segovia Way, from its intersection with Levante Street to the project boundary. 21. Bicycle provisions on Rancho Santa Fe Road are to be established in accordance with standards satisfactory to the City Engineer. C. That said Tentative Map, together with the provisions for its design and improvement and subject to the above conditions, is consistent with all applicable general and specific 3.
