statement of the Matter: The Planning Commissio.n is recommending approval of
Specific Plan No. 160 and Tentative Subdivision Map CT 74-13 on approximately
43.2 acres on the east side of Crest Drive between Elm Avenue and Eucalyptus
Avenue for reasons outlined and subject to conditions stated in Planning
Commission Resolution No. 1108 and 1109.
The proposed 135 dwelling unit development is the second phase of the Hosp
Grove Planned Community {Development: to be known as Buena Woods III. The
Specific Plan/Tentative Map contains 43.2 acres and contains approximately
7.0 acres which will be dedicated to the City for Park purposes. The
7.0 acres is known as the proposed Hosp Grove Amphitheater Park. Additionally
an additional 5 acres are being dedicated along the westerly subdivision
boundary for pedestrian and equistrian purposes.
The applicant has met all ordinances and policies including Public
Facilities of the City, of Carlsbad.

The Planning Commission heard the Buena Woods III request at their
October 8, 1974 meeting. It was moved and unanimously approved to
continue the case until a report could be submitted by the Parks
and Recreation Director. A copy of this report, explaining the
Parks and Recreation Commission's recommendations for the Hosp
Grove Amphitheatre and Park system has been attached.
The Parks and Recreation Director will be unable to attend the
Planning Commission hearing. However, the Parks and Recreation
Commission Chairman will be in attendance to answer any questions
which may arise.
Please note the following changes on your October 8th Staff Report:
Delete condition No. 6 from CT 74-13 as it is not necessary.
Strike out "...and require their replacement when necessary",
from condition No. 18 of SP-160 conditions of approval.
Change wording of condition No. 19 of CT 74-13 to read:
"An Open Space Easement granted to the City of Carlsbad
over lot 148 concurrent with recordation of the final
map".

BUENA WOODS CARLSBAD TRACT i 74-13
The Parks and Recreation Commission has studied and approved
the proposed 12.70 acres that has been indicated would be
dedicated to the City. This includes Lot 140 that contains
7.0 acres that is located in the area that a proposed Amphi-
theater would'be constructed and Lot 136 which contains 5.7
acres that is located on the West boundary of the property.
The Parks and Recreation Commission has approved the said
area to be implemented into our program.
DISCUSSION:
A. Lot 140
This is the area that the Commission and Director feel
would be the amphitheater location. The amphitheater
would be built in a 'rustic and woodish atmosphere and
an estimated cost would be $75,000. After research of
other amphitheaters it seems that this is an ideal location
and the cost figure also is very reasonable for the type
of construction that would be fitting to this project.
Upon dedication of this property, it is felt that monies
could be budgeted through' the Capitol Improvement Plan
to start in 1975-76 fiscal year. It is the general
feeling of the Commission that this would correlate with
^ the 1976 Bi-Centennial Program.
Exhibit A shows the entrance off Monroe Street that would
give the public a good scenic view plus a parking lot
which would be located in the East end of the said entrance.
As the need increases, there would be ample room to expand
the parking lot.
B. Lot 136
This area would be used for walking trails and some, picnic
areas. Condition 18 calls for the thinning of some of the
debris and trees for a better scenic view to the public,

in addition to reducing potential fire hazards.
More active park area would be initiated as the Hosp (7rove
Park corridor is obtained to the North 'of the boundary lines
of said property.
C. Open Space
It is the opinion of the Commission that public access
should be obtained so that Carlsbad citizens may be able
to physically use these areas. It is their opinion that
the walk ways to be established in the open space areas
would be the responsibility of the City.

I. REQUEST: The applicant is requesting approval of a Specific
Plan and Tentative Map to allow a 135 unit development on a
43.2 acre site, zoned P-C. The site is located on the east
side of Crest Drive between Elm Avenue and Eucalyptus Avenue
and is described as:
Those portion of Lots 3,4,5,6,7,26, and 27, and of Canon
Street is Hosp Eucalyptus Forest Co.'s Tract No. 1 in the
City of Carlsbad, County of San Diego, State of California,
according to Map thereof No. 1136 filed in the office of
the San Diego County Recorder, June 8, 1908.
II. STAFF RECOMMENDATIONS
A. Specific Plan 160 - Staff recommends approval based on
the following justification:
1) Compliance with all applicable Municipal Code
requirements.
2) Conformance to the adopted General Plan.
B. Recommended Conditions of Approval for SP-160:
1) The approval is granted for the land described in
the application and any attachments thereto, and as
shown on the plot plan submitted labeled Exhibit A.
The location of all buildings, fences, signs,
roadways, parking areas, landscaping, and other
facilities or features shall be located substantially
as shown on the plot plan labeled Exhibit A, except
or unless indicated otherwise herein. All buildings
and structures shall be of the design as shown on
the elevation plans labeled Exhibit B.
2) Unless the construction of the structure or facility
is commenenced not later than one year after the
date the approval is granted and is diligently
pursued thereafter, this approval will automatically
become null and void.
3) All requirements of any law, ordinance or regulation
of the State of California, City of Carlsbad, and
any other governmental entity shall be complied
with.
4) All areas shown as parking areas shall be surfaced
with asphaltic concrete and shall be visibly marked
outlining individual parking spaces and traffic
flow. Said surfacing and marking shall be completed
prior to final inspection of the structure or
structures by the Building Department. The surface
shall be kept in a reasonably good state of repair
at all times.
5) All outside storage areas shall be screened from
adjacent property and streets.
6) Interior landscaping of parking areas shall be
provided in a manner acceptable to the Planning
Director. Said minimum area of landscaping shall be
equivalent to 3% of the area of the lot excluding
required perimeter landscaping.
7) A detailed landscape and sprinkler plan prepared
by a landscape architect, shall be submitted to the
Planning Director for consideration and approval.
8) Prior to final building inspection clearance, all
landscaping shall be installed. Said landscaping
shall, at all times, be maintained in a manner
acceptable to the Planning Director.
9) All utilities including electrical, telephone and
cable television, shall be installed underground
and/or shall be completely concealed from view.
10) There shall be no ingress or egress to the property
except for those shown on the plot plan labeled
Exhibit A, and as approved by the City Engineer.
11) Street trees, as required by the City, shall be
installed by the applicant at his expense. Trees
shall be of a type approved by the Parks Dept. and
shall be installed to their specifications. If
removal of any existing trees is required by the City,
said removal shall be at the applicants' expense.
It shall be the responsibility of the applicant to
make all arrangements with the Parks Dept. concerning
the requirements of this condition.
12) Prior to final occupancy, compliance with and execution
of all conditions listed hereon shall be necessary,
unless otherwise specified. Deviation from this
requirement shall be permitted only by written consent
of the Planning Director.
13) Pathways in lots 136 and 148 shall be a minimum
of 8' in width and shall be improved with asphaltic
concrete to the satisfaction of the City Engineer.
These pathways shall have a maximum grade of 7%.
14) Utilities shall be supplied to the Park Site to the
satisfaction of the City Engineer and Parks Director.
15) The applicant, by written agreement and according
to procedures set forth in the California Vehicle
Code, shall consent to enforcement of parking
restrictions on all private drives within the
development.
16) No phasing of the project shall occur unless an
amendment to this specific plan is filed with plans
for extending roads and services to adequately serve
each increment of development.
17) On City Park Lots #136 and 140, all street improve-
ments, parking and public recreation improvements
(such as an open air theatre and picnic area) as
deemed necessary by the Parks Director and City
Engineer are approved as a part of this Specific Plan
18) Prior to issuance of building permits, the appli-
cant shall remove debris and litter and thin groves
on lots 136, 140 and 148. The Parks Department
shall determine which trees should be removed,-a-n4-
r-equire their replacement when necessary.
19) This Specific Plan shall expire if construction
is not commenced by January 1, 1979.
C. Tentative Map CT 74-12 - Staff recommends approval of
CT 74-12 based on the following justification:
1) Conformance to the adopted General Plan.
2) Compliance with requirements of the Subdivision Map
Act.
D. Recommended Conditions of Approval for CT 74-12:
(1) The final map shall be submitted for approval within one
year from the final action by the City Council on the
tentative subdivision map. The final map shall be in
substantial conformance of the tentative subdivision map
known as Exhibit A, dated 7-1-74.
(2) The development of the property described herein which are
in addition to all the requirements, limitations and
restrictions of all municipal ordinance and State and
Federal statutes now in force, or which, hereafter, may
be in force for the purpose of preserving the residential
characteristics of adjacent properties.
(3) All public improvements shall be made in conformity to
the City of Carlsbad Engineering Design Criteria and
Standard Plans, the Subdivision Ordinance and other
City Standards, to the satisfaction of the City Engineer,
without cost to the City of Carlsbad, and free of all
liens and encumbrances. Improvement plans for water
and sewer systems shall meet the requirements of the
respective service districts.
(4) All land and/or easements required by this Ordinance
shall be granted to the City of Carlsbad without cost
to the City and free of all liens and encumbrances.
No easements shall be recorded prior to recordation of
the Final Map unless approved by the City Engineer.
(5) All utilities, inciluding provisions for cable TV, shall
be placed underground and/or shall be completely
concealed from view.
(6) All drainage and flood control facilities shall be approved
by the Coufcty of San Diego Flood Control District prior
to installation.
(7) Ornamental street lighting shall be provided for as
required by Municipal Ordinance Code. The developer
shall post a bond and/or cash in the amount necessary
to energize said street lights for an eighteen month
period after construction, to permit the incorporation
of the subdivision into a maintenance district. This
shall be done prior to approval of final map.
(8) The improvement plans shall include a report of a
geological investigation and a complete grading p^an
of the entire site when required by the City Engineer.
The report and plan shall be prepared by Civil Engineers
licensed by the State of California, and experienced in
erosion control. Said Engineer shall certify that they
have investigated the site and prepared data with full
consideration of the consequences to the included and
neighboring properties and conform to the standards of
the Geological Safety Element of the General Plan.
(9) All slopes created as a result of this development shall
not exceed a 2:1 slope.
(10) Ingress and egress along the property line bordering
public street right of way for all lots shall be
dedicated, except at location as specified by the City
Engineer. Dedication shall be made prior to approval
of final map.
(11) If requested by the City Engineer, an amended tentative
map shall be submitted Cor approval by the City Engineer
prior to preparation of the Final Map to assure compli-
ance to all conditions of approval.

(12) In order to provide for reasonable fire protection
during the construction period, the subdivider shall
maintain passable vehicular access to all buildings
and adequate fire hydrants with required fire flows
and dry-stand pipes shall be installed prior to
framing construction.
(13) Street trees, when required by the City, shall be
installed by the applicant at his expense. Trees
shall be of a type approved by the Parks Department
and shall be installed to their specifications. If
removal of any existing trees is required by the City,
said removal shall be at the applicant's expense. It
shall be the responsibility of the applicant to make
all arrangements with the Parks Department concerning
the requirements of this condition. These arrangements
are to be made prior to approval of the final map.
(14) Street names shall be subject to approval and shall
be designated in accordance with the standards and
policies adopted by the Planning Commission on file
in the Planning Department. Said names shall be approv-
ed by the Planning Director prior to approval of the
Final Map.
(15) The C.C. & R's for this development shall be submitted
to the Planning Director for review and approval prior
to the approval of final map.
(16) Property line return radii at Monroe Street Intersections
shall be 25'.
(17) The developer shall participate in traffic signal
installations at Hosp Way and El Camino Real, Monroe Street
and Marron Road, and Elm Avenue and Monroe Street as
determined by any future policy of the City Council
(18) Lots 136 and 140 shall be dedicated in fee title to the
City of Carlsbad prior to approval of the final map.
(19) An Open Space Easement granted to the City of Carlsbad
over lot 148 prior to approval of the final map.
(20) Lots 136, 140 and 148 shall be reaoned to 0-S (Open Space)
zone prior to approval of the final map.
(21) Hosp Way, as shown on the approved Hosp Grove Master Plan,
shall be fully completed prior to occupancy of the first
unit of development.
III. ENVIRONMENTAL IMPACT REQUIREMEHTS: An EIR was processed and
accepted for the entire Hosp trove Master Plan in April, 1973.
The Buena Woods III project was Included in tins EIR. The
applicant has provided supplemental information which Staff
believes is adequate in discussing impacts of this specific
project.

V. PARKS ORDINANCE REQUIREMENTS: The applicant is dedicating
12.70 acres of the site to the City of Carlsbad for Park
purposes. Based on the Parks Ordinance requirements, about
0.75 acres is actually required for dedication. The Park
configuration as shown on the Buena Woods III Plot Plan is
based on the Master Plan committment for parks. The Park
system, as proposed, meets with the approval of the Parks
Department.
Lot 140 is .intended to be developed as a public open air
theatre. The connecting corridor between the amphitheatr
and City Park Corridor (lot 136) will be used for public
parking, and future parking expansion, should it be needed

E. Projected Population: 500
F. Circulation: Five alternate street sections for Monroe
Street labelled Exhibit C have been attached to this
report. The Planning believes that a landscaped median
with no onstreet parking, as represented in Alternate
"C" is desirable for several reasons:
1) The median will break up the mass of the road,
making it more compatible with the residential area it
abuts.
2) The landscaped median at a 20' width will greatly
reduce the potential for head on and cross-over
col 1isions.
3) The median can be broken at controlled intervals in
order to facilitate left turn movements.
4) Illegal U-Turns can be controlled by the median.
5) There is not normally a demand for onstreet parking
on Monroe because it is,not accessible to the Buena
Woods III Units. Elimination of on-street parking is
desirable on arterials because of the higher traffic
speeds, which increase the potential for accidents from
parked vehicles merging into traffic. Should special
events at the Amphitheatre require additional parking,
the right northbound lane could, with adequate Police
control, be converted to temporary parking.
6) The pathways in the common area bordering Hosp Way
and the City Park paralleling Monroe, are to be
built to standards which would accomodate bike traffic.
This separate lane is the best means for accomodating
bike traffic because it separates bicyclists from
the higher speed vehicular traffic on Monroe, and has a
lesser grade which can be more easily negotiated by
bicyclists.
The City Engineer has traditionally opted for Alter-
nate E for 104' street sections primarily because it
eliminates landscape maintenance costs. However,
staff believes that these costs can be reduced through
selection of low maintenance ground cover, bush and
small tree varieties. '
Staff would like the Commission to choose a Monroe
Street section for recommendation to the City Council.
An appropriate condition will be added to the
Planning Commission Resolution. /•?-
G- Parking: The applicant is proposing a two car garage for
each unit (with potential for tandem parking in driveways)
and guest parking at a ratio of .53 spaces per unit. Staff
is recommending a condition (No. 15 to SP-160) which would
allow enforcement of a no-parking restriction on all
private residential streets.

I wish to appear at the September 24-, 1974., Planning
Commission meeting to oppose the Specific Plan for the
Buena Yu'oods #3 housing development.
The reasons for opposing this Specific Plan are as follows:
1. The Hosp Grove is a natviral park area and should be
preserved for public park and recreational use.
2. The proposed development will require destruction of
trees auu will have an adverse environmental impact
on the area.
3. The proposed development will have an adverse impact
on public schools and other public services.
A. The proposed development does not conform to the density
requirements of the General Plan.

PLAN TO ALLOW A 135-UNIT DEVELOPMENT ON A 43.2
ACRE SITE, ZONED P-C, LOCATED ON THE EAST SIDE OF
CREST DRIVE BETWEEN ELM AVENUE AND EUCALYPTUS
AVENUE. CASE NO. SP-160, APPLICANT: KAMAR
CONSTRUCTION COMPANY
WHEREAS, a verified application for a certain property, to wit:v
Those portions of Lots 3, 4, 5, 6, 7, 26 and 27, and of
Canon Street is Hosp Eucalyptus Forest Co.'s Tract No. 1
in the City of Carlsbad, County of San Diego, State of
California, according to Map thereof No. 1136 filed in
the office of the San Diego County Recorder June 8, 1908,
has been filed with the City of Carlsbad and referred to the Planning
Commission; and
WHEREAS, said verified application constitutes a request as provided by
Title 21 of the "Carlsbad Municipal Code"; and
WHEREAS, the public hearing was held at the time and in the place
specified in said notice on October 22, 1974; and
WHEREAS, the applicant has complied with the Public Facility Policy of
the City of Carlsbad and has provided the necessary information which insures
Public Facilities will be available and current with need; and
WHEREAS, the subject application has complied with the requirements of
the City of Carlsbad "Environmental Protection Ordinance of 1972"; and
WHEREAS, at said public hearing, upon hearing and considering the
testimony and arguments, if any, of all persons who desired to be heard,
said Commission considered all factors relating to the Specific Plan and
found the following facts and reasons to exist:

Pathways in lots 136 and 148 shall be a minimum of 8' in width and
shall be improved with asphaltic concrete to the satisfaction of the
City Engineer. These pathways shall have a maximum grade of 7%.
Utilities shall be supplied to the Park Site to the satisfaction of
the City Engineer and Parks Director.
The applicant, by written agreement and according to procedures set
forth in the California Vehicle Code, shall consent to enforcement
of parking restrictions on all private drives within the develop-
ment.
No phasing of the project shall occur unless an amendment to this
specific plan is filed with plans for extending roads and services
to adequately serve each increment of development.
On City Park Lots #136 and 140, all street improvements, parking and
public recreation improvements (such as an open air theatre and
picnic area) as deemed necessary by the Parks Director and City
Engineer are approved as a part of this Specific Plan.
Prior to issuance of building permits, the applicant shall remove
debris and litter and thin groves on lots 136, 140 and 148. The
Parks Department shall determine which trees should be removed.
This Specific Plan shall expire if construction is not commenced by
January 1, 1979.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Carlsbad

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF CARLSBAD, CALIFORNIA, CONCERNING THE TENTATIVE
MAP TO ALLOW THE DEVELOPMENT OF 135 UNITS ON A 43.2
ACRE SITE, ZONED P-C, LOCATED ON THE EAST SIDE OF
CREST DRIVE BETWEEN ELM AVENUE AND EUCALYPTUS AVENUE.
CASE NO. CT 74-13, APPLICANT: KAMAR CONSTRUCTION
COMPANY
WHEREAS, a verified application for a certain property, to wit:
Those portions of Lots 3, 4, 5, 6, 7, 26 and 27, and of
Canon Street is Hosp Eucalyptus Forest Co.'s Tract No. 1
in the City of Carlsbad, County of San Diego, State of
California, according to Map thereof No. 1136 filed in
the office of the San Diego County Recorder June 8, 1908,
has been filed with the City of Carlsbad and referred to the Planning
Commission; and
WHEREAS, said verified application constitutes a request as provided by
Title 21 of the "Carlsbad Municipal Code"; and
WHEREAS, the applicant has complied with the Public Facility Policy of
the City of Carlsbad and has provided the necessary information which insures
Public Facilities will be available and current with need; and
WHEREAS, the subject application has complied with the requirements of
the City of Carlsbad "Environmental Protection Ordinance of 1972"; and
WHEREAS, said Commission considered all factors relating to the Tentative
Map and found the following facts and reasons to exist:
1. The requested use conforms to the adopted General Plan.
2. The requested use complies with requirements of the Subdivision Map
Act.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Carlsbad, California, as follows: That a Tentative Map is approved for use of
said property to allow a 135-unit development on a 43.2 acre site, zoned
P-C, located on the east side of Crest Drive between Elm Avenue and
Eucalyptus Avenue, and subject to the following conditions:
1. The final map shall be submitted for approval within one year from
the final action by the City Council on the tentative subdivision
map. The final map shall be in substantial conformance of the
tentative subdivision map known as Exhibit A, dated 7-1-74.

The development of the property described herein which are in
addition to all the requirements, limitations and restrictions of
all municipal ordinance and State and Federal statutes now in force,
or which, hereafter, may be in force for the purpose of preserving
the residential characteristics of adjacent properties.
All public improvements shall be made in conformity to the City of
Carlsbad Engineering Design Criteria and Standard Plans, the Sub-
division Ordinance and other City Standards, to the satisfaction
of the City Engineer, without cost to the City of Carlsbad, and
free of all liens and encumbrances. Improvement plans for water
and sewer systems shall meet the requirements of the respective
service districts. x
All land and/or easements required by this Ordinance shall be
granted to the City of Carlsbad without cost to the City and free
of all liens and encumbrances. No easements shall be recorded prior
to recordation of the Final Map unless approved by the City
Engineer.
All utilities, including provisions for cable TV, shall be placed
underground and/or shall be completely concealed from view.
Ornamental street lighting shall be provided for as required by
Municipal Ordinance Code. The developer shall post a bond and/or
cash in the amount necessary to energize said street lights for an
eighteen month period after construction, to permit the incorpora-
tion of the subdivision into a maintenance district. This shall
be done prior to approval of final map.
The improvement plans shall include a report of a geological investi
gation and a complete grading plan of the entire site when required
by th& City Engineer.. The. report and-plan sha-11 be prepared by
Civil Engineers licensed by the State of California, and experienced
in erosion control. Said Engineer shall certify that they have
investigated the site and prepared data with full consideration
of the consequences to the included and neighboring properties and
conform to the standards of the Geological Safety Element of the
General Plan.
All slopes created as a result of this development shall not exceed
a 2:1 slope.
Ingress and egress along the property line bordering public street
right of way for all lots shall be dedicated, except at location as
specified by the City Engineer. Dedication shall be made prior to
approval of final map.
If requested by the City Engineer, an amended tentative map shall be
submitted for approval by the City Engineer prior to preparation of
the Final Map to assure compliance to all conditions of approval.
In order to provide for reasonable fire protection during the con-
struction period, the subdivider shall maintain passable vehicular
access to all buildings and adequate fire hydrants with required
fire flows and dry-stand pipes shall be installed prior to framing
construction.
Street trees, when required by the City, shall be installed fay the
applicant at his expense. Trees shall be of a type approved by the
Parks Department and shall be installed to their specifications. If
removal of any existing trees is required by the City, said removal
shall be at the applicant's expense. It shall be the responsibility

of the applicant to make all arrangements with the Parks Department
concerning the requirements of this condition. These arrangements
are to be made prior to approval of the final map.
13. Street names shall be subject to approval and shall be designated in
accordance with the standards and policies adopted by the Planning
Commission on file in the Planning Department. Said names shall be
approved by the Planning Director prior to approval of the final
map.
14. The C.C. & R's for this development shall be submitted to the
Planning Director for review and approval prior to the approval of
final map.
15. Property line return radii at Monroe Street intersections shall be
25'.
16. The developer shall participate in traffic signal installations at
Hosp Way and El Camino Real, Monroe Street and Marron Road, and
Elm Avenue and Monroe Street as determined by any future policy of
the City Council.
17. Lots 136 and 140 shall be dedicated in fee title to the City of
Carlsbad prior to approval of the final map.
18. An Open Space Easement granted to the City of Carlsbad over lot 148
concurrent with recordation of the final map.
19. Lots 136, 140 and 148 shall be rezoned to 0-S (Open Space) zone
prior to approval of the final map.
20. Hosp Way, as shown on the approved Hosp Grove Master Plan, shall be
fully completed prior to occupancy of the first unit of development.
