'Statement of the Matter
The City Council at your meeting of November 19 , 1974, directed the City
Attorney to prepare the necessary documents granting a preannexation
change of zone from San Diego County E-l-A to RD-M ajid C-l. The resolu-
tion granting the zone change is attached, and the ordinance adopting
the change of zone is attached.

Staff Recommendations
If the Council desires to grant the preannexation change of- zone, your
action is to adopt Resolution No.3^^TI , and introduce Ordinance No.
AB No. 2225—- Supplement 1 Date: December 3, 1974
City Manager's Recommendation
Concur with staff recommendation.
Council Action
12-3-74 Resolution #3551 was adopted, announcing findings and decision,
and Ordinance #9410 was introduced for a first reading, granting
a zone change.
12-17-74 Ordinance No. 9410, was given a second reading and adopted.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING
FINDINGS AND DECISION ON A PREANNEXATION
CHANGE OF ZONE FROM SAN DIEGO COUNTY
E-l-A TO RD-M (RESIDENTIAL DENSITY-
MULTIPLE ZONE) AND C-l (NEIGHBORHOOD
COMMERCIAL ZONE) ON 16.5 ACRES TO ALLOW
CONSTRUCTION OF A NEIGHBORHOOD COMMERCIAL
AND APARTMENT COMPLEX ON PROPERTY LOCATED
AT THE NORTHEAST CORNER OF ALGA ROAD AND
EL CAMINO REAL. APPLICANT: CAL PACIFIC
PROPERTIES .
WHEREAS, on October 22, 1974 a duly advertised public
hearing was held before the Planning Commission in the manner
prescribed by law to consider a preannexation change of zone from
San Diego County E-l-A to RD-M (residential density-multiple zone)
and C-l (neighborhood commercial zone) as shown on the map marked
ZC-149, Exhibit A, dated October 8, 1974, on file in the Planning
Department and incorporated by reference herein, on property lo-
cated at the northeast corner of Alga Road and El Camino Real,
more particularly described as:
Parcel B - A 4.978-acre parcel in San Diego County
located in the West one-half of the Northeast one-
fourth of Section 26, Township 12 South, Range 4 West
(to be zoned RD-M) .
Parcel C - A 5.500-acre parcel in San Diego County
located in the West one-half of the Northeast one-
fourth of Section 26, Township 12 South, Range 4
West- (to be zoned RD-M) .
Parcel D - A 6.001-acre parcel in San Diego County
located in the West one-half of the Northeast one-
fourth of Section 26, Township 12 South, Range 4
West- (to be zoned C-l) .
WHEREAS, at the conclusion of said hearing the Planning
Commission of the City of Carlsbad adopted Resolution No. 1106
recommending said zone change which is herewith referred to and
made a part hereof; and
WHEREAS, on the 19th day of November, 1974, the City
Council held a public hearing on the matter, received all recom-
mendations and heard all persons interested in or opposed to the
proposed change of zone; and

WHEREAS, the Planning Director has determined that said
change of zone will have a nonsignificant impact on the environ-
ment and a negative declaration has been prepared and filed in
satisfaction of the requirements of the City of Carlsbad Environ-
mental Protection Ordinance of 1972 and the California Environment
al Quality Act;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the findings of the Planning Commission contained
in the aforementioned Resolution No. 1106 constitute the findings
of the Carlsbad City Council.
3. That the approval of the proposed preannexation change
of zone classification is necessary to carry out the general pur-
pose of Title 21 of the Municipal Code.
4. That the City Council of the City of Carlsbad intends
to adopt an ordinance to effectuate the proposed preannexation
change of zone.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 3rd day of December , 1974,
by the following vote, to wit:
AYES: Councilmen Frazee, Chase, Lewis, McComas and Skotnick

TITLE 21 OF THE CARLSBAD MUNICIPAL CODE
BY AMENDING THE ZONING MAP TO GRANT A
PREANNEXATION CHANGE OF ZONE FROM SAN DIEGO
COUNTY E-l-A TO RD-M (RESIDENTIAL DENSITY-
MULTIPLE ZONE) AND C-l (NEIGHBORHOOD
COMMERCIAL ZONE) ON 16.5 ACRES TO ALLOW
CONSTRUCTION OF A NEIGHBORHOOD COMMERCIAL
AND APARTMENT COMPLEX ON PROPERTY LOCATED
AT THE NORTHEAST CORNER OF ALGA ROAD AND
EL CAMINO REAL. APPLICANT: CAL PACIFIC
PROPERTIES
The City Council of the City of Carlsbad, California
does ordain as follows:
SECTION 1: Title 21 of the Carlsbad Municipal Code is
amended by the amendment of the zoning map preannexation change
of zone from San Diego County E-l-A to RD-M (residential density-
multiple zone) for the following described property:
Parcel B - A 4.978-acre parcel in San Diego County
located in the West one-half of the Northeast one-
.fourth of Section 26, Township 12 South, Range 4
West (to be zoned RD-M).
Parcel C - A 5.500-acre parcel in San Diego County
located in the West one-half of the Northeast one-
fourth of Section 26, Township 12 South, Range 4
West (to be zoned RD-M).
SECTION 2: Title 21 of the Carlsbad Municipal Code is
amended by the amendment of the zoning Map preannexation change
of zone from San Diego County E-l-A to C-l (neighborhood commer-
cial zone)for the following described property:
Parcel D - A 6.001-acre parcel in San Diego County
located in the West one-half of the Northeast one-
fourth of Section 26, Township 12 South, Range 4
West (to be zoned C-l).
EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal within fifteen days after its adop-
tion.
