'Statement of the Matter
The' City Council at your meeting of November 19, 1974, directed the City
Attorney to prepare the necessary documents adopting Specific Plan (SP-160)-
and approving Tentative Map (CT 74-13) . The Ordinance adopting the
Specific Plan and the Resolution approving the Tentative Map are attached.

AN ORDINANCE OF THE CITY COUNCIL OF THF
CITY OF CARLSBAD, CALIFORNIA ADOPTING A
SPECIFIC PLAN (SP-160) FOR A 135-UNIT
DEVELOPMENT ON 43.2 ACRES LOCATED ON THE
EAST SIDE OF CREST DRIVE BETWEEN ELM
AVENUE AND EUCALYPTUS AVENUE.
APPLICANT: KAMAR CONSTRUCTION CO.
The City Council of the City of Carlsbad, California
does ordain as follows:
SECTION 1; A Specific Plan (SP-160) is hereby adopted
for development of 135 units on 43.2 acres of land located on the
east side of Crest Drive between Elm Avenue and Eucalyptus Avenue,
more particularly described as:
Those portions of Lots 3, 4, 5, 6, 7, 26 and 27, and
of Canon Street is Hosp Eucalyptus Forest Co.'s
Tract No. 1 in the City of Carlsbad, County of
San Diego, State of California, according to
Map No. 1136 filed in the office of the San Diego
County Recorder June 8, 1908,
said plan to consist of a plot plan marked Exhibit A to SP-160,
revised October 8, 1974, and an application with attachments on
file in the office of the City Planning Department and incorpor-
ated by reference herein, subject to all terms and conditions of
this ordinance.
SECTION 2; Findings. The approval of Specific Plan
(SP-160) is justified by the following findings:
A. Conformance of the revised Specific Plan to the ap-
proved Master Plan and to the General Plan.
B. Conformance of the revised Specific Plan to all re-
quirements of the Municipal Code requirements applicable to prop-
erty located in the Planned Community Zone.
C. Conformance of the precise development to the existing
and proposed development in the area.
SECTION 3; Development Conditions. The Specific Plan
(SP-160) is approved subject to the following conditions and
restrictions and the development of the property, as described in

Section 1 hereof, shall be subject to'all such conditions and
restrictions which are in addition to all requirements, limita-
tions and restrictions of all municipal ordinances and state and
federal laws now in force or which may hereafter be in force:
1. The approval is granted for the land described in
the application and any attachments thereto, and as shown
on the plot plan submitted labeled Exhibit A. The loca-
tion of all buildings, fences, signs, roadways, parking
areas, landscaping and other facilities or features shall
be located substantially as shown on the plot plan labeled
Exhibit A, except or unless indicated otherwise herein.
All buildings and structures shall be of the design as
shown on the elevation plans labeled Exhibit B. Exhibits
on file in the Planning Department.
2. Unless the construction of the structure or
facility is commenced not later than two years after the
date the approval is granted and is diligently pursued
thereafter, this approval will automatically become null
and void.
3. All requirements of any law, ordinance or regula-
tion of the State of California, City of Carlsbad, and any
other governmental entity shall be complied with.
4. All areas shown as parking areas shall be surfaced
with asphaltic concrete and shall be visibly marked out-
lining individual parking spaces and traffic flow. Said
surfacing and marking shall be completed prior to final
inspection of the structure or structures by the Building
Department. The surface shall be kept in a reasonably
good state of repair at all times.
5. All outside storage areas shall be screened from
adjacent property and streets.
6. Interior landscaping of parking areas shall be
provided in a manner acceptable to the Planning Director.
Said minimum area of landscaping shall be equivalent to
3% of the area of the lot excluding required perimeter
landscaping.
7. A detailed landscape and sprinkler plan prepared
by a landscape architect shall be submitted to the Plan-
ning Director for consideration and approval.
8. Prior to final building inspection clearance,
all landscaping shall be installed. Said landscaping
shall at all times be maintained in a manner acceptable
to the Planning Director.
9. All utilities, including electrical, telephone and
cable television, shall be installed underground and/or
shall be completely concealed from view.
10. There shall be no ingress or egress to the prop-
erty except for those shown on the plot plan labeled
Exhibit A, on file in the Planning Department, and as
approved by the City Engineer.

11. Street trees, as required by the City, shall be
installed by the applicant at his expense. Trees shall
be of a type approved by the Parks Departme.nt and shall
be installed to their specifications. If removal of any
existing trees is required by the City, said removal shall
be at the applicant's expense. It shall be the respon-
sibility of the applicant to make all arrangements with
the Parks Department concerning the requirements of this
condition.
12. Prior to final occupancy, compliance with and
execution of all conditions listed hereon shall be neces-
sary unless otherwise specified. Deviation from this
requirement shall be permitted only by written consent of
the Planning Director.
13. Pathways in Lots 136 and 148 shall be a minimum
of 8 feet in width and shall be improved with asphaltic
concrete to the satisfaction of the City Engineer. These
pathways shall have a maximum grade of 7%.
14. Utilities shall be supplied to the park site to
the satisfaction of the City Engineer and Parks Director.
15. The applicant, by written agreement and according
to procedures set forth in the California Vehicle Code,
shall consent to enforcement of parking restrictions on
all private drives within the development.
16. No phasing of the project shall occur unless an
amendment to this specific plan is filed with plans for
extending roads and services to adequately serve each
increment of development.
17. On City Park Lots 136 and 140 all street improve-
ments, parking and public recreation improvements (such
as an open air theatre and picnic area) as deemed necessary
by the Parks Director and City Engineer are approved as a
part of this specific plan.
18. Prior to issuance of building permits, the appli-
cant shall remove debris and litter and thin groves on
Lots 136, 140 and 148. The Parks Department shall deter-
mine which trees should be removed.
19. This specific plan shall expire if construction is
not completed by January 1, 1979.
SECTION 4; Administration and Enforcement. The Building
Department shall not approve any building for occupancy until the
Planning Director has certified that all the conditions of this
ordinance have been satisfied.
EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal within fifteen days after its

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
WITH CONDITIONS TENTATIVE MAP (CT 74-13)
FOR A 135-UNIT DEVELOPMENT ON 43.2 ACRES
LOCATED ON THE EAST SIDE OF CREST DRIVE
BETWEEN ELM AVENUE AND EUCALYPTUS AVENUE.
APPLICANT: KAMAR CONSTRUCTION CO.
WHEREAS, on October 22, 1974, the Carlsbad City Planning
Commission adopted Resolution No. 1109 recommending to the City
Council that Tentative Map (CT 74-13) be conditionally approved;
and
WHEREAS, the City Council of the City of Carlsbad, on the
19th day of November • 1974, considered the recommendation
of the Planning Commission; and
WHEREAS, said Tentative Map has been declared to have a
nonsignificant impact on the environment and a Negative Declaratior
has been prepared and filed in compliance with the requirements of
the City of Carlsbad Environmental Protection Ordinance of 1972;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
A. That the above recitations are true and correct.
B. That Tentative Map (CT 74-13) is hereby approved sub-
ject to all applicable requirements of the Carlsbad Municipal
Code and to the satisfaction of the following conditions.
1. The final map shall be submitted for approval
within one year from the final action by the City Council
on the tentative subdivision map. The final map shall be
in substantial conformance of the tentative subdivision
map known as Exhibit A dated July 1, 1974.
2. The development of the property described herein
which is in addition to all the requirements, limitations
and restrictions of all municipal ordinances and State
and federal statutes now in force, or which hereafter may
be in force for the purpose of preserving the residential
characteristics of adjacent properties.
3. All public improvements shall be made in conform-
ity to the City of Carlsbad Engineering Design Criteria
ar-1 Standard Plans, the Subdivision Ordinance and other
City standards to the satisfaction of the City Engineer,
without cost to the City of Carlsbad and free of all liens

and encumbrances. Improvement plans for water and sewer
systems shall meet the requirements of the City of Carls-
bad.
4. All land and/or easements required by this ordi-
nance shall be granted to the City of Carlsbad without
cost to the City and free of all liens and encumbrances.
No easements shall be recorded prior to recqrdation of
'the final map unless approved by the City Engineer.
5.. All utilities, including provisions for cable TV,
shall be placed underground and/or shall be completely
concealed from view.
6. All drainage and flood control facilities shall
be approved by the City Engineer prior to installation.
7. Ornamental street lighting shall be provided for
as required by Municipal Code. The developer shall post
a bond and/or cash in the amount necessary to energize
said street lights for an 18-month period after construc-
tion to permit the incorporation of the subdivision into
a maintenance district. This shall be done prior to
approval of final map.
8. The improvement plans shall include a report of a
geological investigation and a complete grading plan of
the entire site when.required by the City Engineer. The
report and plan shall be prepared by civil engineers
licensed by the State of California and experienced in
erosion control. Said engineers shall certify that they
he.ve investigated the site a".cl prepared data with full
consideration of the consequences to the included and
neighboring properties and conform to the standards of the
Geological Safety Element of the General Plan.
9. All slopes created as a result of this develop-
ment shall not exceed a 2:1 slope.
10. Ingress and egress along the property line border
ing public street right-of-way for all lots shall be dedi-
cated, except at locations as specified by the City Engi-
neer. Dedication shall be made prior to approval of final
map.
11. If requested by the City Engineer, an amended
tentative map shall be submitted for approval by the City
Engineer prior to preparation of the final map to assure
compliance to all conditions of approval.
12. In order to provide for reasonable fire protec-
tion during the construction period, the subdivider shall
maintain passable vehicular access to all buildings and
adequate fire hydrants with required fire flows,and dry-
stand pipes shall be installed prior to framing construc-
tion .
13. Street trees, when required by the City, shall be
installed by the applicant at his expense. Trees shall
be of a type approved by the Parks Department and shall
be installed to their specifications. If removal of any
existing trees is required by the City, said removal shall
be at the applicant's expense. It shall be the respon-
sibility of the applicant to make all arrangements with
the Parks Department concerning the requirements of this-

condition. These arrangements are to be made prior to
approval of the final map.
14. Street names shall be subject to approval and
shall be designated in accordance with the standards and
policies adopted by the Planning Commission on file in
the Planning Department. Said names shall be approved
by the Planning Director prior to approval of the final
map.
15. The CCSR's for this development shall be submittec
to the Planning Director for review and approval prior to
the approval of final map.
16. Property line return radii at Monroe Street inter-
sections shall be 25 feet.
17. The developer shall participate in traffic signal
installations at Hosp Way and El Camino Real, Monroe Street
and Marron Road, and Elm Avenue and Monroe Street as
determined by any future policy of the City Council.
18. Lots 136 and 140 shall be dedicated in fee title
to the City of Carlsbad prior to approval of the final map
19. An Open Space easement granted to the City of
Carlsbad over Lot 148 concurrent with recordation of the
. final map.
20. Lots 136, 140 and 148 shall be rezoned to O-S
(Open Space) zone .prior to approval of the final map.
21.. Hosp Way, as shown on the approved Hosp Grove
Master Plan, shall be fully completed prior to occupancy
of the first unit of development.
22. The street section for Monroe Street may vary
from the 84-foot standard to provide for a varied location
for parking and a landscaped median to the satisfaction
of City Engineer.
C. That said Tentative Map, together with the provisions
for its design, and improvement and subject to the above condi-
tions, is consistent with all applicable general and specific
plans of the City of Carlsbad.
