Addition of Chapter 20.22. Submitted By : Public Works Administrator Statement of the Matter Chapter 20.20 of the Carlsbad Municipal Code, regarding parcel splits, does not presently distinguish between normal parcel splitting and simple lot consolidations or property boundary adjustments. This procedure is introduced as a separate chapter of Title 20 of the Municipal Code. Exhibit 1. The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1: That Title 20 of the Carlsbad Municipal Code is hereby amended by the addition of Chapter 20.22 to read as follows: "Chapter 20.22 ADJUSTMENT PLATS Sections: 20.22.010 Purpose of chapter. 20.22.020 Applicability. 20.22.030 Application. 20.22.040 Approval. 20.22.050 Revised adjustment plat. 20.22.060 Conditions of approval. .20.22.070 Certification. 20.22.010 Purpose of chapter. The purpose of this chap- ter is to provide a simplified procedure for the adjustment of property boundaries where no additional lots or parcels will result and where standard public improvements are available. 20.22.020 Applicability. Notwithstanding any other pro- vision of this title to the contrary, the procedure set forth in this chapter shall govern the processing of and requirements for adjustment plats. An adjustment plat may be filed in accord with the provisions of this chapter to adjust the boundaries between two, three or four lots provided the City Engineer deter- mines that the boundary adjustment does not: (1) Create additional lots. (2) Include a lot created illegally. (3) Impair any existing access or create a need for a new access to any adjacent lot. (4) Impair any existing easement or create a need for a new easement. (5) Violate zoning requirements. (6) Alter the city limit boundary. (7) Require substantial alterations of existing public improvements or create a need for new public improvements. 20.22.030 Application. An application for approval of an adjustment plat shall be filed with the City Engineer accompanied by such information as the City Engineer may require and by a fee of $50.00 which will not be refundable. The application shall also be accompanied by an adjustment plat of a size and form pre- scribed by the City Engineer which shall bear the signature of the owners of the property involved and by a title report for said VINCENT F. After an application for approval of an adjustment plat has been filed in accord with this chapter, the City Engineer may approve, conditionally approve or disapprove such plat. The applicant shall be notified in writing of the City Engineer's action. 20.22.050 Revised adjustment plat. A revised adjustment plat shall be submitted for approval when the City Engineering finds that the number or nature of any changes necessary for approval are such that they cannot be shown clearly or simply on the ori- ginal adjustment plat. When required, the failure to file a revised adjustment plat within six months from the date of the conditional approval of the original plat shall terminate all proceedings. 20.22.060 Conditions of approval. The City Engineer may impose conditions of approval to be satisfied prior to recorda- tion of the adjustment plat as he finds necessary to insure that the boundary adjustments involved are in full compliance with all applicable sections of the Carlsbad Municipal Code. 20.22.070 Certification. If the City Engineer determines that the adjustment plat meets all the requirements of the Municipal Code and that any conditions imposed have been satisfied, he shall certify on the adjustment , plat that it has been approved pursuant to this chapter, notify the Planning Department, and file it in the Public Works Department. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council held on the 3rd day of December, 1974, and there- after PASSED AND ADOPTED at a regular meeting of said Council held on the 17th day of December, 1974, by the following vote, to wit: AYES: Councilmen Frazee, Chase, McComas and Skotn.i.cki .
