SUBJECT: MORATORIUM ON THE COMMERCIAL DEVELOPMENT IN THE
ROOSEVELT STREET STUDY AREA
City Council, on August 20, 1974, adopted Ordinance #9403 which
places a moratorium on the Roosevelt Street Study area, (see
attached Exhibit A for boundary of study area)
The instruction given by the Council on August 14, 1974 during the
Land Use Element hearing was to insure that the proposed General
Plan conformed to the existing zone (C-2) and additionally that
the staff be instructed to prepare a schedule for the development
of a Specific Plan for the Downtown which would include the sub-
ject properties. Ordinance #9403 states that City does not have
satisfactory zoning tools to accomplish the proposed combination
district designated 0-N (Professional and related Commercial).
The staff has developed a work program to insure General Plan and
Zoning consistency and is also in the process of developing a
Spectfic Plan of the downtown as outlined in the Land Use Element.
Tfie Spectfic Plan program is contemplating the use of Federal and
State funds as implementing tools for Planning and Improvements,
therefore, a Specific Plan and the appropriate zoning tools have
not yet been completed.
It is recommended that the moratorium on commercial development in
the Roosevelt Street Study Area be extended for eight additional
months to August 20, 1975. City Council must approve the interim
ordinance extension for eight months by a 4/5ths vote. The staff
will have a Specific Plan and Ordinance to implement such Specific
Plan by that date.

ORDINANCE NO.
AN INTERIM ORDINANCE OF THE CITY COUNCIL
OF THS CITY OF CARLSBAD, CALIFORNIA,
ADOPTED AS AN URGENCY MEASURE PROHIBITING
COMMERCIAL DEVELOPMENT IN THE ROOSEVELT
STREET STUDY AREA.
WHEREAS, the Planning Commission has recommended to the
City Council as part of. the General Plan revision a special treat-
ment area designated 0/.1 for the Roosevelt Street Study Area, as
shown on the map marked Exhibit A attached hereto and incorporated
by reference herein; and
WHEREAS, the City at this time does not have an approp-
riate zone to implement the provisions of said General Plan desig-
nation; and
WHEREAS, it may be necessary in order to assure consis-
tency between the applicable zoning in the area and the General
Plan to defer including the Planning Commission's recommendation
in the General Plan revision until such time as the Planning De-
partment has completed a study of the area and has developed ap-
propriate zoning tools to accomplish the objectives called out
in the proposed 0/N designation; and
WHEREAS, the City Council has determined that it is neces-
sary in order to protect the public safety, health and welfare to
adopt as an urgency measure an interim ordinance prohibiting any
uses which may be in conflict with the contemplated '0/N zoning
and General Plan designations; .
NOW, THEREFORE, BE IT ORDAINED by the City Council of the
City-of Carlsbad, California, as follows:
SECTION 1; That all commercial-development in that area
of the City of Carlsbad identified as the Roosevelt Street Study
Area, and more particularly described in Exhibit A hereto, is
hereby prohibited. .

the Carlsbad Journal within fifteen days after its adoption..

ROLL CALL:
Mayor Frazee reminded the Council of up-coming
committee appointments for the Senior Citizens Committe
Airport Committee, Bicycle Committee and the Water
Committee. Mayor Frazee recommended JERRY McCLELLAN be
considered for the Airport Committee and invited the
other Council members to submit _their recommendations.
Councilman Skotnicki requested that ROBERT CHANEY
be considered for the Seismic Safety and Geologic
Hazards Committee.

The Planning Director reviewed each of the
following items, both as to Council recommendations
and Planning Commission consideration and the Council
took formal action on each of the items as described
below:
RLM Density: The Council appro-ved RLM Density
of 0-4 D/U per acre and asked that the clarifying
sentence "In those exceptional cases where the base
zone is consistent with the land use designation but
would permit a slightly higher yield than that recom-
mended in the low and low-medium density residential
classifications, the City may find that the project is
consistent with this element if it is compatible with
the objectives, policies, general land uses and progranjs
expressed herein and does not exceed twenty-five(25)
pe'rcent of the maximum allocation," be added to the
Land Use Element text.
Stone Request. The Council approved the "RMH"
designation that stops on the north side of Chestnut
Avenue to be continued southerly to Palm Avenue.
Savage Request: Mr. William Savage, property
owner, addressed the Council previous to Council dis-
cussion and action.
The Council approved "RMH" designation (10-16
D/U per acre) for the Savage property lying north of
Batiquitos Lagoon and east of Interstate 5.
North Pio Pico: The Council approved a desig-
nation of Professional and Related Commercial on the
area along the easterly side of Pio Pico Drive with
all access to be taken from Pio Pico Drive.
Rinker Request: Mr. George Coopman, represent-
ing the Rinker and Vanderburg properties, addressed th<
Council previous to Council discussion and action.
The Council approved a land use designation on
the subject properties as being: northerly portion as
"Community Commercial - 60%, or approximately 820 feet,
and "Professional and Related Commercial" on the
remaining 40*, or approximately 550 feet, with orienta-
tion of the commercial area to be to Mar»ron'Road, and
directed the staff to determine specific footage.
-^ Roosevelt Commercial: The Counci1. approved
making the Genera. 1 Plan conform to the existing zoning
and instructed the staff to prepare a schedule on the
entire downtown area.

RECESS: Mayor Frazee called a recess at 4:10
and the meeting was reconvened at 4:25 p.m., with all
Councilmen present.
Following the recess, a motion was made in
regard to the Roosevelt Commercial matter heard before
the recess that a moratorium on all C-l and C-2 devel-
opment in that area be enforced for a period of four(4
months.
Coninmark-Beach Colony. The City Planner
stated the subject property consists of 3.2 acres and
now shows as 0-P land use designation in the General
Plan, which conflicts with the zoning and master plan
approved for this site in 1971. The developer is
requesting "RMH" land use designation for this propert
which lies west of Highway I'll and north of San Marcos
Creek, at the southerly tip of the City.
A motion was made to amend the proposed Land
Use Element of the General Plan to reflect "RMH" desig
nation on the subject property and to refer the matter
back to the Planning -Commission for recommendation.
General Plan Amendments: The City Planner
provided the Council with two information requests for
General Plan amendments, stating that Valle Verde
(Loker property) request was a "back-up" request and
that as such, not a valid consideration at this time;
and that a request from Mr. Cason was premature in tha
a complete application has not been filed nor has an
Environmental Impact Report on his property.
Special Treatment Area for the Downtown: The
Council approved the boundaries for Special Treatment
on the downtown area west of 1-5, between Buena Vista
Lagoon and Agua Hedionda Lagoon, as recommended by the
staff, and returned the matter to the Planning Com-
mission for recommendation., Further, the staff was
directed to concentrate their initial efforts on the
area described and recommended by the Planning Com-mission.
Discussion on joint meetings with the PlanningCommission in those months when there are five Tuesday
was held and no action was taken.
By proper, motion, the meeting was adjourned at
5:00 p.m., to the next- regular meeting on August 20,
1974, at 7:00 p.m. in the Council Chambers.

ORDINANCE NO. 9414
AN INTERIM ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF CARLSBAD, CALIFORNIA,
ADOPTED AS AN URGENCY MEASURE EXTENDING
ORDINANCE NO. 9403 FOR EIGHT MONTHS TO
PROHIBIT COMMERCIAL DEVELOPMENT IN THE
ROOSEVELT STREET STUDY AREA.
The City Council of the City of Carlsbad does ordain
as follows:
SECTION 1; Ordinance No. 9403, "An Interim Ordinance
of the City Council of the City of Carlsbad, California, Adopted
As An Urgency Measure Prohibiting Commercial Development in the
Roosevelt Street Area", is hereby extended for eight months to
August 20, 1975.
SECTION 2: This ordinance shall be read once and shall
take effect immediately.
SECTION 3; The City Clerk shall certify to the adoption
of this ordinance and cause it to be published at least once in
the Carlsbad Journal within fifteen days after its adoption.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 17th.. day of December, 1974,
by the following vote, to wit:
AYES: Councilmen Frazee, Chase, Lewis, McComas and Skotnick
NOES: None.
ABSENT: None.
