On February 5, 197^, the City Council by Resolution No. 3316 approved
the tentative map of Carlsbad Tract 73-52.
The owner has requested that the subject tentative map be extended for
a period of one year to February 5, 1976.

Dear Don:
This letter is a request on behalf of Charles Kuderna for exten-
sion of the subject tentative map for one year.
The tentative map was approved by Planning Commission Reso-
lution 1020, dated December 11, 1973.
The completion of the final map has been held up because of the
change in the fire codes.
Additional fire protection is needed, and the Resolution of the
fire flow problem is taking longer than expected.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
'WITH CONDITIONS TENTATIVE MAP (CT 73-52),
A ONE-LOT 22-UNIT CONDOMINIUM PROJECT AND
A ONE-LOT PARKING AND BOAT-LAUNCHING
FACILITY ON PROPERTY LOCATED AT THE END
OF COVE DRIVE IN BRISTOL COVE.

WHEREAS, on;the;llth day of December, 1973, the. Carlsbad
City Planning Commission adopted Resolution No. 1020 recommending
to the City Council that Tentative Map (CT 73-52) be conditionally

WHEREAS^,.the City Council of the City of Carlsbad, on the
5th day of February r 1974, considered the recommendation
of the;Planning' Commission? and . . • :'
3 WHEREASr said Tentative Map has complied with the' require-
ments of the City,of Carlsbad Environmental Protection Ordinance
of 1972 and has been declared to have a nonsignificant impact
on the environment?
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, as follows:
A. That the above recitations are true and correct. '
- B. That Tentative Map (CT 73-52) is hereby approved,
subject to the execution and/or fulfillment of the following
conditions:
1. The development of the property described herein
shall be subject to the restriction's and limitations set
forth herein which are in addition to all the requirements,
limitations and restrictions of all municipal ordinances
and the State and Federal statutes now in force, or which,
hereafter, may be in force for the purpose of preserving
the residential characteristics of adjacent properties-

2, The C.C.& R.'s for this development shall be
submitted to the Planning Director for review and approval
prior to final inspection.
3.' Park-in-lieu fees shall be granted to the City
prior to City Council approval of the Final Map.
4. This development shall meet all of the require-
ments of the Department of Public Health.

5. The developer shall conform to any existing
policies providing for public facilities.
6. If requested by the City Engineer, an amended
Tentative Map shall be submitted for approval by the City
Engineer prior to preparation of the Final Map to assure
compliance to all conditions of approval.
7- :In order to provide for reasonable fire protection
during the construction period, the subdivider shall.main-
tain passable vehicular access to all buildings and ade-
quate fire hydrants with required fire flows shall be
installed as recommended by the Fire Department.
.8. All public improvements shall be made in conformity
to the City of Carlsbad Engineering Design Criteria and
Standard Plans, the Subdivision Ordinance and other City
-. standards,: to the satisfaction of the City Engineer, with-
: out cost to the City of Carlsbad, and free of.all liens
and encumbrances* Improvement plans jEor water and. sewer
:..'•• : systems shall-meet the requirements of the respective :

v . yi"- ,9.0:.:;All:drainage and grading plans shall, be submitted
to the City Engineer for consideration and approval.

shall be placed underground and/or shall be completely
concealed from view.. . -
• 11- Complete plans and specifications shall be sub—
mitted as required for checking and approval, before con-
struction of any improvements is commenced. The subdiv-
ider shall submit the original drawings revised to reflect
as-built conditions, prior to acceptance of the subdivision
improvements by the City. .
12. All land and/or easements required by this
Ordinance shall be granted to the City of Carlsbad without
cost to the City, and free of all liens and encumbrances.*
No easements shall be recorded prior to recordation of
; the final map unless approved by the City Engineer.
13. All facilities provided, other than public ease-
ments, to adequately control drainage on the subject
property,- shall be maintained by the property owner (s)
in perpetuity. /

14. This tentative map approval shall expire one
year from the date of the approval of the City Council
unless extended by the City Council. ^

15. The applicant shall dedicate arfeasement for
public access purposes with an improved sidewalk along
the westerly and southerly property lines in a manner
acceptable to the City Engineer.
C. That said Tentative Map together with the provisions
for its design and improvement and subject to the above conditions
is consistent with all applicable general and specific plans of
