Statement of the Matter:
The Planning Commission is recommending approval of Zone Change 150 and Tentative Map
.CT 73-39(A) on property located on the east side.of Lagoon Lane between Poinsettia Lane
and the Batiquitos Lagoon.
The subject parcel is presently part of Standard Pacific's RD-M ownership to the north.
The 1.5 acre RD-M piece in question is topographically tied more closely to the Spinnaker
Hills property, and is part of the original CT 73-39 subdivision. In essence, the zone
change would result in a zone boundary adjustment to correspond zoning to existing sub-
division boundaries. The revised map does represent an improvement over the original
approved subdivision because the reduction in lots and change in street configuration
should reduce the total amount of earthmoving.
The Land Use Element shows the subject property as residential lowmiedium density at
0-4 dwelling units per acre. The applicant proposes a density of 3.3 dwelling units
per acre. The applicant has met all ordinances and policies, including Public Facilities,
of the City of Carlsbad.

I. REQUEST: The applicant is requesting approval of a Zone
Change from RD-M to R-l-7500 on a 1.5 acre parcel. Also the
applicant is requesting approval of a 307 lot subdivision
over 92,8 acres (including the 1.5 acres which is proposed
to be rezoned). The subject property is located on the east
side of Lagoon Lane between Poinsettia Lane and the Batiquitos
Lagoon.
II. RECOMMENDATION:
A) On Zone Change 150: Staff recommends ZC-150 be approved
for the following reasons:
1) The zone change will correspond zoning boundaries to
existing subdivision boundaries.
2) The zone change is consistent with the General Plan
and all other City policy and ordinance requirements.
B) On CT 73-39(A): Staff recommends that CT 73-39(A) be
approved for the following reasons:
1) The subdivision map meets all requirements of the
subdivision map act.
2) The subdivision map meets all City policy and ordinance
requirements.
Recommended Conditions of Approval p0r CT 73-39(A)
1) The Final Map shall be submitted for approval within one
year from the final action by the City Council on the
Tentative Subdivision Map. The final map shall be in
substantial conformance of the tentative subdivision map
known as Exhibit A, dated December 27, 1974.
2) The development of the property described herein shall be
subject to the restrictions and limitations set forth
herein vjCch are in addition to allQh6 requirements,
limitations and restrictions of all municipal
ordinance and State and Federal statutes now in force,
or which, hereafter, may be in force for the purpose of
preserving the residential characteristics of adjacent
properties.
3) All public improvements shall be made in conformity to
the City of Carlsbad Engineering Design Criteria and
Standard Plans, the Subdivision Ordinance and other City
Standards, to the satisfaction of the City Engineer,
without cost to the City of Carlsbad, and free of all
liens and encumbrances. Improvement plans for water and
sewer systems shall meet the requirements of the respec-
tive service districts.
4) All land and/or easements required by this Ordinance shall
be granted to the City of Carlsbad without cost to the
City and free of all liens and encumbrances. No ease-
ments shall be recorded prior to approval of the final
map unless approved by the City Engineer.
5) All utilities, including provisions for cable TV, shall
be placed underground and/or shall be completely con-
cealed from view.
6) Ornamental street lighting shall be provided for as required
by Municipal Ordinance Code. The developer shall post a
bond and/or cash in the amount necessary to energize said
street lights for an eighteen month period after construc-
tion, to permit the incorporation of the subdivision into
a maintenance district. This shall be done prior to
approval of final map.
7) The improvement plans shall include a report of a
geological investigation and a complete grading plan of
the entire site when required by the City Engineer. The
report and plan shall be prepared by Civil Engineers
licensed by the State of California and experienced in
erosion control. Said Engineer shall certify that they
have investigated the site and prepared data with full
consideration of the consequences to the included and
neighboring properties and conform to the standards of
the Geological Safety Element of the General Plan.
8) In order to provide for reasonable fire protection during
the construction period, the subdivider shall maintain
passable vehicular access to all buildings and adequate
fire hydrants with required fire flows and dry-stand pipes
shall be installed prior to framing construction.
9) Park-In-Lieu Fees shall be granted to the City concurrent
with City Council approval of the Final Map.
10) Street names for the proposed subdivision are not
acceptable as proposed. The applicant shall provide
alternate street names for Hibiscus Court and Camilla (sic)
Circle and shall affix street designations in accord with
the City's adopted street naming policy.

11) The applicant shall offer to dedicate in fee title Lot 81
to the City concurrent with City Council approval of the
Final Map. Because the site is not useable for park
purposes due to extremely steep slopes, no credit toward
Park dedication will be allowed for this lot.
12) The applicant shall offer to dedicate in fee title to
the City the slope^areas within lots 52-60 and 120-122
concurrent with City Council approval of the final map.
Prior to the City's acceptance of the dedication the
applicant shall install a fully automated sprinkler
system and landscaping in a manner acceptable to the
Parks and Recreation Director.
13) A detailed landscape and irrigation plan for the 30'
greenbelt shown on the Lagoon Lane street section shall
be submitted to the Parks and^Recreation Director for
approval. This landscaping and irrigation shall be
installed according to the phasing for Lagoon Lane, prior
to occupancy of the respective units.
14) The sanitary sewer system shall be designed in conformance
with the City of Carlsbad Standards to the satisfaction of
the City Engineer.
15) The specific drainage plan shown on the tentative map is
not approved. Cross-gutters will not be permitted at the
intersection of: Daisy and Rose, Daisy and Camelia, Daisy a
and Iris, Orchid and Primrose. A revised drainage plan
shall be submitted to the City Engineer prior to Final
Map consideration.
16) Slopes shall be 2:1 maximum except where difference in
elevation between top and toe of slope is less than ten
feet.
17) Alignment of Wisteria Circle in the vicinity of Lots
96 and 148 is not acceptable. A revised alignment shall
be submitted to the City Engineer prior to Final Map
consideration.
18) No Final Map will be approved until provisions are made
to extend the offsite sewer to connect to the existing
Ponto sewer and to construct the necessary pumping
system; that is until plans are approved and easements
and bonds are received.
19) Necessary offsite sewer and full-width Lagoon Lane
improvements along Unit 1 frontage shall be constructed
and their corresponding easements dedicated as a
condition of approval of Unit 1. The entire length of
Lagoon Lane right of way within the subdivision boundaries
shall be dedicated with Unit 1.

20) The remaining ful1-2idth Lagoon Lane improvements shall
be constructed as a condition of Unit 2.
21) A paved temporary turn-around shall be provided at any
unit boundary where eight or more lots front on a street
extension created by that unit.
22) Dedication of Lagoon Lane shall include a waiver of direct
access rights from lots shown on the final map, as abutting
thereon. Dedication of Daisy Avenue shall include a
waiver of direct access rights from lots 50, 51, and 52, shown
on the final map as abutting thereon.
III. BACKGROUND:
A) Location: The subject property is located easterly of and
adjacent to Lagoon Lane, approximately 350'.
B) Legal Description:
For ZC-150: Beginning at the center of Section 28 thence
northerly along the quarter Section line, north 0°28'17"
East 133.00 ft; thence south 89007'00" West, 282.00 ft;
thence South 71 42'00" East, 444.33 ft. to the northerly
line of North half, Southeast quarter section 28, thence along
said Northerly line, North 89007'00" West, 705' to the point
of beginning.
For CT 73-39(A): N. %t S.E. %, Section 28, T.125, R.4W.
SBM and portions of S.W.%, N.E.%, Section 28 and portion
of N.W.%, S.W.%, Section 27, S.B.M. City of Carlsbad.
C) Site Description: The subject property is vacant sloping
land covered with coastal scrubs vegetation. No public
improvements presently exist on the property.
D) Project Description: The project entails two activities:
1) The rezoning of a 1.5 acre parcel from RD-M to R-l-7500.
The subject parcel is presently part of Standard
Pacific's RD-M ownership to the north. The 1.5
acre RD-M piece in question is topographically tied
more closely to the Spinnaker Hills property, and is
part of the original CT 73-39 subdivision. In
essence, the Zone Change would result in a zone
boundary adjustment to correspond zoning to existing
subdivision boundaries.
2) The applicant proposes a revised tentative map for the
Spinnaker Hills subdivision. The existing tentative
map (CT 73-39) was recently granted a 6 month time
extension by the City Council. The revised map which
has been submitted for your consideration contains
the following changes:

F) Surrounding Land Use: The project is bounded on all sides
by undeveloped land. The area does have a few scattered
residences and agricultural businesses. The closest
neighbor of any scale is the Alta Mira development to the
northwest.

Environmental Impact Requirement: The project was covered
by the EIR for the Ayers Master Plan application. Staff
has determined that a new EIR is not necessary since the
project has not significantly changed from that anticipated
in the Ayers Master Plan. Copies of the EIR will be made
available to the Commission and Council prior to hearing.
Parks Ordinance Requirements: The Parks and Recreation
Director has determined that in lieu fees be required for the
subject property. The applicant will be providing two
greenbelts on the site which can be credited for up to
25% reduction in in-lieu fees. The first greenbelt, shown
on the typical street section for Lagoon Lane, is 30' wide
with a 5' meandering sidewalk and variable berming. This
greenbelt provides the connecting link to the open space
corridor which extends from Palomar Airport Road to Batiquitos
Lagoon. The second greenbelt is lot 81 which will be left
in its natural state. This greenbelt will be mainly visual
because of its steep slope.

J. Public Facilities Policy: The City has received letters
from the Carlsbad Unified School District and Carlsbad
Municipal Water District stating that public facilities
will be available to serve this project. Copies of these
letters have been attached.
IV. MAJOR PLANNING CONSIDERATION:
1) Does the Revised Map improve upon the original approved
map?
2) Can adequate public improvements and facilities be
provided with each phase of development?
V. DISCUSSION OF SPECIFIC ITEMS:
The revised map does represent an improvement over the originally
approved subdivision. The reduction in lots and change in
street configuration should reduce the total amount of earth-
moving. Lot 81 will be offered to the City as an open space
easement.
Conditions #19, 20, and 21 address the phased construction of
improvements. Dedication of the full right of way for Lagoon
Lane will be required with Unit 1. Also, adequate turn arounds
will be required for streets which stub out at unit boundaries.

The Governing Board of the school district at a meeting held on
January 13, 1975 reviewed the information presented by your department
concerning the proposed real estate development known as CT 73-39
CZC-150) consisting of 307 residential units.
As a result of this review, it is estimated that from the number and
type of residences planned that there may be from 270 to 280 school age
children residing in the project when it is completed and occupied.
The district does not have facilities to provide for a single-session
educational program for children who will be residing'in this proposed
development. In addition, the district does not have any funds to
provide for facilities to howe. thes_e children^.
An agreement has been reached with the developer to provide financial
assistance for school facilities.
It will be greatly appreciated if copies of this letter are made avail-
able to members of the City Council and the Planning Commission.

CONDITIONS TENTATIVE MAP (CT 73-39) TO ALLOM
WHEREAS, on the 9th day of October, 1973, the Carlsbad
City Planning Commission adopted Resolution No. 977, recommending
to the City Council that Tentative Map [CT 73-39) be condi-
tionally apppoved; and
WHEREAS, the City Council of the City of Carlsbad, on the
7th day of' November , 1973, considered the recommendation
of the Planning Cornmission; and
WHEREAS, said Tentative Map has complied with the require-
ments of the "City of Carlsbad Environmental Protection
Ordinance of 1972" and has been declared to be an ongoing
project covered by EIS 114:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, as follows:
A. That the above recitations are true and correct.
B. That Tentative Map (CT 73-39) is hereby approved,
subject to the execution and/or fulfillment of the following
conditions:
1. The recorded restrictions for the subdivision shall include the minimum lot size and width reauirements, evidence of which shall be submitted to-the City Planning Director prior to approval of the Final Map. The minimum for this subdivision shall be 7500 square foot lot with a minimum of
60 feet of lot width.
2. That Lot No. 's 1, 288 and 289, as shown on the final revised tentative map dated September 17, 1973, shall be shown on the approved landscape plan (see #16) with 3 to 1 or flatter slopes between the pad and the west property line. Said slope area to be heavily landscaped and irrigated and shall be
added to the adjacent 30 foot wide green belt. Said landscape plan shall show a minimum 5 foot high solid decorative block wall on the west side of the lot pads.
4. Park-in-lieu fees shall be granted to the City prior to approval of the Final Map.
5. An open space easement shall be granted to the City of Carlsbad for that slope area shown adjacent to Lagoon Lane for the full frontage of the subject property except for the roadway openings.
6. The developer is encouraged to work with the
Carlsbad Unified School District to provide for
future school requirements that will result from the proposed development.

to be a restricted access street in this instance.
14. Street names shall be subject to approval and
shall be designated in accordance with the standards
and policies adopted by the Flanning Conmission on
file in the Planning Department. Said names shall
be approved by the Planning Director prior to recordation of the Final Map.
15. The proposed dedication and improvement of Lagoon Lane shall be completed for the full frontage of the subject property on the basis of a 99.5 foot full
street. A detailed landscape and irrigation plan for
the proposed 30 foot side green belt and the adjacent fill slope shall be submitted as a part of the
required improvement plans for the Planning Director's
consideration and approval. Prior to this issuance
of occupancy clearance for the first residence and/or model of this subdivision, the green belt area and
adjacent slope shall be landscaped and irrigated in a
manner acceptable to the Planning Director.
16. Prior to any occupancy clearnace, the proposed trunk line extension from the Ponto Trunk line to the proposed pump station at Lagoon Lane shall be installed in a manner acceptable to the City Engineer. This subdivision shall be served from this proposed sewer facility. If the City Engineer determines this is not a feasible solution, the developer should provide an alternate solution to the satisfaction of the City
Engineer. No permits shall be issued on this subdi- vision until plans have been completed and a clear
indication exists that this proposed sewer extension
shall exist at the time that it will be needed by the
dwelling units in this subdivision.
17. The parcel indicated on the Final Revised Tenta- tive Map dated 9-17-73 as "not a part" shall be dedicated to the City of Carlsbad encompassing this new lot.
C. That said Tentative Map together with the provisions for
its design and improvement and subject to the above

WHEREAS, a verified application for a certain property, to wit:
Beginning at the center of Section 28 thence northerly along the
quarter Section line, north 0°28'17" East 133.00 ft; thence South

significantly changed from that anticipated in the Ayers Master Plan; and
WHEREAS, at said public hearing, upon hearing and considering the testimony
and arguments, if any, of all persons who desired to be heard, said Commission
considered all factors relating to the Zone Change and found the following facts
and reasons to exist:
1. The zone change will correspond zoning boundaries to existing sub-
division boundaries.
2. The zone change is consistent with the General Plan and all other
City policy and ordinance requirements.

WHEREAS, a verified application for a certain property, to wit:
N. 1/2, S.E. 1/4, Section 28, T.125, Range 4 west, San Bernardino
Meridian and portions of S.W. 1/4, N.E. 1/4, Section 28 and
portion of N.W. 1/4, S.W. 1/4, Section 27, San Bernardino
Meridian, City of Carlsbad, shown on file in the Planning
Department as Exhibit A, dated 12/27/74;
has been filed with the City of Carlsbad and referred to the Planning Commission
and
WHEREAS, said verified application constitutes a request as provided by
Title 21 of the "Carlsbad Municipal Code"; and
WHEREAS, the applicant has complied with the Public Facility Policy of the
City of Carlsbad and has provided the necessary information which insures Public
Facilities will be available and current with need; and
•WHEREAS;-the-sttbject application has complied with the requirements of the
City of Carlsbad "Environmental ProtecCion Ordinance of 1972", because the
project was covered by the EIR for the Ayers Master Plan application. It has
been determined that a new EIR is not necessary since the project has not

WHEREAS, said Commission considered all factors relating to the Tentative
Map and found the following facts and reasons to exist:
1. The subdivision map m-ets all requirements of the subdivision map act.
2. The subdivision map meets all City policy and ordinance requirements.
MOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Carlsbad as follows:
A) That the above recitations are true and correct.
B) That a tentative map is approved to allow a 307-lot subdivision over
92.8 acres on property located on the east side of Lagoon Lane between
Poinsettia Lane and the Batiquitos Lagoon, and is subject to the
following conditions:

1) The Final Map shall be submitted for approval within one year
from the final action by the City Council on the Tentative Sub-
division Map. The final map shall be in substantial conformance
of the tentative subdivision map known as Exhibit A, dated
December 27, 1974.
2) The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all the requirements, limitations and restrictions of
all municipal ordinance and State and Federal statutes now in
force, or which, hereafter, may be in force for the purpose of
preserving the residential characteristics of adjacent properties
3) All public improvements shall be made in conformity to the City o
Carlsbad Engineering Design Criteria and Standard Plans, the Sub-
division Ordinance and other City Standards, to the satisfaction
of the City Engineer, without cost to the City of Carlsbad, and
free of all liens and encumbrances. Improvement plans for water
and sewer systems shall meet the requirements of the respective
service districts.
4) All land and/or easements required by this Ordinance shall be
granted to the City of Carlsbad without cost to the City and free
of all liens and encumbrances. No easements shall be recorded
prior to approval of the final map unless approved by the City
Engineer.
5) All utilities, including provisions for cable TV, shall be placed
underground and/or shall be completely concealed from view.
6) Ornamental street lighting shall be provided for as required by
Municipal Ordinance Code. The developer shall post a bond and/
or cash in the amount necessary to energize said street lights
for an eighteen month period after construction, to permit the
incorporation of the subdivision into a maintenance district.
This shall be done prior to approval of final map.
7) The improvement plans shall include a report of a geological
investigation and a complete grading plan of the entire site when
required by the City Engineer. The report and plan shall be
prepared by Civil Engineers licensed by the State of California
and experienced in erosion control. Said Engineer shall certify
that they have investigated the site and prepared data with full
consideration of the consequences to the included and neighborhin
properties and conform to the standards of the Geological Safety
Element of the General Plan.
8) In order to provide for reasonable fire protection during the
construction period, the subdivider shall maintain passable
vehicular access to all buildings and adequate fire hydrants with
required fire flows and dry-stand pipes shall be installed prior
to framing construction.
9) Park-In-Lieu Fees shall be granted to the City concurrent with
City Council approval of the Final Map. A 25% reduction in the
in-lieu fees will be allowed for the following dedications and
improvements:
a) The applicant shall offer to dedicate in fee title Lot 81
to the City concurrent with City Council approval of the
Final Map.

b) The applicant shall offer to dedicate in fee title to the
City the slope areas within lots 52-60 and 120-122 concurrent
with City Council approval of the final map. Prior to the
City's acceptance of the dedication, the applicant shall
install a fully automated sprinkler system and landscaping
in a manner acceptable to the Parks and Recreation Director.
c) A detailed landscape and irrigation plan for the 30' green-
belt shown on the Lagoon Lane street section shall be sub-
mitted to the Parks and Recreation Director for approval.
This landscaping and irrigation shall be installed according
to the phasing for Lagoon Lane, prior to occupancy of the
respective units.
10) All manufactured slopes with a slope ratio more than 3:1 and a
height more than 5 ft. shall be hydra seeded with quick growing
plants as an interim for erosion control purposes.
11) Street names for the proposed subdivision are not acceptable as
proposed. The applicant shall provide alternate street names for
Hibiscus Court and Camilla (sic) Circle and shall affix street
designations in accord with the City's adopted street naming
policy.
12) The sanitary sewer system shall be designed in conformance with
the City of Carlsbad Standards to the satisfaction of the City
Engineer.
13) The specific drainage plan shown on the tentative map is not
approved. Cross-gutters will not be permitted at the inter-
section of: Daisy and Rose, Daisy and Camelia, Daisy and Iris,
Orchid and Primrose. A revised drainage plan shall be submitted
to the City Engineer prior to Final Map consideration.
14) Slopes shall be 2:1 maximum or as approved by the City Engineer.
15) Alignment of Wisteria Circle in the vicinity of Lots 96 and 148
is not acceptable. A revised alignment shall be submitted to the
City Engineer prior to Final Map consideration.
16) No Final Map will be approved until provisions are made to extend
the offsite sewer to connect to the existing Ponto sewer and to
construct the necessary pumping system; that is until plans are
approved and easements and bonds are received.
17) Necessary offsite sewer and full-width Lagoon Lane improvements
along Unit 1 frontage shall be constructed and their correspond-
ing easements dedicated as a condition of approval of Unit 1.
The entire length of Lagoon Lane right of way within the sub-
division boundaries shall be dedicated with Unit 1.
18) The remaining full-width Lagoon Lane improvements shall be con-
structed as a condition of Unit 2.
19) A paved temporary turn-around shall be provided at any unit
boundary where eight or more lots front on a street extension
created by that unit.
20) Dedication of Lagoon Lane shall include a waiver of direct access
rights from lots shown on the final map, as abutting thereon.
Dedication of Daisy Avenue shall include a waiver of direct
access rights from lots 50, 51 and 52, shown on the final map as
abutting thereon.
