Statement of the Matter:
The Planning Commission is recommending approval of a tentative map (CT 74-23) on
property located on the west side of Monroe Street between Park Drive and Magnolia
Avenue. .The subject property was recently granted a panhandle lot variance by the
Planning Commission.
The project will create three panhandle lots and five street-fronting lots out of three
existing lots. The lots fronting on Monroe Avenue and Park Drive in the vicinity of
the project range in size from about 10,000 square feet to one acre. Many of these lots
would be subdividable in the near future and some have already been subdivided into
panhandle lots. The lots fronting on Andrea Lane are approximately 7500 square feet in
area.
The project conforms to the General Plan designation of low medium density residential
at 0-4 dwelling units per acre. The Commission has noted that the subject property is
restricted by unusual configuration and the location of existing structures. Given these
limitations, staff believes that the proposed subdivision is acceptable.
The applicant has met all ordinances and policies including Public Facilities of the
City of Carlsbad.

Staff Recommendations to City Manager: Staff recommends that tentative map (CT 74-23)
be approved for the reasons outlined'in Planning Commission Resolution No. 1133. If
the City Council concurs with the Planning Commission recommendation, the Council should
direct the City Attorney to prepare the necessary documents.

The Council should make a point of viewing this property,
particularly as it relates to Requirement #11 which provides
.for the relocation of the four palm trees. The property owner
at 3785 Monroe, while technically part of the proposed sub-
division, is not involved with a physical change on that portion
of his property which includes his residence and the four palm
trees. Although he does not oppose the improvements in front
of his property, he does not wish to have the trees moved onto
his property. If this is required, he has-indicated that he
will withdraw his property from the project.
The proposed curb line would run through 'the trees and there is not
sufficient room to relocate the trees on City property. The developer
could take several alternative approaches but those approaches would
either postpone the improvements or eliminate the requirement for them.
It is therefore recommended that the Council give consideration to
the removal of the trees. If this is not acceptable, the tentative
map should be approved as recommended by the Planning Commission.
Counci1 Action
2-18-75 The matter was continued to March 4, 1975.
3-4-75 The City Attorney was instructed to prepare the necessary documents
for approval of the tentative map for Carlsbad Tract 74-22, subject
to the conditions imposed by the Planning Commission, excepting
condition #11 which was deleted. The staff was requested to
cooperate with the developer in the removal of the trees.

I. REQUEST: The applicant is requesting approval of an 8-lot subdivision
on 2.36 acres located on the west side of Monroe Street between Park
Drive and Magnolia Avenue. The subject property was recently granted
a panhandle lot variance by the Planning Commission.
II. RECOMMENDATION: Staff recommends that the Tentative Map be APPROVED
based on the following justification:
1. The tentative map meets all.requirements of the approved pan-
handle variance for the subject property.
2. The tentative map meets all City Ordinance and policy require-
ments.
3. The tentative map meets all requirements of the Subdivision
Map Act.
Recommended Conditions of Approval:
1. The Final Map shall be submitted for approval within one year
from the final action by the City Council on the Tentative Sub-
division Map. The Final Map shall be in .substantial conformance
of the Tentative Subdivision Map known as Exhibit B, dated
January 22, 1975.
2. The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all the requirements, limitations and restrictions of
all municipal ordinance and State and Federal statutes now in
force, or which, hereafter, may be in force for the purpose of
preserving the residential characteristics of adjacent properties.
3. All public improvements shall be made in conformity to the City
of Carlsbad Ennireerinq Design Criteria and Standard Plans, the
Subdivision Ordinance and other City Standards, to the satisfaction
of the City Engineer, without cost to the City of Carlsbad, and
free of all liens and encumbrances. Improvement plans for water
and sewer systems shall meet the requirements of the respective
service districts.

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF CARLSBAD, CALIFORNIA, CONCERNING THE TENTATIVE
MAP TO ALLOW AN 8-LOT SUBDIVISION ON 2.36 ACRES LOCATED
ON THE WEST SIDE OF MONROE STREET BETWEEN PARK DRIVE
AND MAGNOLIA AVENUE. CASE MO. CT 74-23, APPLICANT:
MICHAEL STRAUS (AGENT).
WHEREAS, a verified application for a certain property, to wit:
All that portion of Tract 253 of Thum Lands, recorded with the
San Diego County Recorder on December 9, 1915, and further
described in the files of the Planning Department;
has been filed with the City of Carlsbad and referred to the Planning Commissio
and
WHEREAS, said verified application constitutes a request as provided by
Title 21 of the "Carlsbad Municipal Code"; and
WHEREAS, the applicant has complied with the Public Facility Policy of the
City of Carlsbad and has provided the necessary information which insures Public
Facilities will be available and current with need; and
WHEREAS, the subject application has complied with the requirements of the
City of Carlsbad "Environmental Protection Ordinance of 1972" because it is
small and in an already developed portion of the City; and
WHEREAS, said Commission considered all factors relating to the Tentative
Map and found the following facts and reasons to exist:
1. The Tentative Map meets all requirements of the approved panhandle
variance for the subject property.
2. The Tentative Map meets all City Ordinance and Policy requirements.
3. The Tentative Map meets all requirements of the Subdivision Map Act.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Carlsbad as follows:
A) That the above recitations are true and correct.
B) That a Tentative Map is approved to allow an 8-1ot subdivision on
2.36 acres located on the west side of Monroe Street between Park
Drive and Magnolia Avenue, and is subject to the following conditions:
1) The Final Map shall be submitted for approval within one year
from the final action by the City Council on the Tentatave Sub-
division Map. The Final Map shall be in substantial conformance
of the Tentative Subdivision Map known as Exhibit B, dated
January 22, 1975, on file in the Planning Department.

4) All land and/or easements required by this Ordinance shall be
granted to the City of Carlsbad without cost to the City and free
of all liens and encumbrances. No easements shall be recorded
prior to approval of the Final Map unless approved by the City
Engineer.
5) All utilities, including provisions for cable TV, shall be placed
underground and/or shall be completely concealed from view.
6) In order to provide for reasonable fire protection during the
construction period, the subdivider shall maintain passable
vehicular access to all buildings and adequate fire hydrants with
required fire flows and dry-stand pipes shall be installed prior
to framing construction.
7) Park-In-Lieu Fees shall be granted to the City concurrent with
City Council approval of the Final Map.
8) Street trees, when required by the City, shall be installed by
the applicant at his expense. Trees shall be of a type approved
by the Parks Department and shall be installed to their specifi-
cations. If removal of any existing trees is required by the
City, said removal shall be at the applicant's expense. It shall
be the responsibility of the applicant to make all arrangements
with the Parks Department concerning the requirements of this
condition. These arrangements are to be made prior to approval
of the Final Map.
9) An additional 9' right of way along the subdivision boundary ad-
joining Park Drive shall be dedicated concurrent with City
Council approval of the Final Map. Property line radius at Park
and Monroe shall be 20'.
10) The developer shall construct complete half street improvements
for Monroe Street and Park Drive prior to the issuance of
building permits.
11) Prior to the construction of Monroe Street improvements, the
applicant shall relocate all existing trees which abut the sub-
division. The trees shall be moved to the right of way's
westerly boundary, in a location where they will not disrupt the
public improvements.
12) Lot 1 access rights to Monroe and Park shall be dedicated, except
along the southeasterly 50' adjoining the Park Drive right of
way.

13) The City will not accept the proposed 40' wide drainage and sewer
easement at the southerly boundary of Lots 1, 3 and 5 for public
maintenance. The City Council must approve a private sewer ease-
ment for these lots. i
14) The developer shall enter into an agreement with the City to
participate in a storm drain district of which the intersection
of Monroe and Park is a part.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Carlsbad
Planning Commission held on January 28, 1975 by the following vote, to wit:
