Council Action 2-18-75 Resolution #3600 was adopted, establishing the prevailing wage rates for contracts involv.ing public works projects. .. .. 1 2 3 4 5 6 7 0 9 10 11 12 13 14 15 16 17 18 19 20 21 22 ’ 23 24 25 26 27 28 RESOLUTION NO. 3600 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA SPECIFYING THE GENERAL PREVAILING NAGE RaTES AS REQUIRED IN PUBLIC WORKS PROJECTS WHERFAS, Section 1773 of the Labor Code of the State.of Zalifornia requires that the general prevailing rate of per diem vages and the general prevailing rates for legal holiday and Bvertime work in t.he locality in which a contract for public work is to be performed for each craft, classification or type of sorkman needed to execute the contract shall be specified in the :all for bids for the contract and in the bid specifications and in the contract itself; and WHEREAS, Section 1773 has been amended to provide that in Lieu of specifying the prevailing wage rates in such call for bids the awarding body may refer to copies thereof at its principal. 3ffice; and’ WHEREAS, the provisions of Section 1773 of the Labor Code Df the State of California provide that where the awarding body Zhooses to refer to a copy of the prevailing wage rate on file at its principal office in lieu of specifying them in each call for Dids, the awarding body shall publish its determination of the prevailing wage rates in a newspaper of general circulation at least one time during each year, and, if there is any change in the prevailing wage rates during the course of any year, the awarding body shall specify the changes in the first call for bids nade by the awarding body thereafter; and WHEREAS, the City of Carlsbad has compiled a schedule of the prevailing wage rate in this area for each craft, classification 1 -2 2 4 G U E 7 e 9 1c 31 12 13 14 15 16 27 18 19 20 21 22 23 24 25 . 26 27 28 or type of workman needed to execute contracts for public works; and WHEREAS, a copy of the said schedule, marked Exhibit “A”, is attached hereto and incorporated herein by reference thereto; and WHEREAS, the City Council of the City of Carlsbad, having heard the testimony of the City.Engineer and having reviewed the said schedule determining that the rate of per diem wages and the - general prevailing rates for legal holiday and otzrtime work for each craft, classification or type of workman needed to execute contracts for public works set forth in the said schedule is the prevailing wage rate for each craft, classification or type of workman needed to execute contracts for public works in this area; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad that the schedule of prevailing rate of per diem wages and the general prevailing rates’for legal holiday and overtime work for each craft, classification or type of workman needed to execute contracts for public works is that set forth in Exhibit “A“, attached hereto and incorporated herein by reference there to ; BE IT FURTHER RESOLVED that, in lieu of specifying the said prevailing wage rates in each call for bids, the City of Carlsbad shall refer to a copy of the said prevailing wage rates on file with the City Clerk of the City of Carlsbad. BE IT FURTHER RESOLVED that the City Clerk is directed to cause the publication of this resolution in the Carlsbad Journal, a newspaper of general circulation published in the said City of Carlsbad. Where dual cards are required by Employer, the employee will receive 1Oc per hour above the rate of his classification. NOTE: Under the new Agreement Owner-Operators are employees. Therefore they must receive the appropriate hourly wage and all fringe benefits must be paid for them. An Owner-Operator may not under P.U.C. regulations be paid less than the prescribed P.U.C. rates for the equipment used, and the fringe benefits may not be deducted from the P.U.C. minimum rates.
