Statement of the Matter
The City Council by Resolution No. ^4»o £ has expressed its
intent to include employees hir.ed to perform identification
and communication duties in the Police Department and who were
in this employment on August 4, 1972, as Safety Members in the
Public Employees Retirement System.
To implement the Council's intent it is now necessary to adopt
an ordinance authorizing an amendment to the City'1 s contract
with the Public Employees- Retirement System.

ORDINANCE NO. 1177
AN EMERGENCY ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF CARLSBAD, CALIFORNIA AS AN
URGENCY MEASURE AUTHORIZING AN AMENDMENT
TO THE CONTRACT BETWEEN THE CITY COUNCIL
AND THE BOARD OF ADMINISTRATION OF THE
CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT
SYSTEM TO ALLOW CERTAIN POLICE COMMUNI-
CATORS TO ELECT.TO BE SAFETY MEMBERS OF
SAID SYSTEM.
The City Council of the City of Carlsbad, California,
does ordain as follows:
SECTION 1: That an amendment to the Contract between
the City Council of the City of Carlsbad and the Board of
Administration, California Public Employees' Retirement System
is hereby authorized, a copy of said amendment being attached
hereto, marked "Exhibit A", and by such reference made a part
ihereof as though herein set out in full.
I SECTION 2; The Mayor of the City of Carlsbad is hereby
authorized, empowered, and directed to execute said amendment for
and on behalf of said Agency.
SECTION 3; This ordinance is adopted pursuant to the
authority vested in the City of Carlsbad pursuant to California
Government Code Sections 36934 and 36937 and is hereby declared
to be an urgency ordinance. The facts constituting the urgency
are as follows:
"The police communicators of the City of Carlsbad
have an opportunity to be designated local police
safety employees of the Public Employees Retire-
ment System. Such a designation constitutes a
significant economic benefit to such employees. It is also a
morale factor which will directly affect the
efficiency of the Police Department. Such oppor-
tunity will be lost if the contract with the
Retirement System is not amended by April 1, 1975.
There is not sufficient time to accomplish the
amendment unless it is immediately approved, which
requires an urgency ordinance."
SECTION 4; This ordinance shall be read once and shall
take effect immediately.

SECTION 5; Prior to the expiration of fifteen days
from the passage thereof, the City Clerk shall publish it at
least one time in the Carlsbad Journal, a newspaper of general
circulation, published and circulated in the City of Carlsbad.
PASSED AND APPROVED at a regular meeting of the Carlsbad
City Council held on the 18th day of March , 1975,
by the following vote, to wit:
AYES: Councilman Frazee, Chase, Lewis ,Skotnicki and
Councilwoman Casler
NOES: None
ABSENT: None

The Board of Administration,- Publ.il c Employees" Retirement
System, hereinafter referred to as Board and the CITY COUNCIL
of the CITY OF CARLSBAD, hereinafter referred to as Public
Agency, having entered into a contract under date of December
23, 1955, effective January I, 1956, as amended effective
July 1, 1957, January lf 1959, March 5, 1959 and March 4r 1975,
and as provided by Chapters 170 and 316, Statutes of 1971,,
which provide for participation of Public Agency in said systeiri/
Board and PUblic Agency hereby agree as followss
The following said paragraph shall be added to paragraph 5
of said contract: ,
"Local policemen shall include persons who are employed
to perform identification and communication duties in
the Police Department who are not now local safety members
and who were in such employment on. August 4,, 1972 and ~ :
who elect safety membership within 60 days of the
effective date of this amendment." • .
This amendment shall be attached to said contract and
shall become effective on the eighteenth, day of.March, 1975*
