Baldwin ELIMINATION OF MUNICIPAL CODE Assistant City SECTION 14.16.110/"EXCHANGING METERS" Manager Statement of the Matter Staff has found that there are conflicting sections in the Municipal Code regarding water meter exchanges. Section 14.16.060, "Installation Charges", provides that in the event that the customer wishes to exchange a smaller meter for a larger one, he shall not be required to pay any charge. If he substitutes a larger meter for a smaller one, he shall pay the usual charge for the larger meter. Section 14.16.110, "Exchanging Meters", provides that when a consumer exchanges a smaller meter for- a larger one, a $35.00 credit shall be applied to the computed cost of the larger meter. When a larger meter is exchanged for a smaller meter, the consumer shall then pay the pre- vailing installation charge for the smaller meter size. In staff's opinion, the provisions of Section 14.16.060 should prevail in order to encourage the use of smaller meters . Exhibit Ordinance No . tyQ Ity repealing Section 14.16.110. The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1: Chapter 14.16 of the Carlsbad Municipal Code is hereby amended by repealing Section 14.16.110. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adop- tion.
