Connection by the City of Oceanside to the Administrate
Joint Sewer System
Statement of the Matter
On June 20, 1972, the City Council authorized the execution of an
agreement for temporary connection by the City of Oceanside to
the Joint Sewer System. This agreement was extended in July of
1974 to terminate on July 1, 1975. However, due to delays in ob-
taining the grant funds for this project, the completion date has
again been set back, and Oceanside has requested the agreement be
extended to terminate "upon the completion of Oceanside's Buena
Vista pump station -and acceptance thereof by Oceanside". This
project is now under construction and should be completed in
November 1975.
The Joint Advisory Committee, at their March 26, 1975 meeting
recommended approval of the second supplement to this agreement.
Approval is needed by all member agencies of this supplement.

2 . SECOND SUPPLEMENT TO AGREEMENT FOR
TEMPORARY CONNECTION BY CITY OF OCEANSIDE3
4 THIS AGREEMENT is made and entered into as of the 6th
5 of May , 1975, by and among the CITY OF OCEANSIDE,
6 ("Oceanside")
7 .and
8 VISTA SANITATION DISTRICT (-"Vista") , the CITY OF CARLSBAD
9 ("Carlsbad"), BUENA SANITATION DISTRICT ("Buena"), SAN MARCOS
10 COUNTY WATER DISTRICT ("San Marcos"), LEUCADIA COUNTY WATER
11 DISTRICT ("Leucadia") and ENCINITAS SANITARY DISTRICT ("Encinitas"
12 who are hereinafter sometimes referred to collectively as
13 "Owner's".
14 RECITAL
15 Oceanside and the Owners have heretofore entered into an
16 AGREEMENT FOR TEMPORARY CONNECTION BY CITY 'OF OCEANSIDE dated
17 July 5th, 1972 and FIRST SUPPLEMENT TO AGREEMENT FOR TEMPORARY
18 CONNECTION BY CITY OF OCEANSIDE dated July 16th, 1974, and wish
19 to amend said Agreement and First Supplement in the manner
20 hereinafter set forth.
21 NOW, THEREFORE, IT IS AGREED BETWEEN OCEANSIDE AND THE
22 OWNERS AS FOLLOWS:
23 Section 2 of the AGREEMENT FOR TEMPORARY CONNECTION BY CITY
24 OF OCEANSIDE dated July 5th, 1972, as amended by FIRST SUPPLEMENT

25 TO AGREEMENT FOR TEMPORARY CONNECTION BY CITY OF OCEANSIDE dated
26 July 16th, 1974, is hereby further amended to read as follows:
27 "Section 2. Term of Agreement. This Agreement and
28 the permission given to Oceanside for the temporary

connection specified herein shall terminate upon the
completion of construction of Oceanside's Buena Vista
pump station and acceptance thereof by Oceanside. In
addition, Oceanside or Owners may terminate this Agreement
by giving the other party a minimum of thirty (30) days'
•written notice and upon such termination the permission
given to Oceanside for the temporary connection specified
herein shall cease."
IN WITNESS WHEREOF, each party hereto has caused this Second
Supplement to the Agreement to be signed by its respective
officials heretofore duly authorized by the legislative bodies
thereof.

2 A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA APPROVING
3 AN AGREEMENT BETWEEN THE CITY OF CARLSBAD
AND THE CITY OF OCEANSIDE FOR THE SECOND
4 SUPPLEMENT TO AGREEMENT FOR TEMPORARY
CONNECTION BY THE CITY OF OCEANSIDE TO
5 THE JOINT SEWER SYSTEM AND AUTHORIZING
THE MAYOR TO EXECUTE SAID AGREEMENT

7 The City Council of the City of Carlsbad, California, does
8 hereby resolve as follows:
9 1. That that certain agreement between the City of Carlsbad
10 and the City of Oceanside for the second supplement to agreement
11 for temporary connection by the City of Oceanside to the Joint
12 Sewer System, a copy of which is attached hereto marked Exhibit
13 A and incorporated herein by reference, is hereby approved.
14 2. That the Mayor of the City of Carlsbad is hereby authorize}!
15 and directed to execute said agreement for and on behalf of the
16 City of Carlsbad.
17 PASSED, APPROVED AND ADOPTED at a regular meeting of the
18 City Council of the City of Carlsbad, California, held on the
19 6th day of May , 1975, by the following vote, to wit:
