CASE NO. V-246, APPLICANT, CLARENCE HALL (AGENT). WHEREAS, a verified application for a certain property, to wit: Lot 74 of Carlsbad Highlands Unit #2 in the City of Carlsbad, per Map No. 2825 filed in the office of the San Diego County Recorder, and further described in the files of the City of Carlsbad Planning Department; has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as providec Title 21 of the "Carl sbad Municipal Code"; and WHEREAS, the public hearing was held at the time and in the place specified in said notice on November 26, 1974; and WHEREAS, the applicant has complied with the Public Facility Policy the City of Carlsbad and has provided the necessary information which in! Public Facilities will be available and current with need; and WHEREAS, the subject application has complied with the requirements the City of Carlsbad "Environmental Protection Ordinance of 1972"; and WHEREAS, at said public hearing, upon hearing and considering the testimony and arguments, if any, of all persons who desired to be heard Commission considered all factors relating to the Variance and found the following facts and reasons to exist: 1. There are no Special circumstances applicable to the subject Property which are not generally applicable to other similarly zoned Properties in the same vicinity. The subject property is comparable in size and shape to nearby properties. 2. There are no special circumstances which restrict utilization ( Property in question. The subject property is afforded similal development rights to adjoining properties. 3. The above recitations are true and correct.
