'Statement of the Matter
The City Council at your April 15, 1975 meeting directed the City
Attorney to prepare the necessary ordinance to amend Sections21.42.040
and 21.58.020 to modify the time limits applicable to conditional use
permits and specific plans. The ordinance to accomplish the amendments
as recommended by the Planning Commission in Resolution No. 1143 is
attached.

ORDINANCE NO. 9423
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, AMENDING
TITLE 21 OF THE CARLSBAD MUNICIPAL CODE
BY REPEALING SECTION 21.42.040 AND BY THE
AMENDMENT OF SECTION 21.58.020 TO REVISE
THE TIME LIMITS APPLICABLE TO SPECIFIC
PLANS AND CONDITIONAL USE PERMITS.
The City Council of the City of Carlsbad, California
does ordain as follows:
SECTION 1: That Title 21, Chapter 21.42 of the Carlsbad
Municipal Code is amended by repealing Section 21.42.040.
SECTION 2: That Title 21, Chapter 21.58 of the Carlsbad
Municipal Code is amended by the amendment of" Section 21.58.020
to read as follows:
"21.58.020 Expiration period. Any conditional use permit
or variance.granted by the Planning Commission or by the City
Council on appeal becomes null and void if not exercised within
the time period specified in the resolution granting the .condi-
tional use permit or variance or if no time period is specified
within eighteen months from the date the conditional use permit
or variance is granted by the Planning Commission or City Council."
EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal within fifteen days after its adoption
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council held on the 6th daY °f 'May r 1975,
and thereafter
PASSED AND ADOPTED at a regular meeting of said Council
held on the 20th day of May , 1975, by the following
