Statement of the Matter : The Planning Commission is recommending approv zone code amendioent to Title 21 of the Carlsbad Municipal Code which would de coverage in the E-A, R-A and R-1 Zones.
The Planning Commission is of the opinion that building coverage requirements in the E-A, R-A and R-1 Zones are intended to apply to habitable and accessor. structures. The current 40% limitation also includes greenhouses. It was Pl Commission's and staff's opinion that the 40% was not intended to include gre houses. It was the opinion of the staff and the Planning Commission that res 40% lot coverage for agricu3tural production was counter productive to the Ge Plan goal of retaining agricultural use-s;

Re: Coverage for Greenhouses
Section 1 - Amend Chapter 21.07 E-A Zone as follows:
A) Section 21.07.020 (4)
"(4) Greenhouses less than 2000 sq. ft. provided all requirement: for yard setbacks and height are met."
B) Section 21.07.040 (12)
"(12) Greenhouses greater than 2000 sq. ft., provided all requir ments for yard setbacks and height are met.

Section 2 - Amend Chapter 21.08 R-A Zone as follows:

"(3) Greenhouses less than 2000 sq. ft. in area. Greenhouses grc than 2000 sq. ft. are permitted by approved Conditional Use Permi only. In either instance all requirements for yard setbacks and height shall be met.
B) Section 21.08.090 Lot Coverage. Lot coverage with buildings anc tures shall not exceed 40% of the lot. Buildings and structures growing or raising plants are not counted as coverage".

Section 4 - Amend Chapter 21.42 Conditional Uses, as follows:

1) Lighting to be directed away from nearby residences and shall nc create undue i 1 1 mi na t i on.
2) Fans shall not create a noise nuisance to nearby residences.
3) Driveways shall be improved with dust control material and be mai n ta i ned .
4) Structure, including panels or coverings shall be maintained anc become a safety hazard or nuisance to the neighborhood.
5) The approving CUP resolution shall contain the time limits of tt and the provisions for periodic review.

REFERENCE: AGENDA BILL NO. 3350
At the last City Council meeting on May 5, a proposed zone code amendment would have amended a section in the €4, Exclusive Agricultural Zone, the R-A, Residential Agricultural Zone and the R-1, Residential Zone that would have eliminated the reference to greenhouses as part of lot coverage.
There was some discussion by the Council of development requirements in each zone, time limit on greenhouses and what constituted a greenhouse structure.
Attached is Exhibit By dated May 13, 1975, which incorporates amendments as discussed by the City Council:

Adds the requirement that yard setbacks and height be met (Sections 1, 2 and 3) Addition of Paragraph 5 (Section 4) which provides for time 1 imits and periodic review.
I believe the foregoing changes will satisfy the issues raised by the City Counci 7.
