BEACH ACCESS STAIRWAY - CONTRACT NO. 1024 - ELM AVE. AT OCEAN ST.
Statement of the Matter
Bids for Contract No. 1024 were opened at 10:00 a.m.• on May 7, 1975
in the office of tl.e City Clerk. Ten bid proposals were submitted;
see Exhibit 1, Bid Summary, for results. The low bid for the contract
was submitted by L.R. Hubbard, Jr. of San Diego in the amount of
$11,74- This bid was 25% under the engineer's estimate of $15,600.
Funds in the amount of $18,000 have been budgeted for this project.
A letter has been received by the City Engineer from the second low
.bidder, Sapper Brothers, Inc., requesting that the low bidder be
declared "nonresponsive" for not formally acknowledging receipt of
Addendum No. 1 in his proposal. Sapper Brothers, Inc. further requests
that the contract be awarded to the second 16w bidder. (See Exhibit 2
for Sapper Brothers letter and. Exhibit 3 for City Engineer's memorandum)

Recommendations
That City Council adopt Resolution No.&,,J�y accepting bids and authorizing
the execution of Contract No. 1024 for construction of a beach access
stairway.
Council Action
5-20-75 Resolution No. 3648, accepting bids and authorizing the
execution of Contract #1024 for construction of a Beach
Access Stairway, was adopted. The Bid was awarded 'to L.R.
Hubbard, Jr. in the amount of $11,742.

Gentlemen:
As you are aware, the apparent low bidder on the subject project
failed to acknowledge receipt of Addendum #1 in his proposal. This
is contrary to your request that said addendum be "acknowledged and
attached to the proposal".
In order to assure that all prospective bidders on this, and future
projects, are basing their proposals on the exact same specifications,
we respectfully request that the apparent low bidder be declared "non-
responsive", and the contract awarded to the second apparent low bidder.

MEMCRANDUM
May 12, 1975

SUBJECT: Sapper Brothers, Inc. letter dated May 6, 1975
protesting award of Contract 1024 to the low
bidder, L.R. Hubbard, Jr.
The Engineering Department on May 1, 1975, issued an addendum to
all plan holders and prospective bidders to clarify two inquiries
as to Item N, "Clean Up", set forth in the Special Provisions for
Contract 1024. The change was as follows:
Original wording:
N. Clean Up
All vegetation, form material and excess steel shall be removed
from the site. Excess excavated material may be spread on the
site if approved by City Engir3er, or removed from the site.
Payment for this item shall he included under excavation and
backfill.
Addendum No. 1 wording:
Please revise Item N, "Clean Up" of the Special Provisions to read:
"All vegetation, form material, excess steel and excess excavated
material shall be removed from the site. Payment for this item
shall be included under excavation and backfill." Please acknowledge
date of receipt of this addendum on the bid proposal.
This department feels the addendum did not have a significant impact
on the scope of work to be performed on the project, but rather was
in the realm of clarification of the Contractor's responsibility as
to final clean up after completion of his work.
At the conclusion of the bid opening on May 7, 1975, the Engineering
Department representative, Mr. Sprehe, questioned the representative
of L.R. Hubbard, Jr. relative to the addendum not being acknowledged
on the bid proposal. His response was that his firm had received the
addendum and thought said addendum was acknowledged in their proposal.
However, the addendum was not acknowledged on the bid proposal. A
letter from L.R. Hubbard, Jr. is attached confirming their knowledge
of the addendum prior to submitting a bid proposal.
Based upon the preceding information and the sentence in the "Notice
Inviting Bids" stating: "The City of Carlsbad reserves the right to

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, ACCEPTING
BIDS AND AUTHORIZING THE EXECUTION OF
CONTRACT #1024 FOR CONSTRUCTION OF A
BEACH ACCESS STAIRWAY
WHEREAS, bids have been received by the City of Carlsbad for
construction of a beach access stairway, located at Elm Ave. and
Ocean St., Contract #1024; and,
WHEREAS, the low bid received for this construction was sub-
mitted by L.R. Hubbard, Jr. in the amount of $11,742; and,
WHEREAS, funds in the amount of $18,000 were budgeted in FY
i 74-75 for this project;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. The bid of $11,742 by L.R. Hubbard, Jr. of San Diego for
Contract T1024, for construction of a beach access stairway,
1oczted at Elm Ave. and Ocean St. is hereby accepted and the
Mayor and City Clerk are hereby authorized to execute a contract
therefor.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City
Council of the City of Carlsbad held the 20thday of May 1975
by the following vote, to wit:
AYES: Councilmen Frazee, Chase, Lewis, Skotnicki and
Councilwoman Casler

Attached is the notice inviting bids for each contract.
Please execute and have both notices published in the Carls-
bad Journal on April 24, 1975.

NOTICE INVITING BIDS
SEALED BIDS will be received at the Office of the City Clerk, City
Hall, 1200 Elm Avenue, Carlsbad, California, until 10:00 AM on the.
7th day of May , 1975 , at which time they will be
opened and read, for perfarming the work as follows:
Beach Access Stairway, Elm Ave. and Ocean Street
Contract No. 1024
No bid will be received unless it is made on a -proposal form furnished
by the Engineering Department. Each bid must be accompanied by cash,
certified check or bidder's bond made payable to the City of Carlsbad,
Zor an amount equal to at least 10 per cent of the amount bid.
The documents included within the sealed bids which require completion
and execution are the following:

The documents shall be affixed with the appropriate signatures and title_
of the persons signing on behalf of the bidder. For corporations, the
signatures of the President or Vice -President and Secretary or Assistant
Secretary are required and the Corporate Seal shall bafixed to ali.
documents requiring signatures. In the case of a partnership, the
signature of at least one general partner is required.
All bids are to be compared on the basis of the Engineer's estimate.
The estimated quantitiesare approximate only, being gaven solely as
a basis for the comparison of bids.
No bid will be accepted from a contractor who has not been licensed in
accordance with the provisions of Chapter 9, Division III of Business
and Professions' Code. The contractor shall state his license number
and classification in the proposal.
Plans, Special Provisions and Contract Documents may be obtained at the
Engineering Department, City Hall, Carlsbad, California, at no cost to
licensed contractors. A nonrefundable charge of none will be required
for each set of plans, special provisions and contract documents for
other than licensed contractors. It is requested that the plans and
special provisions be returned within 2 weeks after the bid opening.
The City of Carlsbad reserves the right to reject any or all bids and
to waive any informality in such bids.
A project tour will be conducted by the City of Carlsbad Engineering
Department at 10:00 AM on April 28, 1975
In accordance with the provisions of Section 1773 of the Labor Code,
the City Council of the City of Carlsbad has ascertained the general

prevailing rate of per diem wages in the locality in which the work
is to be performed for each craft or type of workman or mechanic
needed to execute the contract and has set forth these items in
ti Resolution No. 3600.
A copy of said Resolution is available in the -Office of the City
Clerk in the City of Carlsbad.
Also, the prime contractor shall be responsible to insure compliance
with provisions of Section 1777.5 of the Labor Code of.the State of
California for all occupations with apprenticeships as required on
public works projects above thirty thousand dollars ($30,000) or 20
working days.

Please be advised that the Hubbard Company did in fact have full
E knowledge of addendum #1 when submitting our bid. The addendum
was included in our set of plans and specs when we picked them up.
The fact that the addendum was not noted on the bid form was merely
an oversight.
Again, we had full knowledge of the addendum and look forward to
working with the City of Carlsbad on this fine improvement.
